THE NEWPORT BEACH CITY PLk'NING COMMISSION held its regular monthly meeting in the Council Chambers, City Hall, Newport Beach, California on Wed, eve. December 17, 1941 at 7.30 P.M., Chairman Johnson presiding. ROLL CALL: Commissioners present: Estus,Hall,Hopkins,Seager, Johnson and Patterson " absent: Findlay, Allen and Nelson MINUTES: The Chairman called for consideration of the revised minutes of Oct. let, 1941. Commissioner Patterson moved the minutes be adopted as written, which motion was seconded by Com. Hopkins. Motion carried and so ordered The minutes of November 19th were then considered and motion made by Com.l Hall that these minutes be approved as written. Motion seconded by Com. Estus, carried and so ordered. COMMUNICATIONS: Seely. Seeger read the following communication which was received from the Newport Beach Grammar School and dated Dec. 3rd, 1941: "The Trustees of the Newport Beach Elementary School District re- spectfully request permission to purchase the following described property for the purpose of erecting a school building according to the plans and time as set forth in data to be submitted at a later dmb. ' Blks 531 and 631 of Corona Del Mar, City of Newport Beach as per M.M. Book 3, Pages 41 -42, Records of Orange County, approximately 4-12 acres. Respectfully, (Signed) Marion C. Dodd, Clerk, Board of Trustees of Newport Beach Elementary School Dist. Chr. Johnson advised that he had talked to Mr. Ed. I. Moore who had advised that it is necessary, due to the State law, that the Planning Commission approve a site. The traffic problem was discussed by the Commissioners and the fact that the proposed school will be one block from the highway and will run two blocks back to the bluff was brought out. Com. Patterson advised that the children on the island would be transported to the school in Cor- ona Del Mar. Seely. Seeger stated that the State assumed that Newport Beach has a master plan of parks, playgrounds, and recreational centers and that the purpose of the State Law covering this case, is to give the Plan- ning Commission an opportunity to state %hether. the proposed site would work out in the future development of the community. He added that in or- der to protect ourselves and the public welfare, since the school would not be built immediately, a committee of this commission be.appointed to make a survey in Corona Del Mar and that _the Commission, after such com- mittee's report, might be able to suggest something that A,ould be of value. Com. Patterson stated that it was his understanding that the matter had been taken up with the State Department of Education and the School Board by a Committee appointed for that purpose. Mr. Ed. Moore was telephoned, and asked to appear at the meeting. After Mr. Moore's arrival, Chr. Johnson. explained the previous discussion to him and asked Mr. Moore how urgent the matter was. 43 MINUTES COMMUNIC/TIOES 44 Mr. Moore explained that negotiations had reached a point where the deal is ready to be consummated but that this cannot be done until the approval of the Planning Commission is received. He stated that Dr. Birch of the State Board had been taken over the prouosed site and had aplroved it. Mr. Moore wds'.askedhby Cammihsiohet Patterson if other sites had been considered. Mr. Moore advised that they had but that the proposed site had been decided on. , When asked about the traffic situation Mr. Moore explained that the pupils from Balboa Island would be brought up the lower road via bus and that the bus. would nick up pupils on the northern side of the highway and brought to the school, across.the highway. He further explained that due to an increas ed enrollment of 118 pupils, a larger bus was being purchased to relieve the overtaxed bus situation. After further discussion, Com. Hopkins moved that Coms. Patterson, Hall aid Secretary Seager, as a committee of three, confer with the School Board add file a report with this body at the next meeting. Motion seconded by Com. Estus. Motion carried and so ordered. Secretary Seager read a communication from the City Council and signed by the.City Clerk, Frank L. Rinehart, dated December 16, 1941 and reading as follows: "At a meeting of the City Council of the City of Newport Beach, held on.Monday, December 16, 1941, the following was referred .to you. City Council, Newport Beach, Calif. Gentlemen: The City of Newport Beach owns Lots 11,18,15,20,22 in Blk 732, Corona Del Mar. Said block is just west of the Main St. extension and 101 Highway. It is my opinion that this block should be rezoned from R2 to 83, ' thus enabling it to be developed for multiple income. There are, however, 8 other lots in this block that will be affect- ed if this zoning is changed. I have, on deposit, $50.00 on the sale of Lots 20 and 22, at the, sale price of $450.00, providing the zoning is.changed to R3 (Signed) Balph P. Maskey. There was some discussion among the Commissioners regarding the letter from the City Council, since the Council did not request this•property be rezoned. Cam. Patterson stated that such was the intention of the Council. Com.Seager stated that while there was nothing personal in his regarks, he felt that'at times the Commission had been used by realtors and property owners who wanted to sell and because of that, wanted to rezone for their convenience. He added that the Commission should be above that and that, in the absence of an application for this rezoning, the Commission should take no action on the matter. After still further discussion, Com. Patter- son moved that the Secretary be instructed to contact the City Council and that if they requested it and made application in writing for the rezoning of this property, the Secretary be authorized to advertise for the first hearing at the next regular meeting. Com. Estus seconded. It was so order- ed. The Secretary advised that he had received a bill in the amount of $5.00 from the American Society of Planning Officials which bill was in arrears. Cam. Patterson moved that- the• Secretary be authorized to make demand and ' send it to the City Council. Com. Hopkins- seconded this motion. Motion car- ried and so ordered. The Secretary read the advertisement which advertised the matter for see- 45, and hearing. THE FOLLOWING LAND TO BE CHANGED FROM Rt3 to C-2 ZONE SECOND Lots 1156, 1157, and Lots 1178 and 1214 incl., in Tr. 907, as shown upon REARING a map recorded in Bk 28, pages 25 to 36 incl., records of Orange County, ON AN California, a parcel of land being part of Lot 3, Sec. 28, Township 6 AMENDMENT South, Range 10 West, S.B.B. & M. described as follows: Beginning at the TO southwesterly corner of Lot 1166 in Tract 907, as shown on a map record^ ORD #440 ed in Bk 28, pages 25 to 36 incl., records of said County; running thencerROM Rr3 easterly along the southerly boundary line of said Tract 907, 42$ feet TO more or less, to an angle point in said boundary line; thence southerly C-2 ZONE along the westerly boundary line of said Tract 907, 200 feet; thence westerly in a direct line parallel to 'the aforesaid southerly b undajY line of said Tract 907, 461 feet, more or less, to an intersection with the easterly line of Central Avenue; thence northerly along the easterly line of Central Avenue to the point of beginning, excepting the westerly 100 ft. thereof; and Lots 9 to 35 incl. in Blk 431, Lots 1 to 9 inc1N and Lots 17 to 30 incl. in Blk 530, Lots 13 to 21 incl. in Blk 430, Lots 16 to 26 incl. in Blk 331 all of said blocks being in Lancaster's addit- ion, as shown upon a map recorded in Blk 5, page 14 of Miscellaneous: Maps, Records of said County. Lots 1 to 7 incl. in Block 529, as shown on said map of Lancaster's 4dr dition. The Chairman asked if any written protests had been received. The Secretary reported that none had been received and there was no response when the Chairman asked for verbal protests. Com. Hopkins moved that Resolution No. 195 recommending an amendment:te Ord.440 be adopted covering the rezoning of the above described property and that the same be forwarded to the City Council by the Secretary 48 the recommendation of this Commission; a copy being filed as part of'ths minutes of this meeting.
