Rooting called to order by the Chairman.
ROLL CALL -
Commicaioners present: Ropkins, $sager, Williams, Findlay, Vitus, Patterson, Whitson,
Efodgekinson,
Commissioners absent: Briggs.
City Attorney Thompson and Building, Inspector f6selsou attended.
Chairman stated that, since this was an adjourned meeting called to consider certain
matters, the regular order of business would be dispensed with.
MURINGS -
APPLICATION FUR Y.ABIAVCB OF SIGNAL OIL COMPAVY
Secretary read the letter of application and explained that they are requesting a permit
to move and altar a non - conforming element, also an 80% rear yard setback varianas. This
matter was tabled at tyre last meeting.
Cow, Whitson moved that this matter be lifted from the table. Seconded by Can. lotus.
Motion carried and so ordered by the Chairman.
Com.ffodgskin ®on stated that the only objections had been to allowing the rear yard
variancok the remodeling had boon recognised to be an improvement.
Mr, Ahlport of the Signal Oil Co. and Mr. Blue, lessee of the property were present.
Mr. Ahlport stated that they had requested the rearyard variance to allow more parking
space around the station.
No further discussion.
Com. Yedgskinson m*vad the adoption of Resolution Bo. 145 recommending that a permit
be granted to the Signal Oil-Co. to move and alter a non - conforming element on Lot 18.

be transmitted to the City Council by the Secretary and a copy filed as part of the minutes
of this meeting. Seconded by Con. lotus.

Secretary stated that this matter bad bean tabled at the last meeting on mstiea that
the Commission secure advice from tbo City Attorney as to the proper procedure for a psmviffg,
anbdivsions. Secrstary.read the letter from Attay. Thompson in which he stated that. Is
his optsion; the Planning Commission does not haw jurisdiction over subdivisions bg rvasom
of the fait that no ordinance designating such jurisdiction has been adopted by this City
Council.

the city Council.
Secretary stated that the letter referring the map to the Planning Coesd,osion is a.

Attny, Thompson expressed the opinion that this map complies with all rsquiremetts sfe

Com.Pat:terson called attention to the fact that several lots in the subdivision are
outside the city bousdry.
Com.1hitson moved that the Newport Beach City Planning Co_ mission.approvs the teat*"
map of Beason Bay Subdivision. Seconded by Goo. Findlay.
Com.Seager's opinion was that the only, point to be considered at this time wan too
manner in which the map came beforethe commission..
A6tsy.Thompoon stated that the City Councii did formally rotor the map to the Plasnift
Commission at the meeting hold Rov.21.

Mr. Hanson said that be had made application under Sac 11PP.2 which gives the 08=162148

Mr. Thompson said this applies only when granting such variance does not conflict with
the State law.
It was suggested that Mr. hanson make one lot of his property or out down the &ISO Of

Com.Patterson moved the adoption of Resolution 146 recommending that the application
of Franklin Ransen,Jr. for a 33 1/3% side yard setback variance on either side Of Lot 23,
Blk 14, see 3- Balboa Island be denied as it is in conflict with State law. and that the
same be transmitted to the City Council by the Secretary and a copy filed as a part of the
minutes of %his meeting. Seconded by Com.williams.

Secretary read the letter of application and stated that the hearing bad been advertised
postcard notices sent to 17 surrounding property owners representing 25 lots in the vicinity
and that all other requirements of the ordinance had beat compiled with.
No written protests were received.
Chairman declared the bearing open for discussion.
Attorney Miss. representing Mrs. VacW10uoh was present and stated that if this property
19 not zoned to allow modernization of the building it will be used for the same parpo$*
as that for which it Is now being used. They have no Intention Of allowing sale Of lit"r or
beer. It is the desire of the owner to got a more reasonable income from her Investment.

CONTINCED HEARING (SECOND) ON APPLICATION 07 E.S.
GDSON FOR RZZONUIG OF PORTION 07 LOT
TRACT 919 FROM R-1 to C-1.
Secretary read the application and stated that this was the second and final bearing
on this matter.
Ivan though this property is included in the area of Tract 919 under discussion for
rezoning. the commission felt that action should be taken on this application at this meeting
so that Mr. Gibson would not be delayed longer it starting construction of his auto court.
Com,Whitsan moved the adoption of Resolution NO- 147 recomouding the rezoning from
R-1 to 0-1 of that portion of Lot F, Tract 919 we applied for by E. S. Gibson and that Abe
sane be transmitted to the City Council by the Secretary and a copy filed as a part.6f.tbo
minutes Of this Meeting. Seconded by Com. Hodgkinson.

MOBT ON TFXUTIVB MAP OF TRACT 1011.
Secretary reported his attendance at a sooting of the Orange County Planning Cesmissiou
to express this commission's disapproval of the tentative map of Tract 1011, sabdivioiaa .
of property owned by Mr. Strobridge. He stated that the Orange County Planning Ceaalesiom
postponed action on the map. They discussed the posibility of placing the subdivider under'
bond to properly dredge the canals. They were to request the subdivider to contact the
City lagineer to learn what arrangement could be made to do the dredging.
Cam. Seager stated that the County Planning Commission had requested the Newport Beach
Planning Commission to file with them the map showing the 3 mile area lying adjacent to the
City boundry. He read a letter to the City Council which he had prepared recommending that
the map be adopted and filed with the Orange County Planning Commission. Cos. Seager'nroved
that the map, accompanied by this letter of recommendation be forwarded to the City Council..
Seconded by Com, lotus. Motion carried and so ordered by the Chairman.
Secretary Seeger moved that the Secretary be instructed to send a written report to
the Orange County Planning Commission outlining this commission's objections to the tentative
map of Tract 1011. Seconded by Com, Findlay.
The Commission outlined their objection as follows:
1. It is not shown that provision has been made_for disposal of sewage.
2. It is not shown that provision is made for adequate and acceptable water supply.
3, The commission is of the opinion that the proposed canals are of insufficient
depth to provide for proper water circulation,
4. The commission is not convinoed'of the financial ability of the subdivider to
complete the subdivision as might be finally approved,
5. Insufficient lot area in some instances,
Motion earried and so ordered by the Chairman.
OBDIHABTCm HlGmATING SUBDIVISIONS
Cos, Seeger brought up the matter mentioned earlier in the meeting of requesting the
City Council to enact an ordinance regulating subdivisions.
Attay. Thompson suggested that a committee might be appointed to formulate as ordisaase
which could be submitted to the City Council for adoption.
Chairman Hopkins said that this would give the commission a standard by which to forsi-
ulate decisions on subdivisions maps submitted for approval.
Com. Patterson moved that the Chairman appoint a committee of three to formulate a set
of regulations to present to the City Council to be incorporated into an ordinance regalating
subdivisions. Seconded by Com,Wtlliams. Motion carried and so ordered.
The Chairman appointed Com. lotus, Chairman, Com. Findlay and Patterson and Sec. Semen,
ex- officio to serve on this committee.
COMMUSICATIONS -
Secretary read a communication from Jessie Collins in which she complained of the fire
and smoke resulting from the tarring of barges and floats on the beach in front of the Island
Boat House an Balboa Island.
Com.Patterson moved that this communication be referred to the City Council. Seconded
by Com, lotus. Motion carried and so ordered.
Chairman instructed the Secretary to reply to lira. Collins' letter informing her that
this commission has no police power and no jurisdieition is such matters and that her oem.
munication had been referred to the City Council.

On motion of Com._Seager seconded by Com. Findlay and carried, the meeting adjourned.,
