Planning Commission discussed C.C.& R. provisions and their enforceability. Lawrence Wilson, Vice President of Robert Bein, William Frost & Associates, 1401 Quail Street, appeared before the Commission and advised that the applicant concurred with the staff report and conditions as previously recommended by the Planning Commission and the City Council. That curb access ramps be constructed at the intersections of Von Karman Avenue with Birc Street and with MacArthur Boulevard. 4. That vehicular access to the easterly side of Von Karman Avenue between Birch Street an MacArthur Boulevard be limited to a total of five private driveway approaches (there are three existing), and that the location of th two future driveway approaches be approved by the Public Works Department. 5. That all connections for water and sewer be accomplished in a manner satisfactory to the Public Works Department. Public hearing was opened in connection with thi matter. Sylvia Hatten, 548 Vista Grande, appeared before the Commission in opposition to the request because she felt the lights and noise would depreciate property values and would be detri- mental to the surrounding properties. John Stuart, 440 Vista Grande, appeared before the Commission on behalf of the Board of Direct( of the Bluffs Homeowners Association and comment on the promises which had been made by the Boy's Club when the original use permit was approved relative to landscaping and keeping activities within the building. As an individual, he questioned the need to convert grassy areas to • asphalt and felt there were a sufficient number of other facilities in the area to provide for outdoor activities. Dan Hoodard, 544 Vista Grande, appeared in oppo! tion to the request for lighting as he felt it would shine into his home across the field. He also commented on the lack of landscaping aroun the Boy's Club. Bob Briggs, Costa Mesa, Boy's Club Board of Director, appeared before the Commission to answer questions relative to the request. He advised there was a need for the lights because over 400 boys had signed up for basketball; tha the lights would be turned off at 9:00 P.M. and would be controlled from inside the building rat than from a time clock; the basketball court wo be supervised and the noise would be no greater than from a group of boys playing other games; and the lights would be similar to those instal at the Newport Beach Tennis Club which are designed to direct the lights straight down on the court. He answered questions of the Commis Sion relative to the present facilities and the • landscaping. Commissioner Frederickson commented on the ligh ing and noise and felt there would be no effect on the properties adjacent to the park because Page 5. He also felt there was a need for the court and that the commitment for landscaping should be met. Commissioner Hummel voiced concern that a new element was being introduced into the area and the effects were unknown until the facility was installed. He also commented on the need for landscaping. There being no others desiring to appear and be heard, the public hearing was closed. Motion X Motion was made that Planning Commission make th following findings: 1. That the proposed use is consistent with the Land Use Element of the General Plan and is compatible with surrounding land uses. 2. The project will not have any significant environmental impacts. 3. The approval of Use Permit No. 1846 will not under the circumstances of this case be detrimental to the health, safety, peace, morals, comfort and general welfare of persc residing and working in the neighborhood or detrimental or injurious to property or improvements in the neighborhood or the general welfare of the City. and approve Use Permit No. 1846, subject to the following conditions: 1. That development shall be in substantial conformance with the approved plot plan and lighting plan. 2. That the lighting system shall be designed and maintained in such a manner as to concee the light source and to minimize light spill age and glare to the adjacent residential uses. The plans shall be prepared and signe by a Licensed Electrical Engineer; with a letter from the Engineer stating that, in hl opinion, this requirement has been met. Page 6. He advised of their preference for asphalt instead of Portland Cemen Concrete for paving the easement because of the expense and future maintenance problems; and tha the provision for curb be eliminated on one side of the easement and replaced with turf block or similar material in order to reduce the impact of so much concrete or asphalt. City Engineer Nolan commented on the request and advised there was no objection to the deletion o the requirement for Portland Cement Concrete. However, with respect to the request for turf block to replace curb on one side, he suggested the alternate use of stamped concrete because th City's experience with turf block has not been entirely satisfactory. Mr. Foreman requested a compromise of 4 feet of turf block and 4 feet of stamped concrete, to which Mr. Nolan agreed. Rolly Polaski, 105 Main Street, Architect for th project, appeared before the Commission and advised of their desire to retain the present configuration of the garages and install garage door openers. He also advised that the Newport Heights Homeowners Association had reviewed the plan and felt that it met the concerns of the community. He concurred with the staff recom- mendations and answered questions of the Commis- sion relative to landscaping. Mike Mooslin, 621 Powell Place, appeared before the Commission to comment on the neutral positio of the homeowners association, the depth of the proposed lots as compared to those in the area, and felt that the proposed development was not compatible with the surrounding properties. If this development is approved, he requested that mature evergreen trees be placed every 15 feet o adjacent.properties with permission of the owner in order to screen the development from existing homes; and that decorative wood treatment.be placed on the windows and back walls. Norma Nell, 615 Powell Place, appeared before th Commission and advised that the development woul affect their living area because of the height size of the structures. Page 8. He also suggested that if the final grade was higher than adjacent properties, that a 6 foot high solid block wall be constructed. . Victor Shenski, resident of Gary Place, appeared before the Commission in favor of the proposed development and felt that it would be an asset to the neighborhood. Ed Hume, 1501 Haven Place, applicant, appeared before the Commission to comment on the average size of the proposed lots and the net buildable area; the design of the homes which took into consideration the subject of privacy on adjacent properties as well as that of the proposed units • and advised of his willingness to landscape the project within reason. There being no others desiring to appear and be heard, the public hearing was closed. Commissioner