regular session at 7:30 P. M. in the City Hall,
November 18th, 1936, - Chairman Parkspresiding.
Present
Parks, Patterson, P. A. Palmer, E. B.
Whitson, Mrs. Williams, F. W. Briggs,
L. W. Briggs, Consultant Tilton and
Inspector Nelson.
Absent: Kenneth Baum, Roland Thompson.

MINUTES: All members having received copies of
min:i.tes of the Nov. 4th meeting and no
corrections or alterations being offered,
the minutes were declared aporoved as
written.
VALLELY FINAL.HEARING: Chairman Parks announced
that any persons oresent desiring to sneak on the
petition of Roland Vallely for rezoning of Lot 5,
Block 9, Section One, on Balboa Island from R -2
to 0-1 would now be heard.
ROY Summers stated that he favored the petition.
There being no communications on the subject nor any
other persons present desiring to be heard, the
Chairman declared the hearing closed.
Roland Vallely thanked the commission for their
consideration.
Motion: Moved by Com. Whitson, seconded by L. W.
Briggs, that.the Commission recommend to theCity
Council an amendment to the Zoning Ordinance
changing the zoning of Lots 5 and 6, Block 9, Sec.
One, of Balboa Island, from R -2 to C -1.
Upon call of the roll the motion was lost.
BENNETT HEARING ON VARIANCE: (E. W. Bennett).
Petitioner desires to build sun porch on the exist-
ing dwelling at 908 South Bay Front, Balboa Island,
extending to within five feet of the front of the
lot, which would constitute a 50% variance from,the
front yard - requirement set up in the Ordinance.
Don Kirby, speaking for the petitioner stated that
the adjoining dwelling stands within 3J feet of the
so front of the lots.
Mr. White, owner of Lot 1, Block 4, Section Two,

Motion: Upon motion of Com. Palmer, seconded by Com.
Whitson and carried, the commission decided to allow
the petition of E. W. Bennett for a 50% variance of
the front yard requirement,.reducing same to five
feet, at 908 South Bay Front, Balboa Island.
COMMITTEE APPOINTMENT: Chairman Parks appointed F.
W. Briggs and Inspector Nelson as a committee to make
A study of the entire Balboa Island Bay Front to
determine the average set back of all houses and make
report on same.
TENTATIVE MAP - TRACT NO. 1011. (Strobridge).
The above map was forwarded by the Orange County
Planning Commission together with letter from
Quinton, Dode and Hill -Leeds and Barnard Co, for
tentative approval.
Com. Patterson advised that the commission's
recommendations should be based principally on
street widths and lot areas, together with facilities
for adequate water and sewer systems.
Consiltant Tilton stated this map had been presented
to the ounty anning Commission some time ago and
had been referred back to the applicants for revis-
ion as some of the lots were sub - standard in size.
Map as now presented has been revised and given ten-
tative aoprova.l by the County Commission subject to:
(a) The clearing up of the maintenance of the 5-foot
planting strips, (b) clearing up of the restrictions,
(c) clearing up of the question of whether the
streets would be private or public, (d) that the
plat be revised to Provide an area of not less than
4,000 sq. ft, for each .lot (Lots 4 & 5 not of
sufficient area) and (e) that satisfactory arrange-
ments be made for water supply and sewage disposal.
Motion: Upom motion by Com. Patterson, seconded by
oG m. E. W. Briggs and carried, the commission gave
tentative approval to Tract No. 1011 subject to the
conditions set forth in the letter from the County
Planning Commission accompanying the map and to
the letter of Quinton, Code & Hill -Leeds and Barnard.
RESOLUTION: Com. Patterson presented the following
reso u ion and moved its adoption:
RESOLUTION
OF THE
NEWPORT BEACH CITY PLANNING COMMISSION
WHEREAS, the City of Newport Beach has voted
bonds for the construction of a new sewage disposal
plant and sanitary sewer mains, which will eliminate
the existing nuisance of the old sewage disposal
plants around the bay, and will eliminate the dis-
charging of any sewage effluent into the bay from
city territory; and
WHEREAS, it is the intention and desire of the
residents of Newport Beach to develop the city and
Newport Bay as a recreational center; and
WHEREAS, there are certain unsubdivided areas
fronting on the bay and contiguous to the City of
Newport Beach which, when subdivided; will require
proper sanitation facilities.
NOW, THEREFORE, BE IT RESOLVED by the Planning
Commission of the City of Newport Beach: That the
Orange County Planning Commission be advised of the
desirability of eliminating the discharging of
sewage or sewage effluent into Newport Bay, and
urge that the County Planning Commission give proper
study as to sanitation in considering all new sib-
divisions in and around Newport Bay.
PASSED AND ADOPTED by the City Planning Comm-
ission of the said City of Newport Beach, California,
this 19th day of November, 1936, by the following
vote, to -wit:
AYES: Commissioners Parks, Patterson
Palmer, Whitson, Mrs. Williams,
F.. W. Briggs and L. W. Briggs.
NOES: None.
ABSENT: Commissioners Baum, Thompson.,

