HomeMy WebLinkAbout423 - Radio Broadcast InterferenceE • • • ORDINANCE NO. 423 The City of Newport Beach, by and through its City Council, does ordain as follows: SECTION 1. It shall be unlaw- ful for any person, firm or cor- poration to operate in the city of Newport Beach, any device, ap- pliance, equipment or apparatus generating or causing high fre- quency oscillations or .radiations which interfere with radio broad- cast receiving apparatus, or wire- less receiving apparatus, except that a person duly licensed to practice medicine, osteopath ,,, chiropractic or dentistry by t:c State of California, in the coura of practice of his profession, mai operate or cause to be operated under his direct supervision, an -.. machine necessary to give trea'- ments, providing, however, that a' reasonable methods of preventing interference with radio broadcas'? tng receiving apparatus or wire- less receiving apparatus has bee---- applied. SECTION 2. It is expressly un- derstood;,and provided, .,however. that this ordinance shall not apply to radio stations, either broadcast, commercial or amateur licensed by the Federal Government, or which -are engaged in interstate communication, nor to. public util- ities under the supervision of the State Railway Commission. - SECTION 3. That the enforce- ment of this ordinance be placed in the hands of the Electrical In- Spector of the city of Newport Beach, who is given power to deputize one or more persons with- out pay, to assist in the duties herein set forth. SECTION 4. When an inspec- tion and test shall have been made by the Electrical Inspector, and it is found that any device coming within the terms of this ordinance is being operated in violation of this ordinance, the owner or the operator of such device shall, within forty -eight (48) hours af- ter notice has been served, either entirely discontinue the use, or repair the same, or attach silenc- ing device thereto, so that It com- plies with the provisions of this ordinance. Such owner or person in possession or operator shall be deemed to be operating such de- vice in violation of the provisions of this ordinance, and such persons shall be subject to the penalties hereinafter provided for such vio- lation. SECTION 5. The City Elec- trician or his duly authorized deputies, shall have the right to enter upon any premises at all reasonable hours for the purpose of inspecting the installation and working of all apparatus coming within the terms of this ordinance, and it shall be unlawful for any person, firm or corporation to in: terfere with the City Electrician, or his duly authorized deputies; in making such inspection, or to re- fuse to permit the said City Elec- t Ician or his deputies to enter the premises for such purposes. SECTION 6. It shall be unlaw= .`ul to sell or offer to sell or keep' 'n stock for the purpose of sale, Iny electrical appliance equipment or device, for use in the City of Newport Beach, the operation of ^hick in the ordinary course of ::se will constitute a violation of 'tP terms of this ordinance. SECTION 7. SECTION 8. Any person vio -- 'ating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon. con- viction thereof shall be punished by a fine of not more than five hundred dollars ($500.00) or by imprisonment. in the cry Jail for . a period of not more than six (6) months, or by both such fine and . imprisonment. .SECTION 9. The above and foregoing ordinance shall be printed and published once in Newport News, a newspaper of general circulation printed, pub- lished and circulated in the city of Newport Beach, and shall take effect and be in force thirty days after its final passage. The above and foregoing ordin- ance was duly introduced at a regular meeting of the City Counr cil of the city of Newport Beach, held on the 2nd day of July, 1934, and passed at a regular meeting of said City Council held on the 29th day of October, 1934, by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Ellsworth, Garfield, Hilmei•. NOES, COUNCILMEN: None., ABSENT, COUNCILMEN: None The above and foregoing ordin- ance No: 423 having been duly passed by the City Cmmcil of the city of Newport Beach this 29th day of October, 1934, is hereby signed and approved by me.
