PROVERENTS MADE P1 SAID CITY, DESCRIBING THE I]i- -- .PROVEMENT AND DIRECTING AN AC'TIO'N TO BB CO]LJIENDED I% THE SUPERIOR COURT OF OR- ANGE COUNTY, CALIFORNIA, IN THE NAME OF THE CPCY OF NEWPORT BEACH FOR THE CON - DEMNATION OF THE PROPERTY NECESSARY TO BE, 'OAKEN THEREFOR. The Board of Trustees of the City of Newport Beach do ordain as fol- lows: SECTION 1. The public interest and convenience requires them,'and the Board of Trustees of the city of Newport Beach hereby orders certain improvements to be made in said city described as follows: - -- _ - a. That both of the ends of the alley which extends easterly and west- erly in Block 4 of East Newport, be widened by curving the southerly line of said alley at the ends thereof southerly and the northerly line at the ends thereof northerly, the said Icurves to commence on the respective southerly and northerly lines of the alley twenty feet (20 ft.) from the ends of the alley and the radius of the curve shall be 20 ft. b. That both of the ends of the - alley which extends easterly and westerly in Block 5 of East Newport be widened by curving the southerly line of said alley at the ends thereof southerly, and the northerly line at the ends thereof northerly the said curves to commence on the respective southerly and northerly lines of the alley twenty feet from the ends of the alley and the radius of the curve shall be twenty feet. c. The easterly end of the alley which extends easterly and westerly: In Block 7 of East Newport be widen- ed by curving the northerly line there- of at the easterly end of the alley, northerly, the curve to commence on the northerly line of the alley twentyi feet from the easterly end thereof and I the radius of the curve shall bej twenty-feet. d. That both the ends of the alley which extends easterly and westerly' in Block 8 of East Newport be widen ed by curving the northerly line of said alley at the ends thereof north- erly, the curves to commence on the northerly line of the alley twenty feet from the ends of the alley and the radius of the Curves shall be twentyf feet. i e. The westerly end of the alley which extends easterly and westerly in Block 11 of East Newport be widen- ed by curving the northerly line or the alley northerly at the westerly end of the alley, the curves to commence 11 on the northerly line of the alley) twenty feet from the westerly end thereof and the radius of. the curve shall be twenty feet. The described alleys, the blocks mentioned and the East Newport re- ferred to are all as designated and shown upon a map of said East New- port recorded in Book 3, page 37, Miscellaneous Maps, records of Or- ange County, California. The said alleys and the parts there- . of to be widened are set forth and delineated upon a plan prepared by the Engineer of the city of Newport Beach, and now on file in his office. SECTION 2. It is necessary to take land in the making of the described improve- ments, and the city attorney of the city of Newport Beach is hereby di- rected to bring an action in the Su- perior Court of the State of Cal:'for- ma, in and for the county of Orange, for the condemnation of the property necessary to be taken therefor, the said action to be brought within sixty days after the passage of this or- dinance, and in the narrie of the city of Newport Beach. SECTION 3. Reference to Ordinance of Intention No. 256 of the city of Newport Beach, Passed on the 26th day of May, 19,14,; for a description of the Property to be taken and of the assessment dis -I trict is hereby made and for any and all Particulars. SECTION 4. i All proceedings taken in the making; of said Improvements and in the ac- tion to condemn the property neces $sty therefor shall be had and taken in accordance with the provisions of the Code of Civil Procedure, appii -: cable thereto, and I An i Act of the Iegislature of the I State of California, entitled: "An I act to provide for the laying out, . opening, extending, widening, or : straightening in whole or in part of public streets, squares, lanes, alloys,I courts, and places within munievuIi ties for the condemnation of property' necessary or convenient for such pur- poses, and for the establishment of as -, sessment districts and the assessment of property therein to pay the ex-: penses of such improvements." Ap- ! proved March 24, 1903, and all act:. i amendatory thereof. j SECTION 5. This ordinance shall be published. The above and foregoing ordinance shall be published once In NEWPORT NEWS, a newspaper of general cir- eulation printed, published, and cir- culated in the city Of Newport Beach, and shall take effect and be in force from and after its Passage. The foregoing Ordinance was duiy Introduced at a meeting of the Board of Trustees of the city of Newport Beach held on the 7th day of July, 1924, and passed at a regular meet- ing of said Board Of Trustees held on the 21st day of July, 1924, by the af. firmative vote of the following named members of said Board of Trustees: AYES, Trustees, Gen. Y. Wilson, H. C. Sloan, Fred W. Young, Conrad Richter, L. S. Wilkinson. NOES, Trustees, none. ABSENT, Trustees, none.