I HEREBY CERTIFY that the above and foregoing

CANNERY APPLICATION: (Lots 4, 5, 6'& 7 in Block
29, Lancaster's Addition to Newport Beach).
L. T. Bradbury, representing The Italian Food Prod-
ucts Co of Newport Beach, requested issuance of a
building permit to construct a galvanized iron
warehouse building adjoining the present cannery
building. He stated the proposed new structure
would be used to store cartons and new cans, etc.
and would take the place of the second floor of the
old building recently.damaged by fire which they
would then remove,-'.
In support of his request Mr. Bradbury cited the
issuance of a permit to operate a Fish Cannery when
they began operations and the expenditure of
$28,000.00 during the last forty -five days for fish
and labor.
Discussion brought out the fact that the city could
not prevent the installation of canning machinery in
the proposed warehouse building if they allowed the
building to be constructed and that the Zoning Ord-
inance prohibits fish canning in any part of this
City.
The canneries now operating here had their permits
prior to the adoption of the Ordinance and as zoning
laws are not retreactive tIzey can operate until
destroyed or cease operation, but that additions
to present cannery buildings or new buildings to be
used in connection with an existing fish cannery are
definitely prohibited by the text and intent of
the Zoning Ordinance.
Further, that anolications for the reconstruction of
nonconforming uses of a type prohibited in some
districts, but permitted in others, and in a manner
allowed by the ordinance, have been refused on accoun'
o fF- e proposed reconstruction covering more land
area than the existing non - conforming use. Also,
that the expenditure of money by this cannery for
fish and labor, cited by %r. Bradbury, can continue
even though the ordinance does not permit him to
build the structure.under discussion, therefore his
use of this expenditure of money as an argument in
favor of the application is not pertinent.
Motion: Upon motion by Com. L. W. Briggs, seconded by
Wff - Palmer and carried, the application was denied.
ALLEY ABANDONMENT: Discussion disclosed

Motion: Upon motion by Com. Whitson, seconded by
Com. Palmer and carried, the commission decided to
recommend to the city council that the portion of
the alley in Block 11, of the Balboa Tract lying
between Lots S, 9 &•10 be vacated.

PADWAY Mr. B. Padway, owner of Lots 1 & 2,
Block "P ", Tract #518, asked the commission to
recommend to the Council his request to lease a por-
tion of the city property adjoining his lots on the
south for the purpose of landscaping at his expense.
The request was tabled until the type of fencing.to
be used can be determined.
TRAILER CAMP ORDINANCE: A form of an ordinance deal-
ing with trailer camps was submitted to the commiss-
ion by the city council for recommendation.
Motion: Upon motion by Com. Whitson, seconded by
Tom. —Palmer and carried, the Chairman was author-
ized to appoint a committee Of two.to study the
proposed ordinance and report at the next meeting.
COMMITTEE APPOINTMENT: The chair appointed Commiss-
ioners Patterson and F. W. Briggs as such committee.
J. B. MCNALLY VARIANCE: Inspector Nelson presented
a request for permit to construct a private garage
at 106 Coral, Balboa Island, located within 21 feet
of the alley at the rear of the lots, and recommended .
that it be granted.
Upon motion by Com. Whitson, seconded by Com. Palmer
and carried, the application was approved subject to
the 50% variance clause.
