IN THE COUNCIL CBMIR OF THE NEWPORT BEACg CITY BALL ROLL CALL Commissioners Present: Copelin, Daniell, Bllerbroek, Longmoor. Pleger, Rudd, and Wightman. Commissioners Absent: Johnson and Smith. , MINUTES Commissioner Bllerbroek moved and Commissioner Pleger seconded the motion that the minutes of the meeting of November 17, 1949, be approved as submitted to the Commission. PUBLIC Empire Advertising Company application to build a standard poster panel on HEARINGS the following described property:- Coast Highway N 6201 East of Newport Avenue 1001 Lot F Tract 919, This sign is to replace one taken down there. Secretary Copelin explained the site etc., and that after investi- gation of the application, he recommended that the application be granted. Commissioner Copelin moved to close the hearing, seconded by Commissioner Daniell and carried. Commissioner Copelin then moved that a recommendation be sent to the City Council granting permission to erect the sign. Motion seconded by Commissioner Wightman and was passed by the following roll call vote:' AYES: Commissioners Copelin, Daniell, Ellerbroek, Longmoor, Pleger, Rudd, A Wightman. NOES: None. ABSENT: Johnson and Smith. Variance: A 50% rear yard variance on Lots 7 & 8 (Nly 651) Block 138, Be- sub of Corona del Mar, for Mrs. Helen Randall was opened by Chairman Long - moor. Commissioner ?lager gave an explanation of the variance and its necessity and Secretary Copelin stated that after investigation, he could see no reason why the variance should not be granted. Commissioner Copelin moved and Commissioner Daniell seconded the motion to close the hearing. Motion carried. Commissioner Copelin moved, seconded by Commissioner Pleger that the variance be granted and that a recommendation for its approval be ' sent to the City Council. Resolution carried by the following roll call vote: AYES: Copelin, Daniell, Ellerbroek. Longmoor, Rudd. Pleger. and Wightman. NOES: None ABSENT: Johnson and Smith. Conditional Permits Application of Keith 0. Burnham for a conditional per- mit at 111 Agate Ave, Balboa Island, Section 1, Block 7, Lot 8. so that he may.operate a washerette there was then declared open for discussion by Chairman Longmoor. Mr. Burnham was present and stated that he would be glad to answer any questions concerning the matter. In answer to a question from the panel, he stated that he would use all new machines; however, no particular brand had been chosen yet, and that he would have off - street parking in the lot adjoining the building. Chair- man Longmoor asked if he had a lease for it to which he stated that he had a five year lease on the building and was negotiating for the same type lease on the parking lot, Ales, he plans to level the lot and put decom- posed granite on. Chairman Longmoor asked if it would be possible to have a door leading from the parking lot into the building because of the traf- fic on the street•by cars going to and from the auto ferry. Mr. Burnham said it would be possible, but thought it would be rather costly. Chair- man Longmoor asked him to submit signed leases on the building and lot and drawings showing entrance on the side of the building. The Chairman asked for suggestions on the matter from Mr. Wise who agreed that a signed lease should be obtained for the parking lot running the same length of time as the lease on the building before the Commission grant permission for the , application. Commissioner Copelin made a motion that the conditional permit be set over to the next regular meeting of the Planning Commission on January 19, 1950. Commissioner Pleger seconded the motion and carried. 10.3 - -Harry Taylor, Costa Mesa. Owns a portion in Block A -34. Ho t with the underltanding an R -3 apartment house could be built there. With state parks on either side it is. undesirable to have single family residences. Wants R-4 on it also, -- Raymond Todd, 236 Goldenrod Ave., Corona del Mar. Protested Blocks 131-132 - 133 being changed to R -3 zone. Submitted petitions in protest.. People who live here are not desirous of having multiple buildings. If we allow R -3, it would detract from the property value. Requested to have zoning left as it is at the present time. —Henry Millar, 217 Crystal Ave., Balboa Island. The small island is to be re- zoned R -1 and he had two units on his lot and intends to get rid of one. Then sometime in the future h0 might wish to put up a second one and he wanted to know if that would be possible if it were rezoned to R -1. The Commissioneex- planned