HomeMy WebLinkAbout12/20/1951MINUTES OF THE PLANNING COML71SSION MEETING, THURSDAY, DECEMBER 20, 1951 ' ROLL CALL: Commissioners Present: Briggs, Copelin, Longmoor, Reed, Rudd, Smith, and Wightmsn. Commissioners Absent: Ellerbroek, and Pleger. MINUTES: Upon motion of Commissioner Rudd, seconded by Commissioner Reed, the minutes of the regular meeting of November 15th, and of the Special meeting of December 6th, were both approved as submitted to the Commission. .Motion carried. PUBLIC -USE PERJITS: HEARINGS: 1. Application of Clyde Hennell for "U" drive boat renntal.at 3310 Via Lido, (SEly 120' Lot 1, Tract 1117. Set over from November meeting for public hearing. Chairman Longmoor declared the hearing open and asked if anyone wished to speak for or against the application.. - -Mrs. Taylor, 3300 Via Lido wanted to know if they intened to put in a bulk- head to protect the bank. Chairman read letter of application in full which described in detail just what they inteneded to do:(Chairman also read a letter from the Lido Isle Community Association stating that they were opposed to such an install ation.� ���- r� -�• " .John Mottram of P. A. Palmer's office introduced W. Hennell to answer any questions. t1r. Hennell stated that they do intend to put in a.bulkhead, on the bulkhead line the whole length of the three lots involved. No boat re- pairing to be done on the lot to the extent of complete over - hauls. Will have launching ramp for trailer boats ramp open to the public. Mr. Mottram than stated that the Griffith Company would not be in favor of the launching ramp being open to the public. Mr. Hennell said that was the first they had heard of that and still wanted the ramp. Dean Ward, 217 Santa Ana Ave, brought up the point that.there are two fine churches across the street from the property involved and that they would require all the available parking on Sundays - -a day when a good deal of the sport fisherman are in the area. After further discussion, Commissioner Reed made a motion that the hearing be continued to the next regular meeting for further investigation. Motion seconded by Commissioner Copelin and carried. 2. Use Permit application of Lillian Schumann to operate a nursery school at 5810 Seashore Drive, (Lot 6, Block 58, Ocean Front Tract ). Chairman asked if anyone wished to speak for or against the.application. The applicant was present and said that she had written to the, surrounding neigh ors and received only one reply which was negative. The Lot is 301 x 851 and she plans to have 6 to 8 children plus two of her own under her care. Secretary Copelin read a letter of disapproval from one of the neigh- bars but they only occupy the house one month out of the year. School is to run five days a week- -not on weekends. Will operate all year 'round. Commissioner Rudd was chairman of the investigating committee and said that after looking the situation over, he could find no fault with it. 184 Commissioner Copelin made a motion that the application be granted, seconded by Commissioner Rudd and carried by the following roll call vote, to -wit: AYES: Commissioners: Briggs, Copelin, Longmoor., Reed, Rudd, Smith, & ' Wightman. NOES: None ABSENT: Commissioners. Eliberbroek, and Pleger. 3, Use Permit application of Frank E. Thibodo for retail sale of marine hardware, marine engines, boat accessories, new & used small boats, storage & repair of small boats less than 25 ft. in length, and milling & assembling of marine hardware for sale. Above to be conducted at 201 26th Street. (Hayward Lumber Company property) C-1 zone. Secretary read letter from the applicant, which gave complete picture of operations to be conducted there. Employ 5-20 people. Chairman asked if anyone wished to speak for or against. No casting, no grinding to be done. Applicant was asked if he'd be willing to have stipulated that all boat trailers would be parked on property and that there be ingress and egress. Agreed. Commissioner Copelin then made a motion that the application be granted, seconded by Commissioner Smith with above stipulations and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioners: Ellerbroek, and Pleger. VARIANCES: 1. Application of the City of Newport Beach for a setback variance on the ' southwest side of Lot 23, Block 138, River Section (203 38th St, Newport Beach). Variance is needed to move houses to widen the highway. Houses to be moved to the lots next door in each case. After further informal discussion, Commissioner Rudd made a motion that the hearing be closed, seconded by Commis- sioner Smith and carried. Commissioner Copelin then made a motion that the Commission grant a three foot setback variance on the sideline. Motion seconded by Commissioner Rudd and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, Smith, and Wightman. NCES: None ABSENT: Commissioners: Ellerbroek, and Pleger. 