Balalis commented on the size of tf lots in the area and felt that some of the con- cerns would be resolved if the number of lots was reduced to four. Motion X Motion was made that Planning Commission accept the environmental document, make the findings a! recommended in the staff report, and approve Tentative Map Tract 10156, subject to the recommended conditions except that condition No. 5 f. should be deleted and condition No. 5 should read as follows: Curb shall be provides except that the requirement for standard curb may be waived on one side of the street, a 4 foi width of the standard pavement may be replaced with stamped concrete paving and 4 foot of the width replaced with turf block." Commissioner Hummel voiced reluctance in approv a project where the homes were located on an undedicated street. He also voiced concern wit • the width of the access easement. Motion X Motion was made to continue this matter in order to allow the applicant the opportunity to come b with a redesigned project containing four units. Staff pointed out that a continuance would requi the concurrence of the applicant since this matt had previously been continued and there was a ti element involved. Ed Hume, applicant, appeared before the Commi.ssi at their request and advised he could not see an reason for a continuance since his studies had indicated that the project with less units would not work out any better than the one proposed, and, therefore, preferred that the project be denied rather than continued at this time. Commissioner Cokas felt that the developer had done everything possible to meet the concerns of the adjacent properties, and that the proposed development would do nothing but increase the va of the neighborhood. Motion X Following discussion of alternative actions whic could be taken, substitute motion was made to reconsider the approval of Tentative Map Tract 10156, making the findings and subject to the conditions as originally recommended in the sta report (i.e. no change to conditions 5 f. and g. Commissioner Hummel advised he was still opposed to the proposed development because of the inade quate streets and over - abundance of building. Ayes X X X Motion to approve was voted on and failed. Noes x x X Motion X Motion was then made that Tentative Map Tract 10156 be denied, based on the following finding: 1. That the proposed map does not meet the requirements of the Code in that it requires an exception which can be eliminated by another kind of development. Page 10. The proposal includes the paying of an annual fee to the City for the required parking spaces in a nearby Municipal parking lot in lieu of providing parking on -site Live entertainment is also proposed in the expan ed restaurant facility (i.e. Studio Cafe). The existing structure encroaches to within 3 feet t of the rear property line (where the Ordinance requires a 5 foot rear yard when abutting reside tial property). All new construction conforms with the required 5 foot rear yard setback. The proposed development is a logical expan- sion of an existing automobile sales and service facility that was approved by the Planning Commission. 5. The approval of Use Permit No. 1579 (Amended will not, under the circumstances of this case be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing and working in the neigh borhood or be detrimental or injurious to property or improvements in the neighborhood or the general welfare of the City. and approve Use Permit No. 1579 (Amended) subjec to the following conditions: 1. That development shall be in substantial conformance with the approved plot plan and elevation. 2. The automobile service and storage areas sha be enclosed by 6 - 8 foot high masonry walls as indicated on the approved plot plan, except for openings into the existing servic and storage portions of the facility. 3. That a landscape plan for the proposed land- scape planter areas shall be approved by the Director of Parks, B aches and Recreation. Said plan shall incorporate similar trees, shrubs, ground cover and lawn, that now exis on the site. All landscaped areas shall be separated from an adjacent vehicular area b) a wall or curb at least six inches higher tt the adjacent vehicular way and shall be equipped with an automatic irrigation systen and shall be permanently maintained. 4. Exterior illumination of the expanded site shall be permitted subject to standards developed by the Emkay Development Company which set forth criteria as to number, loca- tion, height, size, and wattage of each fixture. Said standards shall be reviewed e approved by the Director of Community Develc ment. All fixtures shall be directed and shielded as required to confine any visible light source to the premises. City Engineer Nolan advised that the existing parking standards were adopted by the Planning Commission and City Council a number of years ag based on a parking study made at that time and although they are minimum standards, they were found to be workable. Public hearing was opened in connection with thi matter. Helmut Reiss, applicant, appeared before the Commission and concurred with the staff report and recommendations. He answered questions rela tive to parking and control of the lot. Richard Beren, 709 Begonia Avenue, appeared before the Commission and voiced concern with t parking problems in Corona del Mar, especially on another lot adjacent to his property which is located diagonally across the street from the subject property. Helmut Reiss appeared before the Commission to comment on his 15 years of experience in the operation of a delicatessen and advised that the business would be closed at 10:00 P.M. and does not provide live entertainment or dancing. He felt there would be no reason why his business would be noisy or cause parking problems and agreed to closing the parking lot when the busi- ness was closed. Lila Crissman, 707 Begonia, appeared before the Commission to comment on the traffic and parkin( problems and the misuse of alleys in the area. She suggested that the alleys be made one -way in order to eliminate some of the problems and make the neighborhood safer. Sven Pretorius, 706 Begonia, appeared before th Commission in opposition to the request and com on the use of the subject parking lot by other businesses in the area as well as the number of other restaurants in the area. That the map meets the requirements of Title 19 of the Newport Beach Municipal Code, all ordinances of the City, all applicable gener or specific plans and the Planning Commissic is satisfied with the plan of subdivision. 2. That the proposed resubdivision presents no problems from a planning standpoint. and approve Resubdivision No. 565, subject to V following conditions: 1. That a parcel map be filed. 2. That there shall be submitted a declaration of Covenants, Conditions and Restrictions, setting forth an enforceable method of insui ing the continued maintenance, restoration and replacement of the proposed facilities I the two sites.
