THE NEWPORT BEACH CITY PLANNING COMTJISSION met in regular session Iuednesday, November 24, 1937, at 7:30 P.M. in the Newport Beach City Council Chambers. . Chairman Hopkins presiding. Meeting was called to order by the Chairman. ROLL CALL - Commissioners present: Hopkins; Seager, 'iiilliams, Schnitker, Briggs. Commissioners.absent: Findlay, Patterson, ',Jhi t s on . City Attny. Thompson, Building Insp. Nelson, Consultant Tilton and T'r. Sampson attended. MINUTES It was moved by Com„ "_. Briggs that the minutes of the last regular meeting 10/28/37 be approved as written. He did not believe it necessary to read them, as all members had received copies. Seconded by Schnitker. ". "otion carried. APPLICATION FOR VARIANCE Application of George H. T "cFarland, owner of Lot 4, Tract 742, for a 50% rear yard variance was read by the Secretary.. Ile stated that the notices had been sent and the application, together with the maps, plot and plans had been posted as re- quired. It was brought out that this was.the var- iance discussed at the previous meeting. Secretary said that the property had been visited by the Building Inspector and the variance met with his approval. Attny. Thompson suggested that the Commission hereafter number the resolutions recommending variances to the Council and give the number of the resolution in the motion for adoption. He suggested the following form to be used by members of the Connis.sion in moving the adoption of res- olutions: "Resolution No. , Moved by that Resolution No. beadopted and the same be transmitted to the ty Council by the Secretary and a copy be filed as a part of the minuteg of this meeting. Seconded bT Passed by the following Roll Call vote., • Briggs moved that resolution No.110 be adopted and the same transmitted to the City Council by the .Secretary and a.copy be filed as a part of the minutes of this meeting. Seconded by Schnitker. Passed by the following Roll Call vote: Yes: Hopkins, Seager, '.71lliams, Schnitker, Briggs. No: None. 9 0 APPLICATION FOR VARIANCE. Application of Earl PS. Elson, owner of Lot 18, Tract 742, for a 50% front and 50o side yard variance was read by the Secretary. Chairman Hopkins inquired if the procedure required by the Ordinance had been fully complied with. Secretary replied that it had; the maps, plot and plans had been posted and the notices had been given as required; also that the property had been Visited by the Building Inspector and himself. . The plans and plot plan were examined b -r the members of the Commission. Building Insp. Nelson stated that he believed the Commission would be justified in granting the front yard variance but that he did not believe the side ,yard variance was necessary, as the plans show that a 3 ft wall enclosing an open patio is to be constructed on the side and he sees no need for a side yard variance. Dr. Seager also stated that he did not believe a side yard variance nec- essary. The Chairman inquired of the floor if there was any one present objecting to the granting of these variances. No one objected. The Chairman inquired if the Commission was sat- isfied that the full enjoyment of this lot made the granting of these variances necessary; also if the granting of these variances would be detri -. mental to the neighborhood. Briggs answered that he believed the variances to be necessary and not. detrimental to the neighborhood. Moved by Conn. Briggs that Resolution No.11l be adopted and the same be transmitted to the City Council by the Secretary and a copy be filed as a part of the minutes of this meeting. As it was the opinion of the Commission that a side yard variance is not necessary, Briggs included in the motion that this variance be denied. Seconded by l'uilliams. Passed by the following Roll Call vote: Yes: Hopkins, Seager, Briggs, Schnitker, ',,'illiams. No: None. So ordered by the Chairman. UNFINISHED BUSINESS Chairman Hopkins announced the appointment of the two Committees as ordered at the last regular • meeting. Balboa Island Set -Back Committee Briggs, Uhairman and Dr. Seager. Variance Committee Dr. Seager, UhairTnan, ?firs. '6-illiams, Schnitker, Briggs, _Patterson and Building Insp. Nelson as consultant. The Chairman stated that he had made the Var- iance Committee large in order to cover the differ- ent locations in the city, appointing one of the members living in each section, in order to facil- itate the work of visiting properties. • NEVd BUSINESS COMMITTEE REPORTS �S��e��cial Planning Cor nittee As ohairman-of this committee, Dr. Seager report- ed having consulted with the City Engineer who advised him that he has a map showing the 3 mile zone, also placing streets, buildings and trees which he will modify for the use of the committee. The committee is planning to make recommendations to the County Planning cC ommission suggesting the location of parks, school houses and playgrounds. l ":hen the map is complete it should be filed and made part of the `,aster Plan. Dr.Seager said this is only a progress report. Yr. Schnitker suggested that a resolution be drawn to send to the City Council recommending that they issue no more building permits on Tilarine Ave. Balboa Island until the plans are approved by the Architectural Con- .iittee. This is the opportune time to influence the architecture on this street while • much of the property is vacant; the idea being to develop a business street which is characteristic of the Island, attractive and