ROLL CALL Commissioners presents Copelin, Daniell, Ellerbroak, Johnaon,: Long - moor moor, Pleger, Rudd and Wightman. Commissioners absents Baltz. MINUTES Commissioner Johnson made the motion for the approval of..the minutes of meetinf of November 20, 1947, which was seconded by.Commissioner Rudd and carried. PUBLIC HEARINGS Final hearing upon the application of Mr. John E..Sadleir, for change of zoning classification.from R -2 to C-2 for Lot 9,.Block 7309 Corona Del Mar, excepting therefrom the northwesterly forty feett.was heard, same having been tabled from the last meeting. Committee..- .report was given by Commissioner Wightman, who stated that the coamittee.recom- mended that the application be.denied, due to the many -other lots in Corona Del Mar similarly situated, and, that it would not be fair to recommend the change for this lot and not the others. After consider- ation by the Commission, Commissioner Johnson made the.motion,.second- ed by Commissioner Wightman, that this application be denied., which ROLL CALL VOTE carried by the following roll call votes AYES: Commissioners Oopelin Ellerbroak, Johnson, Longmoor, Pleger, Rudd and Wightman., NOES: None. ABSENT: Baltz. NO VOTE: Daniell. Final hearing upon the petition of application. by Mr. J H. Rinehart, Thomas Miller, Phil F. Holmer, end William W. Cowan, owners of Lots 1, 3, 5, and 7, Block 7;0, Corona Del Mar, was heard. Commissioner Wight - man gave the committee report of recommending that.this. petition be denied, for the same reason as the previous application of Mr. Sadleir's for Lot 9, which adjoins. Mr. Rinehart was present and questioned the similarity of these lots with any others in Corona Del Afar, to which Commissioner Pleger explained that this does exist at Fernleaf, where R -2 zoning is across from 011. Commissioner.Ellerbrook made the motion for denial of the petition, which wassseconded by Commissioner.Johnson, ROLL CALL VOTE and carried by the following roll call vote: AYES: 00ftiAbloners Cope- lint Daniell, Ellerbroek, Johnson, Longmoor, Pleger, Rudd,.and Wightman. NOES: None. ABSENT: Baltz. Hearing upon the application of Elsie R. Karl and Albert D. Oberg, for a 50% front yard setback variance for Lots 8 and 99 Block.15, Easteide Addition to Balboa Tract, otherwise known as 1014 East Central Avenue, was declared and heard, same having been duly filed and advertised. Committee report was given by Commissioner Wightmant who stated that the committee recommended that only 25% variance be given due to the houses on the west being set back further, and 50% setback variance would block _heir view, and bring the building to within four feet of the bulkhead. Commissioner Ellerbroak suggested that a " setback be approved for Lot 9, but no setback variance for Lot 8, however, Mr. Ralph Hoyle, representing the property owners explained that plans are drawn for a four unit apartment house building, so variance on Lot 9 only, would not help their problem. The matter was brought to a mot- ion by Commissioner Wightman, seconded by Commissioner Rudd, for re- commending a 2% setback variance for both lots, and the motion carried by roll call vote. However, later in the meeting, Mr. Hoyle requested a review of the application, and after discussion, Commissioner Daniell made the motion to rescind the motion for the 25% setbaokvariance, which was seconded by Commissioner Ellerbroek,,and carried. Them Cora- 23 missioner _ Pleger made the motion, seconded by Commissioner Daniell for the approval of a setback variance for a maximum up to 25% for the west- ' erly conneq of Lot 8, and a maximum up to 50% for the easterly corner of Lot 91 which carried by the following roll call vote: AYESt Commissioners ROLL CALL VOTE Copelin, Daniell, Ellerbroek, Johnson, Longmoor, Pleger, and Wightman. NOES: None. ABSENT: Baltz. Hearing upon the application of Dr. Lucius B. Phelps for a 50% setback variance for Lot 331 Tract $84, to permit the construction of an open porch, glassed on the west, said porch to be part of a proposed house to be reacted on said lot, was declared and heard, same having been duly fil- ed and advertised. Committee report.was given by Commissioner Ellerbroek who stated that the committee visited the property and found that since the original application was made that changes have been made in the plans and that the house has been moved to the twenty foot setback line, and, that they had heard many protests so did not wish to make a recommendation but decided to wait for the protests at the meeting. Mr. Fred Bennett was present representing Dr. Phelps, who passed maps around to all the Conimie- sionera, which showed all the lots in the block and their respective set - backs, and, refuted the arguments of the petition presented in protest by Mr. Powell, 916 Surf, of the adjoingin property owners, who all strongly opposed the granting of this application. The names of those on the peti- tion protesting, were Harry G. Huff man, Lot 29, G. C. Babcock, Jr., Lot 26, E. S, McKitterie #, Lot 35, W. E. Jewell, Lot 34, Marie Monaco, Lot 31, S.. R. Monaco, M.D., Lot 30, M. MaoCullock, Lot 28,,and Charles G. Boice, Lot 27. Commissioner Johnson reported that he and Mr. Nelson inspected the property and found that six feet has been cut off the plans, to.which Mr. Bennett answered that they originally had planned a twelve foot porch, but