ROLL CALL: Commissioners present: Reed, Rudd, Keene, Hayton, Copelin, Lind, Longmoor Commissioners absent: Smith, Briggs MINUTES: Minutes of the meeting on October 21, 1954 were approved on motion of Come Copelin, seconded by Come Reed, and carried. AMENDMENTS: #9 2nd hearing on the application of Weaver H. & Eleanor AMENDMENTS R. Smith, and all the property owners of Lots , #39, 4O, 41, 46, 47, and 48 in Tract #682, which all lots face #9 Waterfront Drive and comprise a block of property surrounded by streets and alleys, to change zoning Smith, Weaver from an R -I district to an R-2 district under Ord. & #635 of the City Code. (Property is located on Eleanor R. Waterfront Drive between Avocado and Acacia Avenues, Corona del Mar.) Lots 39,40.41,46, The hearing was declared open. 47, 48, FINDINGS: Said block of lots was zoned R -2 under Tract #682 previous Zoning Ord. #525 and was changed to Rrl under present Zoning Ord. 9635. The property GRANTED immediately to the rear across an alley is in an Rt2 district and adjacent property to the east between Acacia and Begonia Avenues, and Pacific Drive and Second Ave. has been changed from an R -1 to an Rr2 district since Ord. #635 became effective December 26, 1950. No objections were received. The hearing was closed on motion of Come Copelin, seconded by Come Hayton, and carried. FINDINGS: The building sites as proposed herein are of the same size as adjacent recorded lots in the same block which are now zoned R -3. By limiting the district zoning usage the property would be upgraded. Adjacent lots to each side will not be reduced by this subdivision below said recorded sire lots. The Lido Isle Community Association approved the subdivision and no objections were received. The hearing was closed on motion of Com. Copelin:, seconded by Com. Rudd, and carried. Com. Copelin moved that the application be granted with the stipulation that each building site be limited to a single family residence, motion seconded by Com. Rudd, and carried by the following roll call vote, to -wit: ALL AYES Application of Charles W. Masters for a three foot front setback V - #174 for a proposed attached garage building on Hazel Drive in Corona del Mar instead of the ten foot setback required by District . Masters, Charles W. Map #18. The lot has a sharp drop in the rear which limits the actual economical building area. Property is described as Lot 47, Lot 47, Blk. A, Block A. Tract #673, and located at 308 Hazel Drive, Corona del Mar. Tract #673 The hearing was declared open. The applicant was not present nor represented. Com. Section 4, Balboa Island, and located at 216 Onyx Avenue. The hearing was declared open. Lot 9, Blk. 122 Sec. 41 FINDINGS: Similar overhangs have been allowed on surrounding Balboa Island property on Balboa Island due to the small area of lots. Said oveihang will not restrict any movement of vehicles or be detri- mental to other properties. Granted No objections were received. The hearing was closed on motion of Com. Rudd, seconded by Com. Copelin, and carried. Com. Copelin moved that the application be granted, seconded by Com. Keene, and carried by the following roll call vote, to -wit: ALL AYES Application of Ira 0. Hardesty for a fifteen (15) inch overhang V - #176 into the required ten foot (10') rearyard setback facing a fifteen (15) foot alley for a proposed second dwelling unit to Hardesty, Ira C. overhang a proposed double garage attached to an existing front house, in a C-1 -H District. The lot is thirty by eighty feet Lot 1, Block 3, (30f R 801) with an area of 2400 square feet, and described as Newport Bay Tract Lot 1, Block 3, Newport Bay Tract, and located at 300 E. Balboa Blvd., Balboa. The hearing was declared open, set over ' Neither the applicant nor a representative were present. The hearing was closed on motion of Com. Rudd, seconded by Com. Copelin, and carried. Com. Copelin moved that the application be set over for the next regular meeting, seconded by Com. Rudd, and carried. Application of David I. Nielsen for a frontyard setback of five V - #177 (5) feet instead of the twenty (20)foot setback required by District Map #5 and Sections 9104.2 and 9103.55 (a) of the Newport Beach Municipal Code, on property described as Lots 18 and 19, Nielsen, David I. Tract #1136 and in a C -1 -H district; located at 404 -408 West- minster Ave. with fifteen parking spaces off- street along the Lots 18 and 19, alley