Robert Spannagel, applicant, appeared before the Planning Commission to answer questions relative to the parking, landscaping, and prior conversion of the garage into residential use. Plannin Commission was concerned over the use of public tidelands by private individuals for their exclu- sive use. Motion X Following discussion, motion was made to approve Use Permit No. 1700 subject to the three staff conditions plus the conditions that at least one covered garage space be provided on site.and that the applicant either remove the encroaching paved parking spaces between the bulkhead line and the pierhead line or furnish the Department of Community Development with satisfactory evidence authorizing use of public tidelands. They questioned Condition No. 2 and discussed the drainage problem which presently exists on the property. They also questioned Condition No. 4 relative to formal dedication for public access across the property, stating that public access already exists from Newport Boulevard to the water. Planning Commis- sion discussed further public access along the bayside frontage. The applicant was opposed to additional public access along the bay for reasons of security to the boat slips which are presently under lease and pointed out the fact that the entire project was based on public access from a commercial standpoint. X X X Planning Commission continued the public hearing X UX X X on this matter to the meeting of January 17, 1974, and requested that the applicant furnish them with more details as to what is available for public access and alternate solutions to the drainage problem. City Engineer Nolan advised of the desire to retain the condition in question as extra protection that the sidewalks would be installed. TO developed residential areas; amendments to the sig standards in Areas 8 and 13; and revisions to the standards as they pertain to the height and loca- tion of fences in Areas 9, 10, 11 and 12. Zone: P -C Applicant: The Irvine Company, Newport 'Beach Owner: Same as Applicant Engineer: Williamson & Schmid, Santa Ana Community Development Director Hogan advised the Planning Commission of City Council's action in approving the density for Area 1 at 11 dwelling units per acre and Area 6 at 10 dwelling units per acre. However, there are some problems from an environmental impact point of view with respect to setbacks, particularly on Jamboree Road adjacent to the two southerly buildings; consideration for more guest parking, as all parking must be on site; and the possibility of the locations containing a paleontological site. Assistant Community Development Director Hewicker pointed out that the number of dwelling units in each area had been increased without an increase in the parking, therefore the parking ratio had been decreased. Dr. Sanborn, Director of Institutional Media for the Newport -Mesa Unified School District, appeared before the Planning Commission and made a present- ation on the paleontological aspects of the local area as well as presenting some of the specimens which have been found. COMMISSIONERS S I q A m r• ,n 1C S CITY OF NEWPORT naramk.n on 1n79 BEACH MINUTES INDEX cussed possible ways of preserving and identifying the potential paleontological sites, Larry Moore, Associate Director, General Planning Administration, the Irvine Company, appeared before the Planning Commission and stated that the Company is presently attempting to develop a program where- by identification of paleontological sites can be made before any development is anticipated. Bob McLain of McLain Development Company appeared before the Planning Commission and advised they have been in touch with the Los Angeles County. Museum in an attempt to work out a solution to the possibility of a paleontological site being located on the property. He also made a presentation on the concept of townhouse condominiums. Don Corbin of Morris & Lohrbach, architects; appear ed before the Planning Commission and gave a pre- sentation on the project pertaining to the cluster • concept, traffic movement, underground parking, guest parking on private streets, and reviewed the plot plans, sections, elevations, type of struc- tures, and recreation. Bob Williamson. of Williamson & Schmid, engineers, reviewed the project as it pertains to grading, access to the property, frontage roads, and traffic circulation. Don Brinkerhoff, landscape architect, appeared before. the Planning Commission and made a present- ation, through the use of slides, on the landscap- ing proposed, including plant material and screen- ing. Bob McLain of McLain Development Company again appeared before the Planning Commission to comment and answer questions relative to the reduction in the parking ratio, setbacks, noise level, land- scaping, the paleontological issue, life style of tenants and recreation proposed, ingress and egress throughout the development, and traffic generation. • Planning Commission discussed this matter and were concerned over the parking situation with respect to the ratio per unit, proximity of parking to units, and guest parking. They also indicated concern over the paleontological issue and lack of Page 9. The environmental impact report was discussed with respect to the above issues along with the traffic analysis on Jamboree Road, Ford Road, and the Intersection of the two streets. Planning Commission continued Tentative Maps of Tracts 8444 and 8445 to January 3, 1974, pending further information regarding the issues discussed. Request to subdivide 7.00 acres into one lot for INDEX Item B -4 TENTATIVE residential condominium development, and the M-xv — acceptance of an Environmental Impact Report (EIR TRACT /NB 73 -039). — UFO Location: Portion of Block 55, Irvine's Sub- CONT. Golden, Inc., San Diego Owner: The Irvine Company, Newport Beach Engineer: Quinton- Budlong, Los Angeles Assistant Community Development Director Hewicker advised the Commission that Conditions No. 2, 4, 6 and 7 should be accomplished prior to submittal of the final map. Community Development Director Hogan advised the Commission that the City Council approved the density on this particular development at 35 dwell- ing units per gross acre. Frank Hope, architect and co-applicant, appeared before the Planning Commission to request approval in concept of the project. He described the pro- ject in general, reviewed the plot plans and elevations, presented their rationale of the project, discussed the economics of the proposed development and briefly analyzed the impact the project would have on traffic in the area. The Commission discussed this project and felt that more detail was necessary before approval of the tentative map. Larry Moore, Associate Director, General Planning Administration, The Irvine Company, appeared before the Planning Commission and stated that the project is very complicated and that the intent of this request was to allow the developer an opportunity to obtain approval in concept before getting into technical, detailed studies of the various aspects of the project. X Planning Commission continued this matter to the meeting of January 17, 1974, for the purpose of obtaining more details on the project such as parking, ingress and egress, recreation facilities, fire protection, types of families which will be generated, children, open space, energy consumption, etc. Planning Commission recessed at 11:50 P.M. and reconvened at 11:55 P.M. The development shall conform to the plans as submitted, except for minor modifications approved by the Department of Community Development. 2. A landscape plan shall be submitted to and approved by the Department of Parks, Beaches • and Recreation. Said landscaped areas shall be enclosed by minimum six (6) inch high concrete or asphalt curbs, be equipped with automatic irrigation systems, and be perman- ently maintained. 3. All landscaping and street trees to be placed in the parkways shall be in accordance with a plan approved by the Parks Department and Public Works Department; and that the standard inspection fee of $3 per street tree be paid. 4. All illumination shall be shielded or directed so as to confine direct rays to the subject property. 5. That the design of the connections to Jamboree Road be as approved by the Public Works Depart ment. These connections shall be for right turns only. 9. That the driveway easement along the southerly property line be maintained open and usable for the benefit of the adjacent undeveloped property to the east. Provision shall be made to connect this drive in the future to a north -south drive connecting to Santa Barbara Drive. 10. They also discussed the requirement of right -turns only into the park - ing lot on Marguerite Avenue. This approval shall be for a one year period. Any extension of time beyond the one year period shall be approved by the Modifications Committee. 3.
