ORDINANCE NO. 415
The City of Newport Beach, by
End through its City Council, do
6rdain as follows:
SUCTION 1. It shall be unlaw-
ful for any person, firm or cor-
poration to discharge, explode, fire
of set off any blank cartridges or
fire works containing red, white
or,other form oUphosphorus, or
fire crackers and salutes two
inches (2 inches) and over, whist-
ling devils, whistling storm kings,
blank cartridges, sky rockets, aer-
ial bombs, K. O. Flash, O. K.
Flash, Radio Bombs, Radio Flash,
Globe Flash, Sky Bombs, Radio
Aerial, Double Headed Dutchman,
Chinese Salutes, Chinese Bombs,
White Snakes, or any fire works
of similar make or manufacture
to those herein specified, provided,
however, that the City Council
may in its discretion grant permits
for public displays of fire works.
SECTION 2. It shall be unlaw-
ful for any person, firm or corpor-
ation, to sell or cause or permit to
be sold, explosives or fire works,
at retail, except the fire works and
explosives not prohibited by Sec-
tion 1 hereof, and except from es-
tablished retail places of business,
and except that a permit for the
handling of such explosives or fire
works shall first be granted by the
City Council of the City of New-
port Beach. An established retail
place of business for the purpose
of this ordinance is defined to be
a place where merchandise is of-
fered for sale to the public at re-
tail, and such place of business
has been established for at least
ninety (90) days prior to the time
of the making of the application
for a permit to sell fire works and
other explosives.
SECTION 3. It shall be unlaw-
ful for any person, firm or torpor-
' ation to sell fire works or ex-
plosives prohibited by Section 1
hereof, and no permit shall be
granted for the handling of such
explosives or fire works to a retail

SECTION 4. It shall be unlaw-
ful for any person, firm or cor -,
poration to discharge, explode, fire,
or set off any fire crackers or ex-,
plosives In the City of Newport
Beach, except on lands owned by
the City of Newport Beach, and
fronting on the waters of Newport
Bay or the Pacific Ocean.
SECTION 5. Any person, firm,
or corporation violating any of the
provisions of this ordinance shall
be deemed guilty of a misdemean-
or, and upon conviction thereof
shall be punishable by a fine of
not more than Fifty Dollars
($50.00) or- by imprisonment in_
the City Jail of Newport Beach or
the County Jail of Orange County,`
not to exceed thirty days, or - by
both such fine and imprisonment.
SECTION 6. This ordinance
shall be published once in NEW -;'
PORT NEWS, a newspaper of,
gen -_al circulation, printed, pub;,
lished and circulated in the City
of Newport Beach, and shall take
effect and be in force thirty days.

ance was introduced at a regular
meeting of the City Council of the
City of Newport Beach, held on
the 8th day of May, 1933, and was
duly passed and adopted at a regu=
lar meeting of said City Council
held on the 15th day of May, 1933,
by the following vote, to -wit:
AYES, Councilmen, Claire, Gar-
field, Ellsworth, Hilmer.
NOES, Councilmen: None.
ABSENT, Councilmen: Gordon.