in the rear. Tract #1136 The hearing was declared open. FINDINGS: The owners of Lots 20, 21, 22, and 23 adjacent to the Granted north have written letters approving the 5 foot front setback. Said setback is necessary to allow sufficient off - street parking in the rear as required by the C -1 -H District. No objections were received. An existing professional building on Lot 17 is set back five feet on the front. CONDITIONS: The sideyard setback on the norhherly side of said Lot #19 shall be a minimum of five feet.. ' #1701, known as Irvine Terrace. Said garage accessory buildings Lots 7 & 8, must be attached by a common wall which would eliminate the use Tract #1700 & of a breezeway or roofed section for legal attachment. FINDINGS: The variations in architecture allowed by detached Granted garages on the front portion of lots creates an interesting tract of houses since said architecture is under control by the developers of said Tract #1700 and Tract #1701. Lot sizes in these tracts are of sufficient width that the garage can be designed and located so as to be pleasing to the viewer. The hearing was closed on motion of Cam. Copelin, seconded by Cam. Cunningham under Subdivision Ord. #650 to Resubdivision Application of the Irvine Co. and Macao Corp, for front setbacks V - #179 in variance with the requirements of Section 9103.15 (a) of the City* Code in Tracts #1700 and ,$1701 as per list on file with the Irvine Co. & Planning Commission Administrative Assistant. Macao Corp. The hearing was declared open. Lots 7 & 8, FINDINGS: The frontyard setbacks as applied for herein are Tracts #1700 consistent with previously allowed setbacks on said property & #1701 and are laid out to allow a more interesting architectural development controlled by the subdividers and developers of , Granted said tracts. The hearing was closed on motion of Cam. Copelin, seconded by Com. Reed, and carried. Cam. Lind moved that the application be granted, seconded by Cam. Hayton, and carried by the following roll call vote, to -wit: ALL AYES Application of E. C. Cunningham under Subdivision Ord. #650 to Resubdivision resubdivide a parcel consisting of all of Lots 7 & 8, Block 142, #3 Resub of Corona del Mar into two R-1 building-sites described as follows: Cunningham, E.C. Bldg. Site #1 - consisting of the northerly 61 feet of Lot& #7 and #8 and the westerly 5 feet of Lot #6. Said site #1 has a Lots 7 & 8, reverse frontage of 61 feet on Orchid Ave. by 70 feet deep and Blk. 142, 4270 square feet in area. Resub B.D.M. Bldg. Site #2 - consisting of the remaining portions.of Late #7 and #8 and westerly 5 feet of Lot #6, not described under Bldg. Granted Site #1, and with a frontage of 71.22 feet on Ocean Blvd, and an average depth of 76.55 feet and an area of 5358.50 square feet. An exception is requested from the lot depth of 80 feet required by Sec. 9254.31 of Ord. #650. The hearing was declared open. - FINDINGS: , Said property has a house oh the rear portion designated as Building Site #1 which is set back from Orchid Ave. so as to allow a reasonable frontyard setback consistent with houses . 113 to the north, and sufficient surrounding depth on other yards. The remaining vacant portion will allow a good building site of legal size with exception of the 80 foot depth. The frontyard setback required along Ocean Blvd. will leave sufficient building area. The subdivision will not be detrimental to adjacent or surrounding property. The hearing was closed on motion of Com. Reed, seconded by Com. Lind, and carried. Com. Reed moved that it be recommended to the City Council that this application be granted, seconded by Com. Coast Highway.. Use Permit #133 formerly issued to Johnson & Sons Lihooln Mercury dealer has expired. Lots 39,40,41,42 The hearing was declared open. Tract #1210 FINDINGS: Off- street parking area as porposed in application #159 is larger and better arranged than is a previous appli- GRANTED . cation Use Permit #133 fora Lincoln, Mercury Auto sales on the same property and which automatically expired October 2, 1954. CONDITIONS: 1. Off- street parking to be as shown on a map attached to the application and made a part of this Use Permit and as stated on the application. 2. Said off - street parking to be maintained with a minim= area of 4500 square feet available for customer parking at all times. -with separate egress and ingress so as to circulate traffic and not cause conjestion. 