Rudd, seconded by Com. Lind, and carried. AMENDMENTS: 1st hearing on the application of the Irvine Co. to amend Zoning from a "U" District to an R-# district on Lots 1 to 5 inclusive of Tract.; "2172 located along the easterly side of Harbor Island Road between Rudder Road and Bayside Drive. Com. Copelin moved that the hearing be.'closed and set for second hearing on January 20, 1955. Motion seconded by Com. Lind, and carried. 217 Amendment #10 Irvine Co. (Referred back to Planning Commission by City Council) VARIANCES: Application of Eldon and Mary Urschel for a 2' 6" setback on be Sola Terrace and a 7' setback on De'Anza Drive instead of the 10 foot #167 setback now required. Also a 15 foot rear setback instead of the 22 feet required by R-1 -B district zoning on Lot t87, Tract #1237. Urschel, Eldon The hearing was declared open. & Mary Mr. Urschel presented a letter at this meeting amending_1is LAt 87, Tr. #1237 application to request a twenty (20) foot rearyard setback and a five (5) foot yard set'oack from the property line on De Sola Terrace Granted as only. (At meeting of Oct. 21, 1954 the Planning Commission granted amended Variance for a five (5) foot setbacl on De Sola Terrace only.) FIi'DINGS: The said lot of record is large enough.to contain a house with the existing setbacks. Due to a considerable fall in contour across the lot a yard setback of five (5) feet alone,De Sola Terrace and a twenty (20) foot rearyard setback would allow better use of the property than is now possible with a ten foot side setback. Any variance in setback facing De Anza Drive is considered by the commission to be a detriment to adjacent and surrounding property and not allowable under Section 9106.3 of the City Code. CONDITIONS: Any or all yard setbacks are from property lines only and not from any curbs or public improvements.. The hearing was closed on motion of Com. Copeli.n, seconded by Com. Lind and carried. Com. Lind moved that the application be granted as amended, seconded by Com. Fasters for a 3 foot front setback for an V - #174 attached garage on Lot 47, Block A. in Tract #673, and located at 308 Hazel Drive in Corona del Mar. Section 9103.15 of the City Code Masters, Charles and District Map #18 require a 10 foot setback. Lot 47, Block A, The hearing was declared open. Tract #673 FINDINGS: Adjacent houses and garages on either side of the property described herein have setbacks consistint with or less than that . Granted requested by the applicant. The property has a limited building area due to an embankment which drops off at the other end of the lot. The setback requested herein will allow the applicant a greater use of his property with no adverse effect on adjacent or surrounding property. The hearing was closed on motion of Com. Hardesty for a second floor apartment to overhang a double garage 15 inches into the 30 inch rearyard set- back facing a 15 foot alley in a C-1 District property being used for residential use only. The 10 foot setback demanded by G-1 District, Section 9103.55 (d) is amended by Ord. #702 for residential use to 10 feet from center line of the alley. Said property is Lot 1, Block 3, Newport Bay Tract, and located at 300 E. Balboa Blvd. The hearing was declared open. FINDINGS: The proposed overhang will not interfere with passage of vehicles through the alley. The use of C -1 property for residential use on the property described herein raises the restriction level for the property and the proposed overhang will not be detrimental to adjacent or surrounding property. Come Copelin moved that the application be granted, seconded by Come Keene, and carried by the following roll call vote, to -wit: ALL AYES Application of Mr. & Mrs. A. H. Buck for an extension of a deck over garages two (2) feet into the required rearyard setback of ten (10) feet facing a 10 foot alley for addition of future apart- ment over double garages and to waive the automatic 6 months - termination requirement so 2nd floor apartment can be constructed at a later date. Property is Lot 13, Block 10, Section 2, Balboa Island, and located at 210 Ruby Ave. Covered by Section 9103.25 of Ord. #635. The hearing was declared open. FINDINGS: The garages are to be set in feet from alley to provide turning room foot alley. The overhang of two feet is request of thirty inches which has been surrounding property and will allow the second floor apartment. FINDINGS: The rear property line