unique. Mr. Tilton's opinion was that nothing more could be done by the Commission as this comes under the Traffic Plan of the city which phase of planning has not yet been taken up by this commission. According to Section 17 of Ordinance 440, an offic- ial Highway plan of the city must be drawn up show- ing the major traffic thoroughfares before the Commission can influence the type of buildings in C -1 and C -2 districts: Chairman inquired what the Official Highwn.y Plan of the City means. kTr. Tilton explained that it is ansoffieial ::,.: map showing the major traffic thoroughfares; it goes into the P,Taster Plan. Chairman inquired what makes it official. Mr. Tilton replied that it is officail when adopted by the City Council and it establishes certain streets as major thoroughfares. The Official Plan is adopted after holding public • hearings and is adopted by ordinance or resolution, usually by ordinance. Attny. Thompson said that the same procedure should be followed as at the time of the adoption of Ordinance 440; holding public hearings, etc; that it could be an inititive action by the planning Commission, but tha} the Commission should have the advise of its technical advisor, one who will help them do it as near right as possible. After the plan is formulated the Commission can ask the Council to take action to designate the major • traffic thoroughfares. I,Ir. Tilton said there are three steps to be taken in influencing the architecture of the busi- ness districts, namely: 1. Establish major traffic thoroughfares. 2. Appoint an adivsory committee. 3. Establish certain plans as a basis for the type of building desired in each C -1 and.0 -2 district. These plans should be on file, available..to the building inspector so that he may suggest to the prospective builder about the type of building appropriate to the district. This plan has been established with success by the Orange County Planning Commission. Usually the building inspect- or and the Architectiiral committee can persuade the builder that the accepted type of building would be better; and sometimes can even be constructed, at a cost of from 25 to 100 dollars less than the unattractive, unsightly building often originally planned. (corrugated iron, etc.) • Ir. Thompson pointed out that a report of the Traffic Plan is on file ;ihich could be reviewed as special business at some subsequent meeting. Ivr. Thompson's advise was that the Commission's expert should be consulted as to the cost of this proceeding and then go to the Council and ask for an appropriation to do the work. t =Ir. Tilton said he did not know that it would cost anything.. Suggested that the old report and maps be considered., making of a new map is some- thing to be avoided if possible. Chairman Hopkins suggested that a meeting be set for'December 22 or 29 so that fr. Tilton could attend, and with his assistance the Commiss- ion start formulating the Traffic Plan. Yr. Tilton said that the 29th is the regular meeting of the Orange County Planning Commission and. he could not attend on that'date but thought that December 22nd was satisfactory. Dr. Seager moved to set the date of the next regular meeting for December 15th, 1937 at which time the Commission take part of the evening to • study the Traffic report on file and that an adjourned meeting be held December 22 when Mr. Tilton can be present, the business of thls.ad journed meeting being to consider the Traffic Plan. ';,Tilliams brought to the attention of the Commission a sign board on the corner of Marguarite Ave. and Coast Highway which obstructs the view of motorists coming onto the boulevard. Chairman Hopkins suggested that Bldg. Insp. Nelson look into the matter and if he feels it is of imnortance that the sign be removed, to get in touch with the proper .member of the City Council. figs. Vlilliams also discussed the Cypress trees which grow along some of the streets in Corona del Yar and which drop a gum on the streets and cars parked beneath them. Chairman Hopkins suggested that this be .taken up with the park dep�tment. Chairman Hopkins expressed the appreciation of the Commission for I:ir. Tiltonts presence at the meeting. IIr. Tilton said that he was glad to be there. He has referred on many occasions to the splendid work which the Newport Beach City Planning Commis- sion is doing for the betterment of the community and the civic - minded men who make un this Commis- sion and he wished that he might have the opportu- nity of expressing his very favorable opinion of their work to alarge number of the citizens of the community rather than to the commission them- selves. Iie also complimented .'r'r. Granger Hyer and Mr. Day upon their civic interest. COMIaUNICATIONS The Secretary called the attention of the Chair- man to communications which had not been read. He was instructed to read them. Secretary read a letter from Yiss Helen Coffen, Secretary of the ?;'est Newport Improvement Associa- tion, addressed to ldr. Hopkins containing suggest- ions for community betterment. (On file) Chairman instructed that this letter be filed and that the Secretary make an appropriate reply to this communication. Secretary read a letter notifying the Commission of the Zoning Conference to be held in Chicago, December 13 and 14. Ir. Tilton said that he is attending and will represent the Newport Beach Planning Corinission unofficially and will report the meeting at a future meeting of this commmission.
