ROLL CALL Commissioners present: Lind, Longmoor, Reed, Rudd, Smith, Keene, Hayton, Briggs, Copelin Commissioners absent: none MINUTES An addition was made to the minutes of October 15, 1953, stating that the Use Permits granted by L. M. Holbrook on R -1 dwellings in the Unclassified District in the Cliff Haven area, be con- firmed at,the next regular meeting of the Planning Commission. Minutes then approved on motion of Com. Reed, seconded by Com. Rudd, and carried. PJENJb3PTS First hearing on the Planning 'omission Resolution of Intention R3 #581 to rezone the Cliff Haven area and establish front yard setbacks. JL 4 First hearing on the application of Earl W. Stanley to rezone lots 147 & 148, Tract 1218, from a "U" District to a C-1 district, Cliff Haven area, held in conjunction with Amendment #3. Chairman Longmoor opened the hearing and welcomed Cliff Haven into the City of Newport Beach. The Council Chamber was filled to RSS. OF. I':'T. capacity. Felling called for a standing vote against zoning any of Cliff Haven as Commercial, everyone rose except out- of- towners. Com. Reed moved that the hearing be closed, and second hearing set for December 17, 1953; seconded by Com. Hayton, and carried. r- =� 1 33 First hearing on the application of Hancock Banning, Jr. at al to rezone a portion of Lot D, Banning Tract, lying southerly of A:.%1XTNT #5 ' the State Highway 101, and described as follows: (insert legal) (Request for C-1 -H zoning) Hancock Banning Jr. The hearing was opened. No communications received. Edward T. 1st hearing Healy asked if the application would permit a _prailer park. Com. Longmoor said that a Use Permit would be need or a trailer park. Harold D. Arthur, a resident of that area, said he knew of no objections provided type of businesses allowed in this area would be on a high plane, and no trailers. Chairman Longmoor read section 9103.52 of the Zoning Ordinance and explained the Use Permit. Com. Copelin moved that the hearing be closed and set over for a 2nd hearing on December 17, 1953, motion seconded by Con. Reed, and carried. Application of R. S. Daggett to allow garage to be set 3' 6" VARIANCES: from rear line on Lot 42, Tract 948 further described as 2140 Balboa Blvd., Balboa. Hearing was opened. Three letters were '114 received stating no objections. Mr. R. S. Doris was present and had no objections. R. S. Daggett Cam. Smith moved that the hearing be closed, seconded by Com. Lot 42, Tract 948 Rudd, and carried. Com. Lind moved that the application be granted, seconded by GRANTED Com. Reed, and carried by the following roll call vote, to -wits AIL AYES Application of Ted Laveson to extend 2nd floor apartment over garage, not to exceed two feet six inches (21 6") beyond exist- #115 ing wall. Proposed apartment will extend over and connect to the Ted Laveson front existing house as existing 61 between buildings is not Lot 25, Block 14 sufficient for a detached apartment. Property located at 317 . Section 3 Sapphire, Balboa Island, further described as Lot 25, Block 14, Balboa Island Section 3, Balboa Island. 'here were no communications. Com. Rudd reported that it is common to grant variances on Balboa GRANTED Island in blocks where existing structures overhand rear yard setback. Com. Copelin moved that the hearing be closed, seconded by Com. Lind, and carried. It was moved by Com. Rudd, seconded by Com. Reed, and carried, that the variance be granted, and carried by the following roll call vote, to -wit: ALL AYES Application of Charles 0. Good to decrease rear yard setback from !116 101 to 3' on Lot 165, Tract 1237, further described as 624 Seaward Charles 0. Good Road, Corona del Mar. (Application should have read 151 in place of Lot 165,Tr.1237 10t as district is R -1 -B). 'he Commission found that the applicant has not proven to the satisfaction of the Commission that the appli- DEIFIED cation of the zoning ordinance imposes a hardship. When the subdivi- sion of this tract was approved, all the lots contained a minimum of 6000 square feet which should be sufficient area to adequately comply with all the setback requirements of the zoning ordinance. This tract is enjoying a good development and there has been very few applications for variances and the Commission cannot see any legitimate reasons to start gtanting unnecessary variances at this time. 3 4 (Applicant, Mr. Good, states loan company requires 25' between house & garage which does not allow sufficient rear yard accord1mg to Building Code) Com. Reed moved that the hearing be closed, 2nd by Com. Copelin and carried. It was moved by Com. Reed, seconded by Com. Fisher to allow two family units each on Lots 22 & 23, Tract 1221, further described as 2002 and 1992 "103 Cliff Drive, Cliff Haven. This property is zoned R-2 by the W. E. Fisher County; several other properties on street are built up with Lots 22 & 23 duplexes. Tract 1221 Com. Copelin moved that the application be granted, seconded GRAN= by Com. Reed, and carried by the following roll call vote, to -wits ALL AYES ;Y104 Application of Gillman & Sons to allow a plumbing contracting and Gillman ?