The Public Hearing was opened regarding this item
and Carl Ackerman, Owner, appeared before the
.
Planning Commission and explained that during
the time of the last public hearing, the con-
straints were in the process of presenting this
to the Local Coastal Program for their review,,
after which time they had met with the architect.
He then introduced Jim Wilson to address the con-
cerns that had been raised at the last meeting
regarding the size, density and use of the.bui'ld-
ing.
J?m Wilson, 30th Street Architects, appeared be-
fore the Planning Commission and posted addition-
all exhibits for the Planning Commission's revilew.
He relayed the Planning Commission's concerns
subsequent to the last public hearing regarding
this item relating to the duplexes.which front on
the property line at the back of the building and
t':heir concern regarding the vertical elevations
compared to the other buildings on 20th Street..
He stated that the scale is approximately the
same as the other buildings on the street, the
building is set back considerably from the other
duplexes and residential style materials are used
in an effort to duplicate the residential quality

oln 20th Street.

Commissioner Beek posed a question of Staff, to
which James Hewicker, Director, stated that they
would require that they provide the City witha
contract with a maintenance company which.woulld
ipdicate that they have contracted for maintern-
ance of the grease traps and for vacuum sweepiing
and that the City would make every effort to be
sure those conditions are met.
Commissioner Beek stated his preference that ther
not be a condition of this nature and instead
there be an ordinance that requires weekly vacuum
sweeping of parking lots and maintenance of
grease traps, upon which violation would impose
a fine.
Commissioner Balalis suggested including in the
Study Session Agenda a discussion to consider an
alternate method of receiving the same results
and retroactively remove the conditions.
• Commissioner Beek posed a question regarding
Ekhibit "B ", Findings for Denial, to which Mr.
Hewic.ker replied that Finding No. 2 is an ultimat
finding which the Planning Commission should make
if it is their desire to deny the Use Permit and
that if the Planning Commission were to make a
fnndi.ng that there is an excessive amount of of-
fice space in.the area to support the additional
square footage, then this would represent an ul-
timate conclusion, and the Planning Commission
would necessarily have to have the finding of
fact to support that.
Hugh Coffin, City Attorney, advised that if that
were a condition that the Planning Commission
found that there was an excess of office space,
or whatever other conditions may exist, those.'
should also be included as part of the findings
if denial is appropriate, plus the ultimate
Flinding (No. 2).
Mr. Hewicker further explained that in order to
ajpprove a Use Permit, there must be an ultimate
finding made that the approval will not be detri-

mental, and by the opposite token, in order to
make.a finding for denial, there should be made
afindi.ng that it would be detrimental.
Motion x Motion was made that the Planning Commission make
the findings included in Exhibit "A" of the Staff
Report and approve Use Permit No. 1920, subject
to the conditions included in Exhibit "A" of the
Staff Report.
Commissioner Allen expressed her concern regard-
ing the fact that the property is not currently
being used for a marine - related use an.d inquired
whether the applicant would be comfortable with
marine- related usage for his office building, ;and
stated her preference that the tenants of the
building be involved in businesses that are re-
lated to marine industry.
Mr. Hewicker stated that they have approved Use
Permits in which cases the occupancy of the stiruc
• tares have been conditioned to such uses as yaicht
brokers, marine architects, naval; architects, ma-
rine surveyors and lending institutions which mak
loans for boats.
Mr. Ackerman addressed himself to this point,
stating that currently the building with the 2'400
sq. ft., if leased by a real estate company, will
be the primary occupant in the new building,.and
in addition to that, they have an option to lease
the remaining total square footage,.that in de-
signing the building related to uses, it was di-
rected toward community supported relations.and
services, and that if the present tenant does not
occupy the remaining facilities, there has been
an inquiry from.an individual who has an ex-
cllusively marine insurance brokerage and is a pos
sible tenant. In conclusion, he expressed his
feeling that the need of the people rendering
these services will seek out the site and loca-
tion most conducive to the successful conduction
of their business, and that this environment
creates certain needs, which needs will be served
either by these facilities or others.

