Bay and the Rhine Channel on the east. Initiated by: The City of Newport Beach Bill Hurrill and Ron North appeared before the Commission on behalf of Wilbur Smith and Associa and reviewed the data contained in the draft par ing study for Central Newport Beach. They prese ed slides reflecting the findings of the survey taken within the past months and answered questi of the Commission relative to the parking study. Public hearing was opened in connection with thi matter. Pictures of the fence in question were projected on the screen for the Commission's review. Staf reviewed the request and the Modifications Commi tee's findings. Public hearing was opened in connection with thi matter. Marcia Hanifin appeared before the Commission in connection with this matter and reiterated her comments contained in the letter of appeal dated November 15, 1977. She answered questions of.th Commission and advised that no complaints had be received from the neighbors and that the fence provided the desired safety factor around the swimming pool. • There being no others desiring to appear and be heard, the public hearing was closed. Motion X Motion was made that the decision of the Modific tions Committee be overruled and that the appeal be granted to allow the higher fence to remain. Commissioner Frederickson opposed the motion as he felt there was adequate reason to allow a higher fence on the rear property line but.coulc find no reason for a higher fence along the side property line and felt that portion should confc to the City's regulations. He also felt that a precedent could be set if the higher fence were permitted to remain. Commissioner Agee commented on fence heights an( felt there was little difference between a 6 foc and 7 foot fence constructed for the purpose of privacy. Commissioner Balalis also commented on fence heights and the arbitrary height which has been established. He felt that since no complaints had been made by the neighbors and apparently ti higher fence was desired, it should be allowed • remain in order to maintain privacy and safety around the swimming pool. Ayes X X X X Following discussion, the motion was voted on an Noes X X carried. Request to permit the construction of a.single family dwelling on a lot in a Specific Plan Area where a specific plan has not been adopted. A modification to the Zoning Code is also requeste, since a portion of a required exit deck from the lower level of the structure has a maximum height of 16 feet ± (measured from the existing sloping grade to the top of the required railing, and encroaches 2 feet 6 inches ± into a required 4 foot side yard. Location: Lot 54, Tract No. 673, located at 336 Hazel Drive, on the southeast- erly side of Hazel Drive, southerly of East Coast Highway, in Corona del Mar. Zone: R -1 Applicant: Dan R. Woseman, Costa Mesa Owner: Same as Applicant Staff projected and reviewed pictures of the property in question. Public hearing was opened in connection with this matter. George Wiseman, architect, appeared before the Commission in connection with this matter. He presented additional elevations indicating the relationship of the proposed residence to the adjacent property and concurred with the staff report and recommendations. Betty Cooper, owner of the property to the south- west, appeared before the Commission and voiced concern with the encroachment into the side yard Page 4. Dan Wiseman, property owner, appeared before the Commission to comment on the encroachment. There being no others desiring to appear and be heard, the public hearing was closed. Planning Commission discussed the encroachment into the side yard and alternative designs which could be considered in order to satisfy the concerns expressed by the adjacent property.owne as well as the City staff. It was felt that the fire wall, which was necess, by the Building Code, would be objectionable if 4ktion X allowed to encroach into the side yard, therefor, motion was made that Planning Commission make th All Ayes following findings: 1. The project will not have any significant environmental impact. 5. Adequate parking spaces and related vehicula circulation will be provided in conjunction with the proposed development. • 6. That a corner cutoff with a radius of 10 fee at the intersection of East Coast Highway with Fernleaf Avenue be dedicated to the public. Commissioner Hummel felt that although the propo was attractive, it was out of character with Corona del Mar because of the maximum use of the small lot at this location and the traffic con- gestion in the area. He advised of his oppositi to this request and any other proposal which re- quests maximum use of property along Coast Highw until such time as a Specific Area Plan has been approved. Request to amend a previously approved use permi that permitted the establishment of a restaurant facility with on -sale alcoholic beverages so as to permit the construction of additional dining area on the property. The proposal includes the paying of an annual fee to the City for the required parking spaces in a nearby Municipal parking lot in lieu of providing parking on -site Live entertainment is also proposed in the expan restaurant facility (i.e. Studio Cafe). The exi ing structure encroaches to within 3 feet ± of t rear property line (where the Ordinance requires 5 foot rear yard when abutting residential pro- perty). All new construction conforms with the required 5 foot rear yard setback. Andrews, Newport Beach Motion x Planning Commission continued this matter to the All Ayes meeting of December 15, 1977, at the request of the applicant. ADDITIONAL BUSINESS: Planning Commission held a brief discussion on low and moderate income housing; HUD block grant funds; and SCAG policies with respect to low income housing. Chairman Heather urged the Planning Commission t attend the upcoming Southern California Planning Congress to be held at the Marriott Hotel on December 8th at which Newport Beach was the host Community Development Director Hogan presented the Planning Commission with a schedule from the Public Works Department regarding the decision dates needed by the traffic engineer with respec to the Land Use and Circulation Element alterna- tives. Planning Commission discussed holding a special study session with respect to this matte Planning Commission expressed their displeasure with respect to the lack of preparation on the part of the traffic consultants who made the presentation on the results of the traffic study for Central Newport Beach {Item #1 on the agenda and the waste of time which was taken at a publi hearing. Staff advised that the matter would be brought to the attention of Wilbur Smith and Associates. Page 10.
