Whereas. on the 3rd day of Novem-
ber. 1924, the Board of Trustees of
the city of Newport Beach required f
the city planning commission of said
city to recommend the boundaries of
a district in the city of Newport 'I
Beach within which the carrying on.
ponducting. and maintaining of the
business of drilling for. developing. )
producing. storing. and refining of
petroleum. oil, gas. and other hydro-
carbon substances should be lawful
and permitted. with such appropriate
reservations and restrictions to be en-
forced therein as to the said city
planning commission might appear
proper. and required that the city
planning commission hold a Public
hearing thereon. at the hour of 7:30
o'clock P. m. of the 13th day of No-
vember. 1924. at the council chamber
of the Board of Trustees of said city.
In the City Hall thereof;
Whereas. the city planning commis-
sion as so required duly gave notice
of the time and place of said hearing
by notice published once. on the 7th
day of November. 1924. in NEWPORT
NEWS. a newspaper of general circu-
lation printed. Published and circula-
ted in the city of Newport Beach. that
being the newspaper designated for
said Purposes. and there being no
daily newspaper published in said
city. and duly held the said meeting
at the time and place so required and
noticed. and afforded all persons par- i
ticularly interested and the generals
ipublic an opportunity to be heard:
Whereas. on the 5th Pay of January.
1925. after said meeting and hearing'
and upon due consideration of the
question. the city planning commis -I
j.sion made and filed with the Clerk of
the city of Newport Beach its final
report:
Whereas. the Board of Trustees of
the city of Newport Beach. upon the
filing of said final report of the city
planning commission. did. at its meet -

1925, order and fix the said matter
for hearing at the hour of 7:30
o'clock p, m. of Monday, the 19th day
of January. 1925. at the council cham-
ber of the Board of Trustees of the
city of Newport Beach. in the City
Hall thereof. and directed notice to
be given by publication once in NEW-
PORT NEWS. a weekly newspaper of
general circulation Printed. published
and circulated in the city of Newport
Beach. and designated for that Pur-
pose. there being no daily newspaper
,published in said city:
Whereas. on the 16th day of Janu-
iary. 1925. being within the week
within which said meeting was to be
held. such notice was duly published
,in said NEWPORT NEWS:
Whereas. Pursuant to said order and
notice. the Board of Trustees of the
city of Newport Beach held said meet-
ing at the time and place specified
and gave all Persons particularly in-
terested and the general public an
opportunity to be heard, referred said
matter to a joint meeting of the
whole Board of Trustees and the city
planning commission. and regularly
continued further hearing to the hour
of 7:30 o'clock P. m. of Monday. the
26th day of January. 1925. and at said
hearing finally took the same up.

Whereas. the question of establish-
ing a district or zone and the boun-
daries thereof within the city of New-
port Beach wherein it shall be lawful
to conduct. maintain. and carry on
the business of drilling for. develop-1
ing. Producing. storing. and refining
Petroleum. oil. gas. and other hydro-
carbon substances. and imposing reg-
ulations and restrictions on said
businesses. and prohibiting the con-
ducting. maintaining. and carrying on
of said businesses or any part there-
of. in the city of Newport Beach out-
side of said district or zone having
beet fully considered and understood:
The Board of Trustees of the city I of Newport Beach do ordain as fol-
lows:
SECTION 1.
It is hereby declared lawful for
any person. natural or artificial. to
conduct. carry on. and maintain al:

SECTION 2.
Every person. natural or artificial.
who shall conduct. carry on, main-
tain. or engage in any of the busi-
nesses designated in Section 1 of this
Ordinance shall conduct the same so
as to prevent fire thereby or there-
from, which may endanger. injure. or
destroy the property of any other
persons within the described district'
or zone. or the property adjacent to

SECTION 3.
It shall be unawful and constitute
a misdemeanor for any person. nat-
ural or artificial. conducting. main-
taining or carrying on said businesses
or any part thereof within the des-
cribed district or zone. to allow or
permit any petroleum. oil. or hydro-
carbon substances or any w:s:e. dis-
charge. or refuse matter produced
thereby. or any by- prWuct therefrom.
to flow. seep, or run upon the lands
of another or upon. over. or across
any public highway. street, alley. pub-
lic water. or other public '.'a�;.
SECTION 4.
It shall be unlawial still constitute
a misdemeanor for any person. firm.
co- Partnership. association of persons,
or corporation to conduct or cause
to be conducted. say of the blleinessLs
within the described distriri. or zone
in such a manner that the noise.
smell, odor. or gas produced thereby
)obstructs the free use and enjoy-
ment by others of their property. or -
I the same becomes offensiva to Ilia
'senses or interferes with the com-
plete enjoyment of life or ,property
by others. whether within said zone
or outside thereof, and every day that
any such business is so conducted
,or permitted to be conducted shall be
and constitute a new and separate