3. Baltz for an off- street parking on an R-2 lot adjacent across an 'alley to C -1 district U.P. #160 property. Located on Lot 1, Block 441, Corona del Mar Tract, 411 Orchid Ave., Corona del Mar. Baltz, C. Lewis The hearing was declared open. FINDINGS: The R-2 lot proposed to be used for auto parking is Lot 1, Blk.*41, owned by the applicant who also owns the adjacent Rt2 Lot #4 to Corona del Mar the north. Said lot is adjacent across an alley from the applicants Tract C-1 property and its use as a parking lot will not be detrimental to adjacent residential properties. CONDITIONS: Parking is for free use by Baltz Mortuary customers. Granted ' The hearing was closed on motion of Com. Copelin, seconded by Com. Reed, and carried. Com. Copelin moved that the application be granted, seconded by Com. Reed, and carried by the following roll call vote, to -wit: ALL AYES 114. Resolution #588 to recommend an amendment to Ord. #650 was Resolution passed by the Planning commission Sept. 162 1954 and is being #588 held by the Administrative Assistant to be submitted to the City Council with Resolution of Intention #589. (Res. #590 was passed at meeting of Oct. 210 1954) On motion of Com. Rudd, seconded by Com. Copelin, and carried, Res. #591 Resolution #591 was made to reinstate three foot front setbacks on Lots as shown on District Map #1 under previous Zoning Ord. #525. First hearing was set for meeting of December 16, 1954. A letter was received from the City Council requesting the So. Coast Planning Commission to notify the South Coast Co. that their U. P. #84 Use Permit would not be renewed. On motion of Com. Copelin, will not be seconded by Com. Rayton, and carried, a letter was directed to, renewed the South Coast Company notifying them that their Use Permit #84 would terminate April 21, 1955. Request of Dean A. Kephart, General Contractor, regarding proposed Dean Kephart fire zone change on Lots 1, 22 32 41 Block 5, Balboa Tract, between request for Adams and Palm Ave. on Bay Ave. Also a letter received from said Dean Kephart to the Planning Commission asking that Lots 1, 2, 39 49 Fire Zone change Block 5, Balboa Tract be removed from the #1 Fire Zone, to permit on Lots 1,2,3 a more reasonable cost of construction. and 41 On motion of Cori. Copelin, seconded by Com. Rayton, and carried, Block 5, a letter was directed to the City Council suggesting that a joint Balboa Tract study of the Fire Code by the several municipal departments . actually involved in the administration of the provisions of the Fire Code would be appropriate, the Planning Commission to be present, if desired. r; 1st hearing on Resolution of Intention #589 .under the requirements of Section 9106.52 of Zoning Ord. #635 to amend said Ord. #635 Resolution as follows: Change the Use Permit application.fee required by #589 Section 9106.21 from five dollars ($5.00) to fifteen dollars . ($15.00); to change the Variance application fee required by to change Section 9106.31 from ten dollars ($10.00) to twenty -five fees on dollars ($25.00); and to change the amendment application fee applications of required by Section 9106.51 from twenty -five dollars ($25.00) Use Permits, to fifty dollars ($50.00). A survey has been made of surrounding Variances, and and adjacent cities and a condensed recap has been made.' Amendments FINDINGS: After study by the commission, it was determined that certain changes should be made in the fees as originally prescribed set for 2nd herein. It was suggested that the fees be set as follows: hearing Use Permit - $10.00 Variances - $15.00 Amendments - $50.00 On motion of Com. Copelin, seconded by Com. Bayton, and carried unanimously, Resolution #589 was set over for second hearing. (Res. #590 was passed at meeting of Oct. 210 1954) On motion of Com. Rudd, seconded by Com. This list will be sent to each Commissioner for their study and requested that each commissioner prepare his own list of offices to be discusses at the meeting of December 16, 1954• A letter was received regarding a. publication known as "Zoning Bulletin" for use of Planning Commissioners, wherein legal "Zoning Bulletin" decisions and interpretations made in various sections of the country on zoning laws are compiled and presented. On motion of Com. Copelin seconded by Com. Lind, and carried, the letter was ordered filed. The meeting was adjourned on motion of Com. F.ayton, seconded by Com. Rudd, and carried.
