AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ESTABLISHING A PLANNING COMMISSION UNDER °THE
PLAiINING ACT ", ADOPTED BY THE LEGISLATURE OF
THE STATE OF CALIFORNIA, 1929•

The City of Newport Beach, by and through its City Council,
does ordain as follows:
SECTION 1. There is hereby created a City Planning Commission
of the City of Newport Beach, under the provisions of that certain Act
of the Legislature of the State of California, signed by the Governor
of said State, June 17th, 1929, entitled: "An Act to provide for the
establishment of official master plans and the appointment of planning
commissions in cities, cities and counties, and counties; prescribing
the manner of adoption of such plans, portions thereof, amendments thereto
and composition thereof; prescribing the powers and duties of such
commissions; providing for the transfer thereto of the powers and duties
of other planning commissions; providing for the preparation, adoption
and recordation of precise street plans; providing for the control of
the construction of buildings within the lines of streets shown on such
precise street plans; providing for the levy of a special tax for the
• support of a planning commission and other acts pursuant to this act
and making certain expenditures legal charges against the funds of cities,
cities and counties, and counties and regional planning commissions;
providing for the establishment by cities, cities and counties, and
counties, of regional planning commissions, including two or more cities,
cities and counties, or counties, or a portion or portions thereof, or
both; making certain acts misdemeanors; and repealing other acts in
conflict herewith."
SECTION 2. Whereas, there is a Planning Commission in the
city of Newport Beach which was created pursuant to the laws of the
• State of California, in effect before the adoption of the Act of the
Legislature hereinabove named; said existing planning commissilon shall
continue, and the members thereof shall complete the terms for which
they were appointed, and shall thereafter be appointed in accordance
with the provisions of "`the Planning Act ", hereinabove referred to, with
the powers and duties provided in said Act in addition to the powers and
duties said Planning Commission already possesses.
The appointment and terms of said existing members of the
Planning Commission shall le- in accordance with Section 2 of "The
Planning Act" hereinabove specified.
. SECTION 3. This Ordinance shall be printed and published once
in NEWPORT JEWS, a newspaper printed, published and circulated in the
City of Newport Beach, and shall take effect and be in force thirty (30)
days after its passage.
The above and foregoing Ordinance was introduced at a regular
adjourned meeting of the City Council of the city of Newport Beach held
on the 11th day of February 1935, and was finally passed and adopted
on the 11th day of March, 1935 by said City Council at a regular meeting
thereof, by the following vote, to -wit:
AYES, COUNCILMEN: Gordon, Claire, Ellsworth
Garfield, Hilmar.
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None.
The above and foregoing Ordinance is signed and approved by
me this 12th day of March, 1935•