of the lot described herein abutts Lot 42, Tr. #1218 the rear of another lot with no alley between, It is unlikely that an alley would ever be put through this block: Thus a ten foot Granted setback along the rear is not necessary. The 5 foot setback pro- posed herein will not be detrimental to adjacent or surrounding property. -The hearing was closed on motion of Cam. Copelin seconded by Come Lind, and carried. Com. The hearing was declared open; FINDINGS: The placement of the house proposed for said Lot #68 ten Irvine CO. & feet from the front property line will allow a view to the existing Macco Corp. ' houses northerly of said lot and will nbt block the view of any houses along the front of the lot. Thus the setback will be of bane- Irvine Terrace fit to neighbors and not be detrimental. Granted Reed, and carried by the following roll call vote, to -wit; ALL AYES Application of Harry Mann for construction of a garage building for 3 cars, two (2) feet from rear property line facing a 10 foot alley. V - #184 Required setback is 5 feet from rear property line. Property is located on Lot #150 and SW'ly 20 feet of Lot #149, Sub. A. East Mann, Harry Newport Tract, at 336 Buena Vista, Balboa. The hearing was declared open. 336 Buena Vista FINDINGS: The reconstruction as proposed creates an accessable modern Balboa garage to replace a substandard structure, and should be an improve - ment to the neighborhood. Granted CONDITIONS: Proposed garages are to be set on an angle with doors presenting a saw tooth front arrangement on plan as shown on plans for easy access by automobiles. FINDINGS: The above described lots are adjacent along a common DENIED frontage along a wide street facing the rear of bluff frontage Granted lots. A 10 foot setback will not inferfere with the view of other properties to either side. The three lots to the west have been granted ten (10)foot front setbacks on Variance #150. (NOTE: Variance #129 was-granted Lot 7, Blk. 11, March 22, 1954 for substantially the same construction, which Balboa Tract expired Sept. 229 1954. Present proposed design is for two story construction instead of previous 3 story. Previous building DENIED not practical due to cost of construction and 3rd story stairway ' which caused necessary re -design.) The hearing was declared open. FINDINGS: The zero setback at the alley entrance is considered to be a hazard to traffic,both pedestrian and automobiles,since it allows a 10 foot entrance to the alley. Ord. #702 adopted February 8, 1954 wherein residential requirements would be adhered to on commercial property is used for residential purposes. The lot contains 2700 square feet which would allow only two units (one for each 1000 sq. feet allowed by Section 9103.35 of the City Code.) The front setback required would be 20 feet and the rear 'setback 5 feet with 3 foot side setbacks on C -1 property by Ord. #702. The hearing was closed on motion of Com. Copelin, seconded by Com. Hoskin and Son for permission to operate #161 a small boat and water sport equipment sales within a building and to include Marine Hardware & Sporting Goods in a C -1 -H District as Hoskin, Lyle required by Section 9103.52 (a), on Lots 43, and 44, Tract #1210 & Son and located at 1220 W. Coast Highway. Off -street parking is pro- vided for 15 cars with separate entrance and exit driveway around the Lots 43 & 44, building to circulate traffic and avoid conjestion on the Highway. Tr. #1210 Granted FINDINGS: ,Plan submitted with application showing parking layout for 15 automobiles with separate entrance and exit on WAst Coast ' highway which allows circulation of cars without congestion. The small boat sales is to be carried on within a building and will not interfere with the residential section above. There are similar type businesses on. either side of Lots 43, and 44 in Tract #1210. CONDITIONS: Building to be used and parking layout for fifteen oars with drive around building so as to have a separate entrance and exit on the state highway to be as shown on plan attached hereto and made a part of this Use Permit. ' Lind, and carried. Com. Copelin moved that U.P. #162 be set over set over to next meeting in order that the commission as a whole can look over the property. Motion seconded by Com. Rudd, and carried. Application of Stedman B. Hoar and associates to operate an electronic sign manufacturing business on &C-1 District lot, wherein -signs will U.P. #163 be assembled, fabricated, and sold on property described as the south- easterly portion of Lot 5, Block D. Tract #323 and located at 609 Hoar, Stedman B. Fernleaf Ave., Corona del Mar. - & Associates The hearing was declared open. FINDINGS: The applicant says there Will be no noisy machine operations or odorous and injurious fumes given off by the manufacturing operation. There is,a loading area enclosed by a wall for shipping operations. CONDITIONSY 1. Granted for a period of 6 months only. Permit will expire June 30, 1955. 