City Attorney O'Neil concurred with the applicant's opinion. Mr. Thomas A. Ramsey, attorney, represented the applicant and stated that they felt a restaurant. use at this location had not been abandoned inas- much as the property had been vacant since the last restaurant operation except for a.short perio in 1970 when it was used as a teen age church meet- ing place. He stated further that due to the fact that the restaurant would not be open until 5:00 P.M., they would not be competing with the day tim use of the Municipal Parking Lot. Mr. Burr White, the realtor who has managed this property for many years, addressed the Commission in favor of the,application. Kathy Carr, the applicant stated that she had tried, but was unable to find other parking in • the area and, further, that she would be willing to open the restaurant on the first floor of the building only. MINUTES INDEX Item #2e Request to permit an 111 unit 2 story Senior USE Citizen's Residential Hotel in an Unclassified P—PFE MIT District. -07-T567 Location: Parcel 2, Resubdivision 234, located .CONDITION - at 333 Placentia Avenue on the west - I -ILTT-- erly side of Placentia Avenue between APPROVED Hospital -toad and Superior Avenue. Zone: Unclassified Applicant: Herbert Manasse, Hollywood Owner: Morgan A. and Howard C. Stivers. Long Beach Zoning Administrator Laycock presented the applica tion to the Commission and explained that a revise plan had been requested, and received, in order to bring the development within the yard setbacks of an R -4 development and to revise the access drives to the off- street parking areas. He indicated that the revised plans met the staff's approval. He noted further that the new plan indicated a reduction in the number of units from 111 to 108.. Mr: Herbert M.anasse was.present and explained the proposed facility to the Commission. Mr. Ken Ryder, Administrator of Park Lido Convales- cent Hospital, and`Mr. John Shea, a member of Healthco who also operated the Newport Villa and Park Lido Convalescent Hospitals spoke in opposi- tion as they felt there was not a need for additional facilities of this type in the area. There was a discussion as to whether or not this facility should;be referred to as a "hotel" or "convalescent hospital" and Community Development Director Hogan pointed out.that there were specific laws regulating convalescent hospitals and the facilities' being provided under this application did not fall into that category. Following a further discussion as to whether this facility should be referred to as a "boarding hous ", Page 3. That the development shall be according to the approved-plot plan, except for minor modifications approved by the Community.Development Department. 2. That a landscape plan be submitted to and approved by the Community Development De artment. The plan shall include one tree for every ten (10) lineal feet along-the side and rear yards,.not less than ten (10) feet high at time of plant - ing. Said landscaped areas shall be equipped with automatic irrigation systems, and be. permanently maintained. 3. That a 6 foot high masonry wall shall be constructed on the rear and side property lines except for that area-within 20 feet of the front property line, where the .wall shall be reduced to 3 feet. 4. That the types -and locations.of street. trees shall be installed and maintained incompliance with a plan approved by the Director of Parks, Beaches and Recreation, and that the standard inspection fee of $3.00 per tree be paid. 5. That all construction affecting the exist -. ing storm.drain and easement shall be re- viewed and approved by the Public Works Department. Structures shall be designed so that no additional loads will be-imposed on the storm drain. The architect shall be responsible for coordinating design so . that these requirements will be met. Owner: Anthony Industries, South Gate Zoning Administrator Laycock reviewed the applica- tion and displayed pictures of the proposed buildi g. to the Commission. Mr: Ed White represented the applicant and stated that the reason for the request was that the owner would not permit the construction of a permanent building or an addition to the existing building inasmuch as they were on a month to month lease. Chairman Adkinson noted that the following three items were related and asked that the staff present them concurrently, but that a separate motion on each item would be in order. Zoning Administrator Laycock explained that the Resubdivision, (Item 6 on the agenda) would be creating two lots where three lots now exist (two 25 feet in width and one 15.15' in width) and that even if the use permit (Item 7 on the.agenda) were not approved, the resubdivision would provide more flexibility and encourage higher standards of development than the present..configuration. . Item 7, Use Permit No. 1570 was necessary to permit residential uses on the commercial property; also the applicant desired to begin construction prior to the effective date.of the R -4 zoning requested under Item 8. Stine, Newport Beach Owner: Same as applicant The Commission discussed this application at length, especially in regard to the zero side yard setback being necessary to provide the re- quired parking. It was felt that if a setback reduction were granted, more than the required parking should be provided. Mr. Jerry Doyle addressed the Commission as to the effect the zero setback would have on.his adjacent property. Following a discussion, a motion for approval,. subject to the staff recommendations, was made by Commissioner Heather. This motion failed for lack of a second. A further discussion ensued, following which Com- missioner Agee stated that if Commissioner - Heather would make another motion for approval, he would x second it. On motion of Commissioner Heather, x seconded by Commissioner Agee, and carried, Use x x x x Permit No. 1570 was approved, subject to the x x following conditions: x 1. That all conditions of Resubdivision. No. 326 shall be satisfied. 2. Request to amend a portion of Districting Map No. AMENDMEN IV 977178 9 from a C -1 classification to an.R -4 classifica- tion and to establish ,a 4'0" front yard setback. Zoning Administrator Laycock presented the applica- tion to the Commission and.reviewed the revisions in the text recommended by the staff regarding schools, recreation, side yards, trellises, and parking. Assistant Community Development Director Hewicker also addressed.the Commission regarding this proposed amendment. The Commission discussed this application at length, especially in regard.to schools, guest parking, signs and rewording of certain sections of the text. Mr. Larry Moore, Associate Planning Administrator of the Irvine Company, was present.and answered questions of the Commission and Mr. James E. Taylor, Director of General Planning Administration, also addressed the Commission and stated that when they had a developer for the property, the Homeowner's Associations would have an opportunity to discuss the proposed project with them. Mr. Frank Cummings, Secretary of the Broadmoor Hills Community Association asked questions regard- Page 9. Mr. R. H. Schooner of 1327 Seacrest Drive, Corona del Mar, questioned the height limit of 35 feet with two stories above a garage. Following a further general discussion, the application was continued until December 16th in order to obtain additional information, especially in regard to school population projections, and the ability of the Newport -Mesa Unified School District to accommodate this growth. Request to amend a portion of Districting Map No. Item #10. AMENDMENT 3 from an R -2 classification to an A' -P classifica- NO. 307 tion. DENIED Location: Lots 18 and 19, Block 32, Newport Beach.Tract, located at the southwest corner of 32nd Street and West Balboa Boulevard. Zone: R -2 Applicant: Frank Marshall, Newport Beach Owner: Robert E. Washbon, Newport Beach Zoning Administrator Laycock presented this appli- cation to the Commission. Mr. Frank Marshall, the applicant,was present and answered questions of the Commission. Suzanne Rasmussen of 108 - 33rd Street addressed the Commission.in opposition to the applicant's request, stating that she was an attorney and was also representing Mr. and Mrs. Edward Wall of 123 - 33rd Street.. The Commission discussed this application and it was the consensus of opinion that "spot zoning" of this type would set a precedent for other office and commercial uses along. Balboa Boulevard and was x not conducive to good planning practices. Therefore, x denial was recommended: Page 10.