that whatever he had on his lot at the time the ordinance was adopted would be the determining factor. Mr. Millar stated he then wished to protest ' the change in zoning and wants it left to the discretion of the individual owners as to whether they want one or two units on their lots. Chairman Long - moor stated the Commission would go into this matter when considering all the suggestions. Chairman Lougmoor opened the second hearing on the adoption of the now zoning ordinance and explained that the Commission is in no hurry to run the ordinance through and that they are going to take their time and go into all the sug- gestions very carefully. He then asked for comments from the floor. ' - -Lew Miller, 3463 Live Oak, Huntington Park. Owner of 101 Lot 5 and 301 of -Lot 7, Block 23$, Corona del Mar, and has a residence at 702 Acacia,ODM. spoke in regard to the rezoning on Marguerite Avenue. He said that he would like to protest the rezoning to H -1 because right next to him a contractor had built quite a pretentious court of about six units and another big project was going in, and stated that he didn't think it's suitable for private residences. He had planned to build some units over there himself and would appreciate it if the Commission would carefully consider it before making a change in the zoning there. —Mr. Nmpes, representing the Citizens National Trust and Savings Bank (owner of Block A -34 known as "The Hock ") siad that the bank felt the property is best . suitable for high class income property and not R -1 Residential use. They would like to see the property used as a state park and had tried to negotiate with the state to this effect, but the state said that they would only be interested in the level sands at the bottom of the bluff and not in the property, so the deal fell through. The bank hated to see it built upon at all; however, the bank had carried the property for many years and now must develop it, There- fore, as it must be developed, the question is.'What is the best use? Single family residences or high class income hotel property?$ He stated that if the property were developed as single family residential, there would be at least four sites and that they hated to see the property cut up at all. Also, they believed that single family residences would block off the view just as effec- tively as income buildings there. Therefore, as far as the view was concerned, there is no choice between R -1 or R -3. But, with state parks on both sides, it would be much better to develop the property into hotels. Also, there is a question of privacy making it unsuitable for private residences, and there is adequate parking facilities for probably 300 automobiles. In conclusion, he said that he believed it would give a reputation -to Newport Beach - -the kind of thing we really wanted and asked that A -34 be zoned R-4. - -Harry Taylor, Costa Mesa. "In any representative capacity, I appeared before the Commission recently regarding the zoning in Block 131, CDM, and would again like to go on record as-being against the rezoning of Block 131. We feel just as we did before. We appreciate the Commission's part, their work, etc., but if it is designated as R -3, we are inviting trouble for the Planning Commission too. Every time a person wants to build, they are going to have to make application to be granted by the Planning Commission.,, people who live there now do not want any R -3 in the block." Chairman Long - moor said the Commission had all the signature and protests for lot owners in that area on file. - -Dr. Levantine, owner of Block 1, Lot 1, Tract 323, and Lots 16-18 -20-22 in Block 232, CDM, inquired as to a change in zoning on his property. "I under- stand from the map a zoning change is considered for this property from R-3 to R -2. When we purchased, we bought becapse they were R -3, and we believe that those lots facing the gas station now are unsuitable for duplex and single family residences. They would be better for multiple or motel purposes than two-family residences. The Chairman asked if he would write out his protests and attach maps etc. for the Commission's consideration. - -Mrs. Millar: Owns two lots on Cyrstal Avenue on the small island and wanted to know the object of rezoning it to R -1. Mr. Wise was asked to explain it and said that from the standpoint of contestion it was necessary. A traffic count showed 9,000 cars going on and off the bridge a day and the traffic situation is going to become impossible at thisrrate.when