2. Application of G. Beemer to remodel an existing non - conforming U.P. #164 building containing three units on an R -3.lot 251 % 102.501 con- taining 2562.50 square feet. Said building is non - conforming Beemer,.G. due to.setbacks on front and sides being less than that required by Section 9103.37 and more units than is allowed by Section Lot 14, Blk. 15, 9103.35 (b) of Ord. #635. Lot 14., Bloch 15, Section B, Newport Section B Beach Tract, and located at 1529 W. Balboa Blvd. Newport Beach The hearing was declared open. Tract FINDINGS: The existing building to be remodeled is of sound construction but quite old and not good looking. The stairway to Granted the 2nd floor is unsafe and in a poor location. Exterior doors swing out onto the sidewalk. The applicant proposes to remodel all apartments, relocate the stairway in a side setback, and stucco the entire exterior. A petition by twenty -three of the applicants immediate neighbors stating that they are in accord with his proposed remodeling was presented. The investigation committee of commissioners believe that the results of remodeling will be a definite improvement to the neighborhood and encourage responsible tenants to the apartments. CONDITIONS: Remodeling is limited to the existing two story building which is 22 feet wide by 32 feet long and an adjo6:ning rear one story section 23 feet wide by 24 feet long which two parts make one building fifty -six feet long containing 3 units as per plot plan attached hereto. Rudd, and carried by the following roll call vote, to -wit: ALL AYES Second hearing on Amendment #11 by Planning Commission Resolution Resolution to amend zoning Ord. #635 - Original motion set hearings on #589 application fees of $15.00 on Use Permits; $25.00 on Variances; and $50.00 on Amendments. After study of survey of fees charged Amendment #11 by adjacent and surrounding cities, the Commission voted at the 1st hearing to recommend a further change in fees to allow a $10.00 fee on Use Permits; $15.00 on Variances, and $50.00 for Adopted Amendments, upon motion of Com. Copelin, The hearing was declared open. FINDINGS: The existing fees charged for Use Permit, Variance, and .Amendment applications do not cover the actual cost of processing. Charges for publication vary from $3.50 to $12.25 with $4.35 a fair level figure. Average consulting and clerical time by the Planning Commission staff to process an application and issue the permit is approximately three hours for Use Permits, and Variance applications, and considerably longer for Amendments due to the research generally needed to accomplish a satisfactory, solution. In addition the City Attorney must draft an Ordinance to accomplish the amendment. All of these costs are without consideration of Council time or time spent to investigate the actual use by the applicant of the permit and see that it is accomplished in accord with the law. The proposed increase in fees does not cover the many cases which are handled by the Administrative Assistant through consultation, which do not require action by the Commission or the Council. Rudd, and carried by the following roll call vote, to -wit: ALL AYES r. 123. A list of possible professional offices was mailed to each commissioner for discussion at the December 16, 1954 meeting. Professions to be Professional defined under "Professional Offices" were discussed and the Commission Offices proposed an amended list by elimination of parts of the original list and ordered that the new list be prepared ancLmailed to each Commissioner for further discussion at the Jan. 20, 1955 meeting. A motion was made by Com. Copelin that the Planning Commission n6t accept any applications for hearing later than 12:00 noon of the Friday ACCEPTANCE OF preceeding the Planning Commission hearing and all applications received Applications after that time will be set over until the next regular meeting.