moved it back six feet. Commissioner Johnson recommended that the matter be tabled for further study, however, Secretary Ellerbroek made the motion seconded by Commissioner Johnson that the Commission recommend the.denial of this application, in view of the strong protests. Com- mittee report by Commissioner Copelin..was continued to the next meet- ing, and Chairman Longmoor stated that he had contacted City.officials, who stated that three of the councilmen, contacted, were in favor of such rezoning. Mr. Dinsmoore, of The Irvine Company, stated that they were requesting the zoning on the same basis and to correspond to the City property across the Highway. Commissioner Johnson made the.mo- tion, seconded by Commissioner Pleger, that the matter beset to sec- ond hearing. Motion carried and so ordered. First hearing upon the matter of the application of Miss Margaret.Gib- son for rezoning from R -1 to R -2 of Lot 1, Block 34, Corona Del Mar, was declared, same having been duly filed and advertised. Committee re- ..port was.given by Commissioner Pleger, who stated that he felt the application had been.filed in error, and Commissioner Ellerbroek stated that he felt that this is "a case of an unfortunate condition..created by people 'juggling' land around. .Commissioner Ellerbroek.made.the motion, seconded by Commissioner Rudd that the matter be set to second. hearing. Motion carried and so ordered. First hearing upon the application of Mr. Otto Boyd for rezoning from R -1 to R -2 of Lot 7, Block 22, Eastside Addition to Balboa Tract, was declared, same having been duly filed and advertised. Secretary Eller- broek read two letter.of opposition, one from Mr. G. R. Prose, and one from Mr. L. L. Isbell. Commissioner Johnson stated, after Mr. Boyd explained the problems.of his.propertyi that he had checked same, and that ','r. Boyd's lot is R -1 while all the others adjoining..are R -3. Mr. Thomas Webster was present and protected, adding that he would rather see the entire Balboa peninsula zoned R -1 than going into aV ' Rr2 or R -3 zoning at all. Commissioner Rudd made.the motion, seconded by Commissioner Ellerbroek that the matter be set to aecond.hearing. Motion carried and so ordered. Final hearing upon the matter, tabled from the last meetings of'the re- zoning of the four corners of 30th Street and Coast Highway, was dec- lared. Commissioner Jot-moon stated that "this brings up a number of problems, including the small piece of property, owned by the Pacific Electric Company, which is not included in this rezoning, and so will remain R -2." .Commissioner Copelin suggested that the matter be agitin tabled, however, Commissioner Pleger made the motion, seconded by Commissioner Wightman, that the Planning Commission recommend that the as advertised, of the four corners of 30th Street and Coast Highway, be rezoned to C-1 from R -2 classification, which eailt Cto carry by the following roll call votes AYES: Commissioners Daniell, Pleger, and Wightman. NOES: Commissioners Copelin, Ellerbroek, Johnson, Longmoor, and Rudd. A3SENT: Commissioner Baltz. COMMUNICATIONS Secretary Ellerbroek read a letter from Mr. C. R. Ripling, requesting a renewal of a 'variance granted last March on the 'key' lot located at 107 Garnet Avenue Balboa Island',,adding 'although the Building Permit has been issued and construction started, Mr. Nelson, Building Inspector has called to my attention the fact that we did not start work within I u 25 six months from date of issuance'. The Secretary stated that the City Attorney advised that this lot, Lot 7, Block 3, Section 1, Balboa Island is not only not a 'key' lot, but that the matter must be refiled and re- ' advertised, for reconsideration by the Commission; his argument being that a 'key' lot must be adjeoing property classified as C-1, C-2, or M -1, as set forth on page 16, Ordinance:No. 525. Mr. and Mrs. Ripling were present, and so were notified accordingly, and; also that the Commission recommended that another.filing fee would not be required. Mr. Tom Webster was present with a group of about twenty property owners . NEW BUSINESS of the Balboa Peninsula, in the area of "4" Street, who brought up their wishes of rezoning to R -1 the area from °F'.' Street to the end of the pen- insula, feeling that spratment houses do not improve the values An the area. The discussion was informal, and Chairman Longmoor explained the necessary steps required for such rezoning, etc. Chairman Longmoor and Secretary Ellerbroek reported to the Commission PLANNING CONSUL, that the request for a Planning Consultant has been tabled by the City TANT Council, pending further study, and, also that a proposed meeting with another consultant, Mr. Bennett is planned. Secretary Ellerbroek stated that he had been contacted by two students at U. S. C., who will be grad - uated in February, and available as assistants to the Planning Consultant then. Commissioner Pleger made the motion, seconded by Commissioner Wight - man, that a letter be directed to the City Council, advising them that the Commission has explored the angle of available men for assistants, and have two qualified men available shortly, who are very anxious to be cow sidered. Motion carried, and so ordered. ' Commissioner Copelin made the motion for adjournment, seconded by Commie - ADJOURNMENT sioner Daniell, which carried, and so ordered.