Commissioner Allen expressed her concern that the
area has a number of needs and so little land and
that unless provisions are made for the special
needs, the area can support anything that can pos
sibly be there,. She further stated that she
would like to see the marine quality of the area
preserved.
Commissioner Balalis stated his understanding tha
the applicant would prefer not to have a limita-
tion to marine- oriented facilities, but that he
would certainly welcome that use if an applicant
for some of said space became available.
Mr. Hewicker stated that in the Specific Area
Plan for Mariner's Mile, there is included a sec-
tion pertaining to uses on Mariner's Mile and
such uses as yacht clubs, yacht brokers, social
clubs, commercial- recreation, boat sales, marine
supply, boat.repair and servicing, sport fishing
• establishments, hotels, motels, businesses and
professional offices where marine- related service
are offered to the general public, and other uses
which in.the opinion of the Planning Commission
are of a similar nature, the language.of which
could be adapted in this particular instance to
include yacht brokers, boat sales, marine supply
sales and boat repair and servicing and other
kinds of businesses or professional offices where
marine- related services are offered to the gen-
eral public.

The Public Hearing was opened regarding this item
and Norman Walker, Applicant and Owner, appeared
before the Planning Commission and stated his in-
tention to occupy the property himself and stated
his concurrence with the conditions as set forth
in the Staff Report. He informed the Planning.
Commission that the property is lower than Ocean
Boulevard, no higher than the adjacent property,
and cuts off no one's .view or air or 'sea breeze.
Commissioner Beek expressed his feeling that the
purpose of .a variance in this instance is that
the present definition of height is unworkable
and will not apply to a house built on a steep
• slope and further expressed his desire that,thie
Planning Commission revise its definition of
heights.
Motion x Motion was made that the Planning Commission make
the findings as included in Exhibit "A" of the
Staff Report and approve Variance No. 1063, sub-
ject to the conditions as included in Exhibit "A"
of the Staff Report.

Commissioner Allen expressed her concern relevant
to building on a steep slope and suggested that
there be included a clause attached to the deed
that would .hold.the City blameless in cases such
as this in which sites are vertical for the secon
o� third owner, should anything happen, in the
eVent.that the building is not as stable as it
should be.
Hugh Coffin, City Attorney, commented that ini-
tially, the City will require, prior to any build
iing, soils reports and other engineering reports
that would indicate that it is built in as stable
aco.ndition as possible and that the Coastal Com-

mission.has attempted to undergo something of thi
nature in this area. He further informed the
Planning Commission that the City has an ammun-
ity in the Government Code from liability for
issuing a permit on a house, but that City liar
bility is beginning to become a problem. He then
.suggested that a condition be programmed into an
approval of a variance in the event of an unusual
circumstance that would require a recorded notice
against the property indicating there may be a
problem with it.
Commissioner Beek expressed that one of the recom
mendations of the Grading and Siltation Committee
made to the City Council was that buildings built
om a slope of instability such as this would re-
quire both a geologist's report, and that the
builders provide .either a bond or an insurance
policy protecting all owners of the property for
the next 15 years against slope collapse.
James Hewicker, Director, replied that the por-
tions dealing with the amendments to the grading
code will come before the.City Council next week
and the portions dealing with the zoning ordi-
nance are tentatively scheduled for the next
Planning Commission Study Session.
Commissioner Balalis suggested that before the
applicant could receive the grading permit, he
would necessarily have to provide this if the
grading ordinance is approved and a condition
could be added to state that the City be held
b➢ameless,'not provided by the zoning ordinance.
Commissioner Allen expressed her intent that
an insurance policy not be required and that the
applicant not be charged any additional money,
but that she would request that the applicant
allow that a clause be included which would hold
the City blameless.
Commissioner Balalis expressed his understanding
that in the San Diego region, the Coastal Commis -
siion has required those statements, one of whiich

was recorded, as an encumbrance against the property, with
no effect on anyone else. He further expressed his under-
standing that the applicant must provide the City with
geology report and the geologist will give requirements1to
building on the property, and the City must be held havinles
in, the event the home slips.

to wit: "Applicant shall record a document whereby.he
waives all claim against the public and any governmental
agency for future.liability or damage, resulting from the
permission to build granted herein. This waiver shall be
binding on the applicant's successors in interest and any

Commissioner Balalis accepted Commissioner Beek's Amendment
to be included as part of his Motion.

