TEE NEWPORT BEACH CITY PLANNING COMMISSION met in regular ., session Wednesday, December 21, 1935 at 7:30 p.m. in the Council Chambers, City Hall; Chairman Hopkins presiding. Meeting called to order by the Chairman. ROLL CALL Commissioners present: Hopkins, $eager, Williams, Estus, Whitson, Hodgkinson, Briggs. Com. Findlay arrived late. Commissioners absent: Patterson. Building Inspector Nelson attended. MINUTES - Chairman called for the reading of the minutes of the three previous meetings. Com. Whitson moved that the reading of the minutes of meetings held Nov. 16, Nov. 30 and Dec. 14, 1938 be dispensed with, as all members had received copies there- of, and that they be approved as written. Secondsdby Uom. Estus. Motion carried and so ordered by the'Chaiir man. COMMUNICATIONS - Secretary ' read a letter of protest in reference to change in zoning as applied for by Marguerite L. Mac - Cnlloch form F Britton McConnell. Chairman suggested that communications referring to matters to be taken up later in the meeting be reserved until such matters are called for hearing. Secretary read a letter from the Orange County Planning Commission informing this commission that the matter of the tentative map:of Tract 1011 will come beffore' them for action at their meeting to be held December 28. Com. Whitson moved that the members of the Committee on the Strobridge matter appointed by the,Chairmans(Come. Fetus, Briggs,and Seeger) attend this meeting. "Seconded ` by Com. Hodgkinson. Motion carried and so ordered. COMMITTEE REPORTS Chairman called for a report from Coma Estus as chairman of the Subdivision Ordinance Committee. Com. Estue stated that the committee had no report at this time. • HEARINGS - SECOND HEARING ON REZONING OF LOTS F & A, TRACT 919. Secretary stated that tls second hearing on this matter had been properly advertised and that no written protests had been received. Dhairman,declared' the meeting open for discussion upon this matter and inquired if anyone present wished to speak on this rezoning No response. Dom: Whitson moved the adoption of Resolution No. 149 recommending to the City Council that that portion of Tract 919, to -wit: All of Lot 'B' as said Lot IF' is laid out.and shown upon a map of Tract 919 as recorded in Miscellaneous Maps, Book 29, Pages 31 -34 inclusive, records,of Orange County, California, and all that portion of Lot 'A' of said tract 919 lying south- westerly and southerly of the following described line; to -wit: Beginning at a point in the easterly.line of San Bernardino Avenue, as said San Bernardino Avenue is laid out and shown upon a map of said Tract 919. which point of beginning is 500.75 feet, measured along said easterly line and its southerly prolongation from the center line of the State Highway 100 feet in width; Running thence "outh 470 15' 30" East 520.9 feet; Thence southeasterly along a curve concave to the northeast and having a radius of 530 feet, which bears North 420 44' 30" East through an arc distance of 189.29 feet; Thence South 670 43' 20" East along a line tangent' to the last mentioned curve a distance of 376.06 feet; Running thence southeasterly along a curve concave to the southwest and. having a radius of 470 feet, which bears South 220 16' 40" West through an are distance of 266.17 feet; Thence South 350 16' 30" East along a line tangent to the last mentioned curve 153.35 feet; Thence southeasterly along a curve concave to the southwest and having a radius of 470 feet, which bears South 540 43' 30" West through an are distance of 164.06 feet; Thence South 150 16' 30" East along a line tangent to the last mentioned curve a distance of 148.6 feet; Thence southerly along a curve concave to the west and having a radius of 70 feet, which bears South 740 43' 30" West through an are distance of 67-19 feet; Thence South 390 43.' 30" West along a line tangent to the last mentioned curve a distance of 62.2 feet to an intersection with the northeasterly line of said State Highway 100 fest.in width. 3 J be rezoned from R-1 to C-1 and that the Secretary be instructed to transmit the same to the City, Council as the recommendation of this commission and that 'a copy be filed as a part of the minutes of this meeting. Seconded by Com.- Nstus. Roll Calls Ayes: Hopkins, Seeger, Briggs, Williams, Estus, Whitson, Hodgkinson. Noes: None. Motion carried and so ordered by the Chairman. APPLICATION FOR VARIANCE OF F. R. MYERS Application of B. R. Myere for a 50%. 19" side yard setback variance on Lot 45, Tract 907, Lido Isle was read by the Secretary. He stated that the plans had been posted, hearing advertised and postcard notices sent to surrounding property owners. All requirements of the ordinance have been complied with. Chairman declared the hearing open for discussion. Plot plan showing the relationship of the existing building to the proposed house and plane of the proposed building were examined by the members of the commission. Mr. P. A. Palmer, representing the applicant, ex- plained the reason for requesting the variance. The . house on the lot adjoining is built to the lot line in two places. This house was constructed prior to the adoption of the ordinance. If Mr. Myers kept the 3 ft. setback it would leave a space too small to utilise facing a blank wall, which would not only be undesirable but which would be waste space. It is the desire of the applicant to build as close to the lot line as possible in order to cut this waste space down to a minimum. It is not his desire to start any precident, but to correct a'bad situation already existing. In reply to a question by Chairman Hopkins, Mr. Palmer stated that the next door owner, the only interested out- side party, is agreeable to the granting of the variance. It was the opinion of the commission that, under the circumstances, a side yard variance should be granted. Cam. Briggs moved the adoption of Resolution ;149 recommending' that a 50%, 190 side yard setback variance be granted to N. R. Myers on Lot 45, Tract 907, Lido Isle and that the same be transmitted to the City Council by the Secretary as the recommendation of this commission and a copy filed a e a part of the minutes of this meeting. Seconded by Com. Whitson. Roll Call: Ayes: Hopkins, Seeger, Briggs. Willims, *Btu$. Whitson, Hodgkineou. Noes' None. MW Reporter's transcript of proceedings conducted by the City Planning Commission in re this application is attached to the minutes of this meeting. Action taken as follows: Com..Seager moved the adoption of Resolution 150 re- commending to the City Council that the application of Marguerite L. MacCulloch for rezoning of Lot 15, Blk 26, Balboa IBastside addition from R -1 to C -1 be denied and that the same be transmitted to the City Council by the Secretary as the recommendation of this commission and a copy filed as a part of the minutes of this meeting. Seconded by Com. Williams. Com. Seager amended his motion, with the consent of the second to incorporate the thought that this act ion is taken without prejudice to the filing of the application when the matter has been finally adjudicated. Roll Call: Ayes: Hopkins, Seeger, Briggs, Williams. Findlay, Estus, Whitson, Hodgkinson. Noes: Hone. Motion carried and so ordered by the Chairman. PLANS FOR BOAT CONSTRUCTION BUILDING - Mr. T. H. Dittmar appeared before the Commission with -- plans for a proposed building to be constructed on Coast Highway. The building is to house a boat works with living quarters upstairs. Com. Findlay moved that this matter be placed in the hands of the Architectural Committee. Seconded by Com. Briggs. Motion carried and so ordered. ODJOUBNMEB7T On motion of Com.
