An adjourned meeting of the Newport Beach City Planning Commission was held
Thursday, November 29, 1945, as called by Chairman Allen, due to the regular
meeting set for November 15, 1945 being adjourned, due to the absence of a
' quorum, with.only Commissioners Allen, Baltz, Longmoor, and Nelson present
for the .regular meeting.
Commissioners present: Allen, Baltz, Ellerbroeks Nelson, and Patterson. ROLL CALL
Commissioners absent: Isbell, Johnson, and Seager(resigned but serbing
untill successor named)
Commissioner Belts made the motion, seconded by Commissioner Nelson, that MINUTES.
the minutes of the meeting of October 15, 1945s be approved as read.
Motion carried, and so ordered.
Secretary Ellerbroek read a letter from Guy Westcott, of Los Angeles, re- COMMUNICATIONS
questing the reactions of. the Commission regarding a rezoning of Lots 19
and 20, Block 27, Newport Beach Tract, for the purpose of locdting a "Help -
Yourself Laundry" thereon. Mr. Westcott was present for the discussion,
explaining his proposed plans. no action was taken, but the feeling of the
Commission was opposition to the proposal due largely to the absence of
parking facilities, in the area.
Second and final hearing upon the matter of.a change of front yard setback PUBLIC HEARINGS
from 51 to 101 for Lots 1 to 93, inclusvie, Block 15, First Addition to
Newport Heights, was declared'and held. Having originated by a petition
of all property owners of-the properties concerned, with a view to the
greater beautification of the area, no protests were heard or received
' from the floor, or the Commission, and Commissioner Patterson made the mot-
ion, seconded by Commissioner Ellerbroek, that the Commission recommend to
the City Council, the approval of the change of front yard setback to 10t
for said lots. Roll call vote. ROLL CALL DOTE
Ayes: Allen, Baltz, Ellerbroek, Pelson, and Patterson.
Noes: None. Motion carried, and, so ordered.
Second and final hearing upon the matter of a change of front yard setback
from lot to 51 for Lot 40, Block As Tract 675, Corona Del mar, for F.
Cloyd Snyder, was declared and heard. No protests were received or heard
fromthe floor, but discussion by the Commission revealed that the granting
of this application would make this lot nonconforming, all others on the
_street using the 101 setback, and further that the topography of the lot
does permit sufficient space and possibilities for build under present
regulations of 101 setback. Commissioner Patterson made the motion, second-
ed by Commissioner Nelson, that the Commission recommend to the City Council
the denial of Mr. Snyder's application. Roll call vote.
Ayes: Allen, Baltz, Ellerbroek, Nelson, Patterson. ROLL CALL COTE
Noes: None. motion carries, and so. ordered, and the motion then.mads by
Commissioner Baltz that the Secretary be instructed to advise gr. Snyder of
its reason for the.denial of this.application. motion seconded by Commiss-
ioner Patterson, and carried.
First hearing upon the matter of the application of X. S. Kilpatrick for a
212, setback for Lot 8, Block C-Z5s Corona Del Mar, was declared and held.
' Oommissioner Patterson made the motion, seconded by Commissioner Nelson that
the matter be passed to the second and final hearing. Motion carried. .
First hearing upon the matter of the application of F. N. Yale for a change
of setback line from 10, to 51 for Lot Is Block A. Tract 518, Balboa Tract,
was declared and held. Some discussion ensued, and Commissioner Patterson
made the motion, seconded by Commissioner Baltz, that the matter be passed
to the second and final hearing, anal that the Chairman appoint a committee
to look over the property. Motion passed, and Commissioners Patterson and

Ellerbroek were named as the committee.
REPORTS OF No reports were given, due to the absence of chairmen of committees.
COMMITTEES
OLD BUSINESS The matter of the proposed lease to T. F. Kilkenny Eor the City owned
property on Coast Highway was brought up again, having been tabled.
Commissioner Baltz requested a review of the original terms presented, and
Councilman Allen being present, stated that he did not feel the proposition
a very good one, but added that the City does need income and "something .
should be done.about the property, should get $25,,000 a year, and Kilkenny
only offered $15,000; Councilman Allen recommended that the Commission
suggest and recommend that the property be developed by private interests,
all the bay frontage be used for boat slips, and that the rest byr a plan
similar to that suggested by Kilkenny, further stating that the City Coun-
cil would approve such a proposal. Secretary Ellerbroek stated that the
proposition should be given further thought, and Chairman Allen agreed,
stating that he did not feel that the five Commissioners present should
make such an important recommendation. Representing Kilkenny interests
was Mr. Lovumu, who explained the plan, and expressed surprise that no act-
ion had been taken as his °thought the Council and the Commission were consi-
dering it, and agreed to bring more detailed plans to the next meeting,
whereupon= Commissioner Baltz made the motion, seconded by Commissioner
Ellerbroek to table the proposition to the meeting of December 20, 1945.
Motion carried, and so ordered.
NEW BUSINESS Secretary Ellerbroek seed a letter from City Attorney Thompson including a
proposed amendment to Ordinance No. 525, Section 2, at the regeust of the
Council, and for the consideration of the Commission. Said proposed amend -
emnt having to do with "one dwelling in R -1 zone, or more than two in an
R-2 zone." Miss McCann was present, and much discussion ensued again over
the Balboa Island property ofMr. West, i, e., Lot 18, Block 159 Section 1,
Balboa Island, which she contended was in violation of R-2 zoning, and that
the. Ordinance 525 as now worded leaves "loop holes ", but further agruing
that the proposed amendment was no help. Chairman Allen agreed, stating
that it did not properly interpret the Ordinance, and Commissioner Patter-
son said that present ordinance was more binding than the @ roposed amend-
ment. Commissioner Patterson made the motion, seconded by Commissioner
Baltz, that the matter be tabled for fbrther study, and that the Chairman
contact City Attorney Thompson for further improvement of the proposed
amendment. Motion carried.
Tentative map of Tract 1133, being a proposed subdivision, was presented
with a letter of explanation from the firm of Patterson and Boyle,.Sants
Ana, for the considration of the Commission. No zone, changes were request-
ed. The owner of the proposed subdivision as given as Kathryn Smith, and
the property described as being north of Highway 101 and easterly of San
Bernardino Avenue. After careful consideration, Commissioner Ellerbroek `
made the motion seconded by Commissioner Baltz, that the Commission recom-
mend the approval of this map to the City Council. Motion carried.
ADTOURNMENT Commissioner Ellarbroek made the motion, seconded by Commissioner Nelson
for adjournment to December 20, 1945. Motion carried, and so ordered.