SECTION 5.
It shall be and Is hereby declared
' !to be unlawful and to be a misde-
meanor for any person. firm, cc -part-
nershtp, association of persons, or
corpora on o commence, con Uc ,
maintain, or Carry on or employ any
other person to do so, in any part of
the city of Newport Beach outside of
the district, zone, or portion of said
city described In Section 1 of this
Ordinance the business of drilling for,
developing, ,producing, storing, or re-
fining petroleum, oil, gas, or any
other hydrocarbon substance, and
�every day that any such person, firm,
co- partnership, association of persons,
or corporation does conduct, main -
.'tain, or carry on auy such business,
or attempts to do so, shall be and
constitute a new and separate offense.
This section is not intended to pre-
vent and shall not be construed as
preventing the storage of the refined
Products of petroleum ready for sale
and use at the places and in the quan-
tities now ,permitted by the ordinances
of the city of Newport Beach.
SECTION 6.
Every person who shall be found
guilty by a court of competent juris-
diction of a violation of this ordinance
or any of its provisions or of any act
or ommission therein declared to be
unlawful and to constitute a misde-
meanor, shall be punished by a fine
not exceeding $250.00, or imprison-
ment for a period not exceeding thirty
days, or both such fine and imprison-
ment in the discretion of the court.
In addition to the foregoing penalties
every nuisance existing in violation
of this ordinance shall be at once
abated.
The above and foregoing Ordinance
shall be published once in NEWPORT
NEWS, a newspaper of general circu-
lation printed, published and circulat-
ed in the city of Newport Beach, and
shall take effect and be in force thirty
days from and after its passage.
I hereby certify that the above and
foregoing Ordinance No. 275 was pass-
ed at a regular meeting of the Board
,of Trustees of the city of Newport
Beach held on the 6th day of April,

RATE OF LICENSE AND TIME OF
j PAYMENT THEREOF FOR CON.
DUCTING CERTAIN BUSINESSES
OR CALLLN" IN SAID CITY, AND,
PRESCRIBING A PENALTY FOR
ALL VIOLATIONS OF THIS OR-
i
DINANCE.
The Board of Trustees of the city of
Newport Beach do ordain as follows;
SECTION 1.
Every ,person, firm, or corporation
who shall engage in the business ofl
:selling or delivering ice in the city
of Newport Beach, not manufactured
An said city, shall pay a license of
$160.00 per month, and which shall be
paid monthly in advance and prior to
engaging in any such business.
SECTION 2.
Every person, firm, or corporation
'conducting, eugaging.in, managing or
carrying on the business of selling
f upon the public streets, or in any
Public place in the city of Newport
Beach, fire works, fire crackers, tor-
pedoes, or fire works display of any
kind, flags, banners, pennants, balls,
canes, horns, trumpets, or noise -mak-
ing instruments of any kind, toys,
badges, balloons, or souvenirs of any
description, or maintaining weighing
machines, or guessing contests, or
who operates a hand organ or other
musical apparatus, shall pay, daily in
advance, a license of $10.00 per day.
SECTION 3.
Every person who shall engage or
attempt to engage or who maintains
or carries on any of the businesses
mentioned in this Ordinance without
having first procured and paid for a
valid license to do so in the amounts
Provided for in this Ordinance shall !
be guilty of a misdemeanor, and upon
conviction in a court of competent I
Jurisdiction shall pay a fine not ex -!
reeding $100.00 or imprisonment not,
exceeding thirty days, or by both such
fine and imprisonment in the discre-
tion of the court.
SECTION 4,
The above and foregoing Ordinance,
shall be published once in NEWPORT,
NEWS, and shall thereupon take ef-
fect and be in force.
This Ordinance was passed at a
regular meeting of the Board of
Trustees of the city of Newport Beach
held the 1st day of June, 1925, by the
vote of the following named members
of the Board of Trustees thereof, to-
wit:
