ORDINANCE NO. 438
AN ORDINANCE OF THE CITY
OF NEWPORT BEACH RE-
LATING TO THE CARE AND
EXPENDITURE OF MONEYS
R E C E I V E D F R O M T H E
STATE OF CALIFORNIA UN-
DER THE PROVISIONS OF
ARTICLE 5, CHAPTER I, DI-
VISION I, OF THE STREETS
AND HIGHWAYS CODE.
Th City of Newport Beach, by
and through its City Council, does
ordain as follows:
SECTION 1. To comply with
the provisions of Article 5 of
Chapter 1 of Division 1 of the
Streets and Highways Code, with
;particular reference to the amend-
Infielits made thereto by Chapter
642, Statutes of 1935, there is here -
lby created in the City Treasury a
special fund to be known as the
"Special Gas Tax Street Improve-
ment Fund."
SECTION 2. All moneys re-
ceived by the. City from the State
of California under the provisions
'of the Streets and Highways Code
for the acquisition of real property
'or interests therein for, or the
construction, maintenance or im-
provement of streets or highways
(other than State highways shall
be paid into said fund.
SECTION 3. All moneys in
said fund shall be expended ex-
clusively for the purposes author-
ized by, and subject to all of the
provisions of Article 5, Chapter 1,
Division 1 of the Streets and High-
ways Code.
SECTION 4. This ordinance
shall be published once in Newport
News, a newspaper of general cir-
culation, printed, published and
circulated in the City of Newport
Beach, and shall take effect and
be in force thirty days after its
passage.
The above and foregoing ordi-
nance was passed by the City
Council of the city of Newport
Beach at a regular meeting there-
of held on the 2nd day of Decem-
ber, 1935, by the following vote,
to -wit:
AYES, CCUNCILMEN: Gordon,
Ulaire, Ellsworth, Garfield, Hil-
mer.
NOES, COUNCILMEN: None.
ABSENT COUNCILMEN:
None.
The above and foregoing Ordi-
nance is signed and approved by
me this 12th day of November,
1935.