Request to consider an amendment to Section 20.87.140 of
the Newport Beach Municipal Code as it pertains to thedefi
nition of the term "Dwelling Unit ", and the acceptance of
an Environmental Document.

mmissioner Beek expressed his feeling that the direction
ich this is taking is that ultimately they will define
dwelling unit to include a kitchen and that by bringing
e cooking facilities back into it, there will be a more
asonable definition of a dwelling unit. He then suggest -
that the term "cooking" be added to the provisions in the
finition of the term, "Dwelling Unit ". He expressed his
eling that if this change is made, there is no longer a
ed to worry about the amortization schedule, because the
uses are no.longer non - conforming, and that an amortiza-
on of 30 years is reasonable; however, an amortization of
years is excessive. He suggested including a clause
ecifying not before 1985 or at the first transfer of title
that the enforcement only takes place at the time the
operty is sold.
James Hewicker, Director, explained that this pertains to
lots in which cases there are two dwelling units that
ere built at a time when there

were two dwelling units permitted on that lot, bu
due to the fact that zoning on the property has
been changed so that only one dwelling unit is le
gal, said situation under the current code must
be altered 30 years from the date of original
construction of the dwelling and has nothing to
do with whether those dwellings have kitchens..
The Public Hearing was opened regarding this item
and Marjorie Nielsen, 707 Marguerite, Old Corona
del Mar, appeared before the Planning Commission
and expressed her feeling that a bedroom without
an! outside door presents a fire hazard and stated
heir preference that the amortization period be
60I years.
Dick Nichols, 519 Iris, appeared before the Plian-
ning Commission and suggested that the time perio
be 10 or 15 years from this date rather than 30
or 60 years from construction:
. Commissioner Beek replied that the builder should
be given time to amortize their investment in the
building.

Mr. Nichols again appeared before the Planningi
Commission and suggested that two units be al-
lowed, but that one of them be 2,000 sq. ft. and
leave less than 600 sq. ft. buildable for the
second unit. He expressed his feeling that the
definition of dwelling unit will depend on what
type of homes are constructed.
Commissioner Balalis expressed his concern re-
garding the 60 year amortization period, because
many of the areas contain dwelling units that
are duplexes in R -1 districts and a large invest-
ment is involved, as well as the peninsula, which
contains multiple units which would necessarily
have.to be modified or demolished.
Commissioner Beek suggested that the 60 years in
the case of a zoning change apply from the time o
the zoning change, not from the time of constru-
ction of the dwelling.

": ..must be altered to conform to the re-
quirements of the Code within 30 years from the
date of construction of the non - conforming. unilts,
unless specifically exempted by the City Counciil,
or unless the units have been made non- conformling
by a change of zoning since the original construe
tion, in which case, they must be altered to con-
form in 60 years from the zoning change."
Mrs..Nielsen.again appeared before the Planning
Commission and stated that the Coastal Commission
has now changed their buildable area to two times
the buildable area in all of California, except
Newport Beach and San Pedro and a lot of the
kitchens were added during the second war at a
time of shortage of housing, and to require thiat
kitchens or bathrooms be removed would bring
about a property devaluation. She expressed her
feeling that people should be allowed to use thei
. property to its highest and best use.
Motion Substitute Motion was made that Amendment No.
538 be revised to include a 60 year amortization
period, rather than a 30 year amortization per-
iod.
Commissioner. Beek expressed his opposition to the
Substitute Motion.
Commissioner Balalis stated his understanding
that the City Council requested that the Planning
Commission change the amortization schedule and
delete a sentence.

The Planning Commission then requested that Staff
consider 4 items to be. included on the report:
1) only upon sale of the property; 2) in no icas
before 1985; 3) 60 years from the zoning change,
if the non - conforming is created by a zoning
change; 4) 30 years from construction of the non
conforming units, or the units which became nom -
conforming as a result of the change of the defi-
nition of the term dwelling unit.
Commissioner Beek suggested that Staff also put
kitchen or cooking facilities into the definition
of the term "Dwelling Unit" and put back in makin
a separate unit by closing a door or putting up
apartition.

which has been suggested by the Fire Department
in order to provide clarity as to where the
City stands in relation to the underground stor-
age of flammable liquids in residential areas..

Commissioner Allen then suggested that Staff brin
back to the Planning Commission an idea as best
they can as to the age of the units which would
be affected.

Commissioner Balalis stated that he is aware of
some of the areas where zone changes have ocurred
but that he was not aware of any cases in which
dwelling units have been built illegally because
of a leniency in the definition.

