cation had begun. City Attorney O'Neil concurred
with the applicant's opinion.

that the restaurant would not be open until 5:00

Chairman Adkinson noted that the following three
items were related and asked that the staff present
them concurrently, but that a separate motion on
each item would be in order.
Zoning Administrator Laycock explained that the
Resubdivision, (Item 6 on the agenda) would be
creating two lots where three lots now exist (two
25 feet in width and one 15.15' in width) and that
even if the use permit (Item 7 on the.agenda) were
not approved, the resubdivision would provide more
flexibility and encourage higher standards of
development than the present..configuration.
.
Item 7, Use Permit No. 1570 was necessary to permit
residential uses on the commercial property; also
the applicant desired to begin construction prior
to the effective date.of the R -4 zoning requested

The Commission discussed this application at
length, especially in regard to the zero side
yard setback being necessary to provide the re-
quired parking. It was felt that if a setback
reduction were granted, more than the required
parking should be provided.
Mr. Jerry Doyle addressed the Commission as to the
effect the zero setback would have on.his adjacent
property.
Following a discussion, a motion for approval,.
subject to the staff recommendations, was made by
Commissioner Heather. This motion failed for lack
of a second.
A further discussion ensued, following which Com-
