ORDINANCE NO. 472
The City of Newport Beach, by
and through its city council, do
ordain as follows:
SECTION 1— Section I of Or-
dinance No. 189 of the City of
Newport Beach is hereby amend-
ed to read as follows: "Whenever
and wherever used in this Ordin-
ance, certain words, terms and
phrases shall mean, and at all
times be construed to have the
meaning, defined in this section.
The word "Liquor" or the phrase
"intoxicating liquor" shall be con-
strued to include alcohol, brandy,
whisky, rum, gin, beer, ale, por-
ter, and wine, and in addition
thereto, any spiritous, vinous,
malt, or fermented liquor, liquids
and' compounds, whether medicat-
ed, proprietary, patented, or not,
and by whatever name called, con-
taining alcohol by weight or by
volume in excess of that permitted
by the laws of the United States.
The term "Wholesale druggist"
shall mean one who sells drugs at
Wholesale and not to the general
public.
The term "retail druggist" shall
mean a registered pharmacist;
authorized to practice in this
State, conducting a regular retail
business in drugs and who sells
to the general public.
The word "physician" shall
mean a person wh6- has a license
to practice medicine under the
laws of the State of California.
The term "valid permit" shall
mean a_ legal unrevoked permit to
do the act or acts performed, is-
sued by a commissioner, Officer,
or agent of the United States, duly
authorized by the law thereof to
issue said permit.
SECTION 2— Section VII of Or-
dinance No. 189 of the City of
Newport Beach, Subdivisions "E"
and "G" thereof, are hereby
amended to read as follows:
"(e) The dispensation of intox-
icating liquors by retail druggists
holding valid permits to do so.
Every such prescription shall be
issued by a physician and filled
by the druggist in conformity with
and by the authority of the law
of the United States."
"(g) The manufacture and sale
of such preparations as flavoring
@Xtracts, , essences, tinctures and
perfumes, which do not contara
more alcohol than is necessary for
legitimate purposes of extraction;
solution or preservation; and all
remedies which do not contain .
more alcohol than is necessary for
extraction, solution or preserva-
tion, and which do contain drugs
in sufficient quantities to medicate
the compound, provided, than when
any of the aforesaid preparations
are manufactured in the City of
Newport Beach, they shall be
manufactured only by persons
holding valid permits to keep al-
cohol for non - beverage purposes,
and such preparations, whether
made in the City of Newport
Beach, or imported, shall be sold
only for lawful purposes, and not
as beverages; provided, further,
that any person who shall know-
ingly sell any liquor, compound;
flavoring extract, whether medi-
cated, proprietary, patented, or
not. by whatever name called, con-
taining alcohol by weight or by
volume in excess of that permitted
by the Laws of the United States,
shall be subject co the penalties
hereinafter prescribed."
SECTION 3 — This ordinance
shall be published once in NEW-
PORT NEWS, a newspaper of gen-
eral circulation, printed, published
and circulated'in the City of New-
port Beach, and shall take effect
and be in full force thirty days
after its passage.
I hereby certify that the fore-
going Ordinance was duly intro-
duced before the City Council of
the City of Newport Beach at a
regular meeting thereof held on
the 3rd day of April, 1938, and
passed at a regular meeting there-
of held on the 10th day of April,
19332 by the following vote:
AYES, Councilmen: Gordon,
Claire, Ellsworth, Garfield, Hil-
mer.
NOES, Councilmen: Nono.
ABSENT, Councilmen: None.

ance No. 412 having been passed
by the City Council of the City of'
Newport Beach this 10th day of
April, 1933, is hereby signed and
approved by me.