Commissioner Haidinger expressed his understand-
ing that anyone who has such a tanker and is do-
ing something that this would prohibit would be
allowed to continue to do so, so that there is;
no great inconvenience to him.
Mr. Hewicker stated that this would represent a
legal non- conforming use and the person with this,
siituation would be able to continue to use it
under the non- conforming section of the Code.
Augie Wagner, Fire Marshall, replied that there
are no residential areas in which there are under-
gr und- storage tanks, and if there were, they
would be illegal and would be removed.

Allen, Fred Talarico, Environmental Coordinator,
replied that they will be removing an existing
bulkhead and putting it back in to give the
structural support needed and the volume of water
and water life would not be disturbed.
The Public Hearing was opened regarding this item
and Brion Jeannette, 504 N. Newport Boulevard,
Architect, appeared before the Planning Commissio
and explained that they are taking an existing
boat facility and making it a useable boat faci-
liity and adding a small storage building on the
eastern side of the property for safe storage
of flammable liquids and controlling any wash -
down of bad fluids.

drive in between the two fingers and the vessel
willl be hoisted up to the platform level and
tracks will take it into the boatyard. He fur-
ther explained that the transfer area is left
open for maneuverability, and the rails are de.
pressed train rails in concept, and the hoist
itself is attached to the bulkhead and at two
points down the length of the hoist is a pier.
Howard Bishop, Newport Beach, explained that the
vertical lift has four motors on it and there are
four pilings under each motor and the cement
walkways that start from the bulkhead and go
out 60 feet are underneath the electric motors
and there are supports for that and when the tabl
is down, the center part lifts the boat for
people to walk on.
In response to a question posed by Commissioner
Balalis, Mr. Jeannette replied that the existing
• 2;000 sq. ft. office building site will be used
solely for the business and the first floor will
be metal working and woodworking shops and the
upstairs will be the office function.

Bob Rubian, Proprietor of the Crab Cooker, ap-
peared before the Planning Commission and stated
that he has a warehouse the entrances of which
are at the point of the boatyard proposal. He
expressed his feeling that the boatyard is a
good project, but expressed his concern that
large boats and recreational-vehicles will be
accommodated, possibly blocking the streets and
the thoroughfare and circulation and the loading
zone and driveways in and out of nearby establish
ments. In conclusion, he expressed his second
concern that parking is deficient.
Mr. Jeannette explained that the maneuverability
of large boats will all be coming through the
water and won't be launching on a weekend basis,
but will be coming directly to the yard and goi-
ing on rails and not waiting and when leaving

the area via the land, it will go out the gates.
In answer to Mr. Rubian's last concern, Don Webb,
Assistant City Engineer, replied that there are
two drive approaches on 21st Street and one of th
required conditions is that the unused one be
closed up and can be used for parking.
Mr. Rubian expressed an additional concern re
g4rding the 24' pedestrian opening from the 22nd
Street Arcade onto the premises, stating that
one or two public meters would have to be elimi-
nated in the arcade area, inquiring whether the
24' opening is necessary, or whether the exist-
ing 18' is adequate, leaving the two parking
places as they now exist.
Mr. Bishop.responded that they do not intend to
remove any parking meters.
• The Planning Commission agreed to add.a condition
to follow Condition No. 1 to read, "The entrap -ce
from the arcade shall be such that it will not
reduce the number of metered parking spaces."
Commissioner Beek posed a question, to which
Mr. Bishop replied that there will be one speci-
fic place for washdowns, which will have a leachi
system in it which will be there strictly to col-
lect barnacles, solvents, etc. that come off the
bottoms of the boats, and will eventually.lead
back into the bay itself, but will filter all
the impurities as it does and will necessarily
have to be cleaned out periodically and will have
t� comply with the California Regional Water Qiva-
lty Control Board..
Mr. Hewicker replied that beginning on Page 9
of the Initial Study, there are mitigation mea-
sures proposed which are made a part of the con -
dtitions, beginning with Mitigation Measure No.
10 and ending with.Mitigation Measure No.. 14,
all dealing with retention basins, grease traps,
regular sweeping, etc.

for water to go over the back end onto their
property, and that the catch basin is 48' longs,
2V deep and 85' wide and can contain a large
amount of water. He added that if they find that
the leaching system is too low, hydraulics will
indicate this and there will be a pump that can
pNt it back up to a flow level and the entire
system is cleaned out periodically.