2. Application of R. L. Ward for setback variance (in connection with above) on Southwest side of Lot 2, Block 138, River Section (202 39th St, Newport Beach). The Chairman declared the hearing open. Another case of a 24 foot hcase on a -25 foot lot. Same circumstances as foregoing application. Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Reed and carried. Commissioner Rudd then made a motion that the application be granted, seconded by Commissioner Copelin and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, Smith, & Wightman. ' 'TOES. None ABSENr: Commissioners: Ellerbroek, and Pleger. 185 3. Application of S. F Falvey & W. J. Barry for relief from strict application of Section 9105.5 (a) of Ordinance No. 635 on Lot 4, Block 221, Section A, (207 21st St, Newport Beach). Chairman declared the hearing open. 0-2 zone. Building residence and want permission to leave roof off car space. After some discussion, Commissioner Reed .moved the hearing be closed, seconded by Commissioner Copelin and carried. Commissioner Reed then made a motion that the application be granted, seconded by Commissioner Smith and carried by the following roll call voted to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, .Smith, and Wightman. NOES: None ABSENT: Commissioners: Ellerbroek, and Pleger. 4. Application of Harry PA. Howell for a variance of 216" on the over- hang on the second story on YPly Lot 1, Block 9, Section 2, Balboa Island. (804 Park Ave.) Declared hearing open and asked if anyone wished to speak for or against. Applicant was present and explained why they need the vari- ance. Lot 30' x 401. Commissioner Reed was chairman of the committee and said that he and Ellerbroek had looked it over, and that Commissioner Eller - broek had expressed his opinion that he couldn't see any particular objection to granting it. Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Wightman and carried. Commissioner Smith then moved that the application be granted, seconded by Commissioner Rudd and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, Smith, and Wightman. ' NOES: None ABSENT: Commissioners: Ellerbroek, and Pleger. 5: Application of S, F. Tedesco for a 8' minimum front line setback on Lot 47, Tract 1133, (at Northwest corner Ocean View and Avon Street). Chair- man declared the hearing open. Roy IA. Watkins, 251 Tustin Ave, designed the apartment house which is planned and explained the application. Property called for twenty foot setback; if this were enforced owner would lose 113 of use of property. Lot is 73' x 1201, triangular shppe. Six units. Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Reed and carried. Commissioner Copelin then made a motion that the application be granted, seconded by Commissioner Reed and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, Smith, & Wightmanl NOES: None ABSENT: Commissioners: Ellerbroek, and Pleger. AIAENDMENTS: Continu& let hearing on Resolution of Intention No. 486 re: commercial incinerators. Set over from the November 15th meeting. letters on file ' from city attorney of time. Chairman and Ward & Harrim -,,ton asked if anyone wished Lumber Company agreeing to extention to speak for or against. --Arthur Pollard, 233 Santa Ana Ave, definitely against incinerators starting up again. (over) No' —Dean Ward, 217 Santa Ana Ave. Ward.& Harrington Lumber Company isa major operation. Doesn't believe there is any incinerator made that Will not give off smoke carry dirt, etc., and is a nuisance -- Walter Spicer, representing Ward & Harrington, said that he didn't ' think that the company should be deprived of a very necessary and proper installation of the business and that all lumber companies have them as a regular function of their business. - -Mr. Ward said that it was a different situation here in Newport Beach where the area is crowded and you have R -1 zoning across the street from the lumber company. Thinks W & H could take care of a lot of the incinerator wank at their Santa Ana location. If one starts, they'll all start, bu the lumber company is the serious one. Commissioner Copelin moved to close this bearing and set the hearing over to the second hearing at the regular January meeting. Motion.seconded by Com- missioner Reed and carried. Chairman.Longmoor asked if there was:ianythink'else to come before the Commission at this time. Mr. James C. Howard, 3116 Newport Blvd., was present and wanted to discuss informally what parking requirements would be if his client, Mr. Earl Strebe of Palm Sprints, wanted to re -open his theatre building. Parking would be approcimately one parking space for every ten cars. COMMUNICATIONS: Secretary Copelin read a letter from the City Council commending the Planning Commission in their work for the past year. There being no further business to come before the Commission, Commissioner Wightman made a motion to adjourn, seconded by Commissioner Reed and carried. Respectfully submitted, y Copelin Se etary G.