the remaining portion of the small island is developed. It is their aim to decrease the increased traffic tendency wherever it might be possible to do so, - -Kate MCBann. "Mr. Wise, can you tell me why our last zoning ordinance wasn't enforced?" Mr. Wise answered that the question was beyond him and that he had found a good many illegal buildings and violations on the island under the re- cent zoning inspection. --Ruth Wiegand, 1133 E. Balboa Blvd. Owner of i lot 15, 16, Block 18, B.S.A. to Balboa Tract which is now zoned R -1 and is being recommended.to be changed to R -3. No protest. —B. Z. McKinney, 1214 Ocean Blvd., Corona del Mar. Has home on "The Triangle" and would have no objections to some R -2 zoning in this section, but there have been about six very nice homes costing in excess of $20,000 built in the very area proposed to be zoned as R -3. Property will depreciate if it is R -3 a- round there. Planning is a dangerous thing, yet at the same time a very nec- essary thing.- One buys property on the basis .of the zone in which it is loca- ted only to find out later that they propose to change it from multiple to residential. Wants to build an apartment house on his Marguerite property and stated that no one is going to build a nice home next to the motel already there. With motel on one side and apartment houses on other side, it would be illogical to not let the same zone continue on into the new zoning plan. Chairman Long - moor asked him to send in written protest. -- Carter Lane, 1118 Ocean Blvd., Corona del Mar. In regard to change in zoning that type property, it should be very well and carefully considered since there is only a limited amount of R -1 property in Corona del Mar. It has been R -1 for a long time, and any plans to change it should be very carefully considered. — Chairman Longmoor again explained that they are going to give.a great deal of careful consideration to the plan before they recommend any action to the City Council. cos -- George Johnson, 441 W. Elm, Burbank. Owner of Lot 6, Block 239, voiced his protest of a change in the zoning from R-3 to R -1 and stated that he felt it should be allowed to develop the same as the other side of the street... would be difficult to sell it as R-1 property ... the new zoning would decrease the actual value of the lot...sympathies with Mr. McKinney. -- Blanche Kilbourne, Upland. Owner of Lots 8- 10 -12 -14 and 16, Block 239, Corona del Mar on Marguerite, protests this change because of the motel and residential lots next to a motel would be undesirable. Why not leave Marguerite as it is? -­Roger Watson, 19842 Newport Blvd., Costa Mesa. Owner of Lots 9 and 10, Tract 1136. Under the new ordinance everything must go to the Planning Com- mission first. I think it shows too much power in the hands of the Planning Commission. Suggested putting it before the people for a referendum vote be- fore it is allowed to become a law. —Lewis Briggs. Would file a report -- Harold Wilson, 320 Iris Ave., Corona del Mar. Didn't come down to protest. Spoke in favor of Block 131 rezoning as R -3. -- Robertq,�A. Bernasconi, 114 Pearl Ave., Balboa Island. Owner of Lot 7 & 8 (All Ex Nly 961) Block 34, Re -Sub Corona de Mar. Is it true that the com= mercial zone has been entirely eliminated other than C -1 in Corona del Mar? G-2 was changed to C -1 which is more liberal than the old C-1 and allows, practically everything the old C-2 did. ' -- Wallace Calderhead, 712 Iris Ave., Corona del Mar. Wanted to know that route the Freeway is going to follow, to which Mr. Wise answered that they thought it should go on the North side of Corona del Mar. - -Henry Millar asked if maps could be made up and published or printed for the public now. It was explained that this would cost too much and that the plans aren't far enough along to warrant this being done. . Nor further discussion, Commissioner Copelin moved that the hearing be con- tinue and set over to the regular February, 1950 melting of the Planning Com- mission. Motion seconded by Commissioner Rudd and carried. OLD None BUSINESS COMMUNI- Lettersfrom H. E. Selvey (Pastor of Assembly of God Church, Newport).re- CATIONS questing permission to use store building in the 2500 block on Ocean Front for a temporary church. Discussion with the Commission, Mr. Selvey and Mr. Nelson, Building Inspector. Commissioner Pleger moved and Commissioner El- lerbroek seconded the motion to grant temporary use not to exceed one year on the store building for a church. Motion carried.