- Sons repair business on Lot 2, Block 438, Tract 1045, further described Lot 2, 3lock 438 as 716 Coast Blvd., Corona del Mar. Property is located in C-1 Tract 1045 ON zone. Committee reported that property is attractive, but that GRATED business is supposed to be housed, which it is not at the present (Conditional) time. Com. Reed moved that the hearing be closed, seconded by Com. Rudd and carried. Com. Copelin moved that the application be granted for a six month period, and at the end of that time a committee would check to see if Mr. Gillman had made an attempt to start housing his business. Peterson for a Use Permit to allow con- U. P. #106 struction of two dwelling units with garages on Lot 10, Block A, Basil H. Peterson in Tract 1219 which is further located in the Cliff Haven Lot 10, Blk. A area at 1301 Miff Drive, and which lot is in an Unclassified Tr. 1219, Cliff District. The Commission accepts Variance #1157 as granted by Haven the Orange County Board of Supervisors, April 14, 1953, which GRANTED allows a five foot (51) rear yard setback. Com m Reed moved d that the application be granted, seconded by . , carried by the following roll call vote, to -wit: ALL AYES Application of Kelso & Sloan for a Use Permit to construct two U.P. , #107 seven unit structures on Lots 10839 1084, 1085, & 1086 in Tract Kelso & Sloan 907, further located at the northeast corner of Via Antibes and Lots, 1083,10849 Lido Soud, Lido Isle, and which lots are in an R-3 district. 1085t & 1086 Chairman Longmoor asked if anyone was presemt regarding this Tract 907 application, and Mr. Walter Baker, adjacent property owner, brought up the problem of parking. Mr. Kelso stated that the parking is GRANTED adequately taken cars of. Mr. Bunster Creely, Manager of the Lido Isle Community Association, was present and said that this Board had approved the plans in general. Com. Copelin moved that the application be granted, seconded by Com. Reed, and carried by the following roll call vote, to -wit: ALL AYES ' Second hearing on Planning Commission Resolution Of Intention to Resolution of amend Section 9105.4 of Ordinance #635 to add paragraph (g) which Intention #580 covers setbacks of "R" districts to be used in "C" and "M" districts when "R" district structures are constructed in said "C" or "M" districts. Com. Copelin moved that the hearing be closed, seconded ADOPTED by Com. Hayton, and carried. - It was moved by Com. Copelin that the Resolution be adopted, seconded by Com. Lind, and carried ty the following roll call vote, to -wit: ALL AYES Request for Planning Commission's review and recommendation of Orange Orange County Comm. County Planning Commission Use Variance Permit Application #UV -1030, Plann. for to allow the establishment of an outdoor advertising sign in the A -19 request General Agricultural District. The sign is for the development of sign. - Isle Linda Isle. Location of the sign is on the west side of Bayside Linda Drive about 575 ft. southerly of the Coast Hwy. in the Northeast Newport Beach area. (No action was taken as the sign was already put up before the meeting) Also a request for Planning Commission's review and written recommen- Orange County Comm. dation by the Orange County Plann. Comm. on the tentative map of Plann. 1880 Tract 18809 as submitted by Leonard H. Gowdy for the Algard Corp., Tr. subdivider. Com. Webb, answered the letter with his recommendations. 36 Additional Request: Mr. Maitland Bishop, representing Wilma Walter also present, wanted Lot 10, Block 328, Corona del Mar, zoned Art as she iirs. Wilma salter understood it was when she purchased the lot, and since has Lot 10, Blk. 328 been rezoned as R -1. It was suggested that Mrs. Walter Corona del Mar. petition the property owners surrounding her property re- garding an amendment to the zoning ordinance on the adjacent block of property with her own. Meeting time set A motion was made by Com. Reed, seconded by 'om. Rudd, and at 7:30 during carried, that the Planning 'ommission meetings be held at winter months. 7:30 PM instead of 8 :00 PM during the winter months. An invitation was received from the Santa Ana Planning Dinner at Knottts Commission inviting the Planning `'ommission members to a Berry Farm. Santa dinner at Knott's Berry Farm on December 10, 1953. Com. Ana Plann. Comm. Longmoor and Com. Copelin were the only members who would be able to attend. Adjournment As there was no further business to come before the Commission, the meeting was adjourned. oelin p y jm Use Permits #108 - #117 incl. IIse Permits #108 Am #117 inclusive were issued by the Administrative Assistant, L. M. Holbrook, for construction of single family dwellings in NUN mone, upon authorization from the Planning Commission. Said Use Permits were approved upon motion of Com. Briggs, seconded by Cam. Hayton, and carried. Said permits were made necessary due to the Cliff Haven annexation, wherein said property automatically fell into a NUN District. lin Sec tary jm 1 r;
