in regular session Wednesday, November 20, 1940,
•7:30 p.m, in the Council Chambers, City Hall;
Chairman Johnson presiding.
Meeting called to order by the Chairman.
ROLL CALL
Commissioners present: Johnson, Seeger, Allen,
Williams, Estus, Findlay, Nelson, Patterson.
Commissioners. absent: Hopkins.
MINUTES
Minutes of meetings held October 16 and 30, 1940'
were considered.
Com. Allen moved that the minutes of the regular
meeting held October 16th be approved as written.
Seconded bd Coma Estus. Motion carried.
Com. Patterson moved that the minutes of the
adjourned meeting held October 30th be approved
as written. Seconded by Com. Allen.

SECOND HEARING - ON PROPOSED NEW ZONING ORDINANCE -
'Chairman announced. that this meeting is for the
purpose of holding the second public hearing on a
proposed new zoning ordinance to replace the present
zoning Ordinance No. 440; he said the Planning Com-
mission feels that this new ordinance is better in
every respect than the old one and that it is to the
best advantage to the city to have it put into effect
He asked the Secretary to read. any communications
received in connection with this hearing.
The Secretary announced that he had sent 421
letters to persons whose property is affected by the
changes in zoning; also that letters of inquiry re-
ceived as a result of this letter were answered,
giving the manner in which their property will be
affected.
Secretary read letters of protest from the
following:
1 - James A. Rabnett, Corona del Mar, protested
re-zoning of his property (! :Ely 25 ft, Lot 25, Blk
137 & Tly 15ft, Lot 25, Blk 137) to R -1. He has
a garage apartment at this time and intends to build
a house on the 'front of the lot in the future.
Com. Seeger remarked that the sentiment of the
•commission had been that special permits could be
issued for building on the front of the lot in cases
of this kind.
2 - Julia Aschmann, George H. Aschmann, Mabelle
Bowman ,- Lot 8, Blk 136, Lot 1, Blk 133, Lot 13, Blk
132, Lots 18 & 20, Blk 133, protested R-1 zoning of
their property.
3 - Katherine I. Fellows, Lots 17 and 19, Blk
133, protested the change from R-2 to R -1 zoning.
4 - Wm. R. Gilmour, Lot 3, Blk 25, Newport
Beach Tr. protested any change in the present zoning
of Blk 25.
5 - Z. H. Jarman, Lot 1, Blk 3, Newport Bay Tr.
protested the new zoning ordinance.
6 - J. P. Gregg, Lot 5, Blk 24, Newport Beach
Tr. protested the regulation of the number of famili-
es he could entertain in his property.
7;- Eugene U. Briggs, owner of NEly 10' of Lot
25 and all of Lot 25, Blk 138, Corona del Mar, pro-
tested reclassification of his property to R -i stat-
ing that there are several two family residences in
the immediate neighborhood and that this property
is now an apartment district being near the hotel.
8 - J. H. McCrink, owner of Lots 12, 13, 14,
'Blk 1, Newport Bay Tr. protested the reclassification
of his property from C -1 to R -3.
9 - Elizabeth Haid, owner of Lot 9 & SWly 15' of
•11, Blk 137, Corona del Mar protested rezoning of
her property to R -1.
10 - H. Cardoza Sloan protested the rezoning of
Blk 143, Canal Section.
11 - C. W. Bradford, owner of Lot 32, Blk 9, See'
1, Balboa. Island and Mrs. Hattie Claybrook, owner
of Lot 13, Blk 9, Sec 1, Balboa Island protested
the rezoning of Agate Avenue from C-1 to R -3 south
of Park Avenue.
12- A petition signed by George Crouse, R. E.
Steckel, A. M. Rothgery, George W. Colihan, W. E.
Mattson, Almora Patterson, Everett E. Chace, Edwin
C. Fairchild, Samuel Stiefel, Clara Stiefel, Anthony
K. Plummer, Nellie M. Neff, protested rezoning of
property located on Central Ave. between Alvarado St.
and Stiefel's alley from C -1 to R -3.
Chairman Johnson declared the hearing open
for discussion and invited comment from the floor
on the new ordinance.
Katherine I. Fellows, owner of property in

Corona del Mar which is being rezoned from R -2 to
R -1 protested this change stating that it wculd be
a very great hardship for persons like herself who
had planned to build an apartment over the garage
for income to be restricted to single family res-
idence.
Mr. H. Cardoza Sloan, owner of property in
Blk 143, Canal Section requested that the zoning
of this block be left as it now stands as this
property is close to the State Highway and Is more
suitable for the present permitted use than for
two - family residence.
Per. C. H. Reed, owner of the first 10 lots on
30th St. off Central Ave. requested that his property
be place in the proper zone so that his building
would be a conforming use instead of non- conforming
as it is at present.
Mr. Eckdale, representing the Italian Food
Products, stated that his company is quite satisfied,
with the new ordinance and has only one criticism to
make.. His company has confined their maekrel
business to the one small plant in Newport. They
do not desire to have the plant any larger, but in
the event of a fire, they would be out of business
tomorrow under the present contemplated restrictions.
They feel that rebuilding on a percent of the assess-
•ed valuation is unfair. They are prefectly agreeable
to being zoned but would like to be able to rebuild
to the full extent of the present plant in case of
loss by fire or other calamity. He thought the
commission should give considerable thought to the
matter before the "catastrophe" clause is put into
the ordinance.
Yr. Grainger Hyer stated that yacht clubs are
covered by the same paragraph as the canneries.
If a change is made for the canneries it must in-
clude all non - conforming uses at the same time.
Kr. Hyer also suggested that the setback on the
west side of Abalone south of Park Ave. on Balboa
Island be changed to 5 ft.
Mr. Longmore of the b7estern canneries concurred
In Mr. Eckdale's remarks about the cannery situation.
Dr. Brady, owner of considerable property in
Corona del roar, praised the Planning Commission
for the wor$ they are doing on the new ordinance in
•trying to look toward the future development, of the
city. He heartily favored the rezoning of Coast
Blvd. in Corona del tsar for business. He stated
that Dr. Flapzg wished him to express his approval'
of the change to business zone of this property.
Miss Marguerite McCulloch made the same request
for rezoning of her Lot 15, Blk 26, on the Peninsula'
•as at the first public hearing, that it be changed
from R -1 to R -2.
W. R. Gilmour protested the rezoning of Blk 25,
Newport Beach Tr. from R -3 to R -2.
Mr. Forster said that 955 of the property owners
in the section between Alvarado St. and Stiefel's
alley are opposed to the change in zone from C -1 to
R -3. In his opinion there is no reason for such
change.
The following persons asked for information as
to hovel the new ordinance will affect their property:
Mr. Holland, representing George & Julia Aschmann
and Mabelle Bowman, :Miss Studebaker, P3. E. Roe,
D. M. Spencer, Mr. Hollybush, Cluade Sweetman, Pete
Anitch, Miss Herryveather, Mr. Hemstreet and Mr.
Matson.
This information was supplied by the City
Engineer.
•It was the opinion of the commission that the
hearing should be continued and the cannery problem
discussed with interested parties before taking final
action on the proposed ordinance.
Com. Allen moved that the second hearing on the
proposed new zoning ordinance be continued to Nov-
ember 27th, 1940. Seconded by Com.'Estus.
Yotion carried and so ordered by the Chairman.

November 27, 1940, 7:30 p.m. in the Council Chambers,
City Hall. Seconded by Co:.q. 71illiams.
