THE NEWPORT BEACH CITY PLANNING COMMISSION met in ad-
journed regular session Wednesday, December 14, 1938 at
7:30 p.m. in the Council Rhambers, City Hall; Chairman
Hopkins presiding.
Meeting called to order by the Chairman,
ROLL CALL
Commissioners present: Hopkins, Seeger, Williams„
Briggs, Findlay.
Commissioners absent' lotus, Patterson, Whitson,
Hodgkineoa.
Attorney Roland Thompson end Building Inspector Nelson
attended.
Chairman stated that, since this was an adjourned
meeting, called to consider certain matters, the regular
order of business would be dispensed with.
HEARINGS -
Secretary stated that the business of the evening
was the second hearing upon the application of Marguerite
L. MacCulloch for rezoning of Lot 15, Bik 26, Balboa
Eastside Addition from R -1 to C-1 and the second hearing
upon the rezoning of Lots A & F. Tract 919 from R -1 to
C-1. Re explained that he had telephoned to the news-
paper office instructing them to duplicate the advertise-
ments run for the first hearings with the exception of
changing them to read "second hearing" and changing the
date to December 14, 1938, but that the adds had not
appeared in the paper.
Attorney Roland Thompson expressed the following
as being the appropriate findings and action for the
Planning Commission:
The Planning Commission finds that this was the day
and hour set for the second hearing upon the application
of Marguerite L. MacCulloch for rezoning of Lot 15, Blk 26,
Balboa Eastside Addition from R -1 to 0-1 and for the
second hearing on rezoning Lots A & F, Tract 919 from
R -1 to 0-1 and this commission also f }ads that it has
no jurisdiction to proceed with the hearings for the
reason that the hearings have not been advertised in the
manner required by Ordinance 440 and the Statutes of
California, through the negligence of the newspaper, and
that it is necessary that a new date be set for said
hearings.
Secretary Seeger awed that the findings as stated
by Attny. Thompson be made the findings of this commis-
sion. Seconded by Com. Findlay. Motion carried and
so ordered by the Chairman.
Com. Findaly moved that the hearings be advertised
for the regular meeting to be held December 21 -, 1938.
Seconded by Com. Briggs. Notion carried and so ordered
by the Chairman,
APPROVAL OF PLANS FOR MARINE ENGINE DISPLAY BOOM ON
COAST HIGHWAY. -
Mr. gager appeared before the commission to present
the plane for a shworoom and assembly room for marine
engines to be constructed on Coast Highway opposite the
Cris -Craft building. Re explained that it is to be primarily
a display room where dealers may send customers to view
different types of marine engines, the assembly room is
only incidental and there will be no manufacturing of
engines on the premises. Re will not deal dlrsetly with
with the public, but only through dealers. He said they
plan to set the building back 25 feet from the Highway.
It was the opinion of the commission that this would
be a permitted use under Ordinance 440 since the building
is to be used primarily for a display room.
Com. Findlay, chairman of the Architectural Committee,
examined the plans of the building and approved same for
the committee.
Com. Findlay moved that the Planning Commission
approve the plans for the Marine Engine display room and
•' assembly plant as presented by Mr. Hager. Seconded by
Com. Briggs. Motion carried and so ordered by the Chairman.
COMMUNICATIONS -
Secretary read a letter from Arthur K. Hutchings
requesting a 50% front yard setback variance on Lot al,
Abalone Street, Balboa Island.
Chairman requested the Secretary to reply to Mr.
Hutchings informing him that itwill be necessary for him
to make formal application for a variance.
Secretary presented a bill from the American Society
of Planning Officials for $5 covering the commission's
dues for membership to that Society for the year 1939•
. Chairman Hopkins said that he considered the News
getter mailed each month from the Society a great value to
the commission; each issue is filled with valuable material.
Com. Seeger stated that other material is sent out
periodically besides the News Letter. He considered
material of value to the commission and suggested that
the Hews Letter be sent from member to member for them
to read, then filed in a folder for future reference.
Com. Briggs moved that this bill be forwarded to
the City Council with the recommendation that it be paid.
Seconded by Com. Williams. Motion carried and so ordered;
by the Chairman.
