HomeMy WebLinkAbout448 - Special Election - 08-18-1936• E • • C� • ORDINANCE AO. 448 AN ORDINANCE OF THE CITY OF NEWPORT BEACH, CALI- i�ORWA, ORDERING, CALL- ING AND PROVIDING FOR THE HOLDING OF A SPEC- IAL ELECTION TO BE HELD IN THE CITY OF NEWPORT BEACH ON TUESDAY, THE 18th DAY OF AUGUST, 1936, FOR THE PURPOSE OF SUB- MITTING TO THE QUALI- FIED VOTERS OF SAID CITY A PROPOSITION TO INCUR A BONDED INDEBTEDNESS BY SAID CITY FOR THE AC- QUISITION AND CONSTRUC- TION OF A MUNICIPAL IM- PROVEMENT, TO -WIT, AD- DITIONS TO THE MUNICI- PAL SEWER SYSTEM. WHEREAS, the City Council of the City of Newport Beach, at an adjourned regular meeting there- of held on the 20th day of July, 1936, by a vote of more than two - :thirds of all its members, duly passed and adopted a resolution entitled "A Resolution of the City Council of the City of Newport Beach determining and declaring `that the Public Interest and Nec- essity demand the Acquisition and Construction of a Municipal Im- provement, to-wit, Additions to the Municipal Sewer System, in- cluding Acquisition of Lands and )�tights of Way and the Acquisition and Construction of a Main Sewer Line and Discharge Sewer Lines, a Sewage Disposal Plant, Sewage Works, Pumping Plants, and Buildings and Equipment neces- sary or convenient for said Pro- ject," which said resolution was numbered Resolution No. 969 and was duly signed and approved by the Mayor of said city and attest- ed and certified by the Clerk of said city: NOW THEREFORE, the City 6unell of the City of Newport Beach does ordain as follows: SECTION 1. That a special election be held and the same is, l hereby called to be held in the City 6f Newport Beach on Tuesday, the 18th day of August, 1936, for the purpose of submitting to the qual- ified voters of said city the prop- osition of incurring an indebted- ness and issuing bonds of said city therefor in the amount herein= after set forth and for the objects and purposes set forth in said resolution and hereinafter stated. SECTION 2. That the objects and purposes for which said in- debtedness is proposed to be in- curred and bonds issued therefor are as follows: PROPOSITION: The acqui- sition and construction of a municipal Improvement, to- wit, additions to the municipal Hewer system. including ac- quisition of Iands and rights of way and the acquisition and construction of a main sewer line and discharge sewer lines, a sewage disposal plant, sew- age works, pumping plants, and buildings and equipment necessary or convenient for said project. SECTION 3. That the estimat- ed cost of the proposed municipal improvement described in the proposition set forth in Section 2 hereof is three hundred thousand dollars ($300,000.00). That the amount of principal of the indebt- edness to be incurred therefor is the sum of three hundred thou - yand dollars ($300,000.00), and that the maximum rate of interest to be paid on. said indebtedness shall be five per cent (5 %) per annum, payable semiannually. That if the said proposition for the incurring of said indebtedness for said purpose so submitted re- ceives the requisite number of votes, to -wit, two - thirds of the votes of the qualified electors voting at said special election, bonds' of said city in the amount of three hundred thousand dollars ($300,- 0^^,.00) shall be issued and sold for the objects and purposes here - inabove set forth in said propo- sition. SECTION 4. That the polls for said election shall be open at six o'clock A. M. of the day of said election and must be and remain open continuously from slid time until seven o'clock P. M. of the same day, when said polls shall be closed, except and provided, how- ever, that if at said hour of clos- ing there are any voters at the polling places or in line at the entrance thereof who are qualified to vote and who have not been able to do so since appearing, the polls shall be kept open a suffic- ient length of time to enable them to vote, but no one who shall ar- rive at the polling places after ,seven o'clock , P. M. of said day shall be entitled to vote although the polls may be open when such person,;,tpay arrive. The ballots to be used at said ,election shall, in addition to appy other matters required by law tb be printed thereon, contain sub- . stantlally the following: "MARK CROSS X ON BALLOT ONLY WITH RUBBER STAMP, NEVER WITH PEN OR PENCIL. INSTRUCTIONS TO VOTERS. To vote on any question of- proposition, stamp a cross X in the voting square after the word 'YES" " or after the word 'NO.' All marks" except the cross X are forbidden. All distinguishing marks or eras ures are forbidden and make the ballot void. If you wmngly stamp, d tear or deface this ballot, return it to the Inspector of Election and obtain another. Proposition- Newport Beach in- cur a bonded indebt- edness in the princi- pal amount of $300,- 000.00 for the acqui- sition and construc- tion of a municipal improvement, to -wit; additions to th€ mu- nicipal sewer sys- tem, including ac- quisition of lands and rights of way and the acquisition and construction of a main sewer line and discharge sewer lines, a sewage dis- posal plant, sewage works, pumping plants, and buildings and equipment nec. essary or convenient for said project ? I YES. NO A cross X stamped in the voting square after the word "YES" shall be counted in favor of the adop- tion of the proposition or question. A cross X stampc_d in the voting square after the word "NO" shall be counted against the adoption of the proposition or question. SECTION 5. That for the pur- pose of holding said election there, shall be seven (7) precincts, being. the seven (7) regular election pre- r 1 • • • r 1 • • cipcts as now established in said city by the Board of Supervisors pf the County of Orange for hold- ing state and county elections; that the polling places for the re- spective precincts shall be the places hereinafter designated and that the persons hereinafter nam- ed, being competent and qualified electors and residents of said city and of their respective election precincts, are hereby appointed of- ficers of election for their respec- tive election precincts and they shall conduct said election and make the return thereof is the manner provided by law. Election Precinct No. 1 Shall consist of the regular election Pre- cinct No. 1 as now established in said City of Newport Beach by the Board of Supervisors of the County of Orange for holding state and county elections. Polling Place: Maskey's Real Estate Office, Coast Boulevard and 36th Street, Newport Beach. . Officers: Inspector Mrs. Eunice B. Fipps. Judge, Frank C. Brookings. Clerk, Mrs. Mrytle I. Blakeslee. Clerk, Mrs. Gladys Mann. Election Precinct No. 2 shall consist of the regular election Pre- cinct No. 2 as now established in said City of Newport Beach by the Board of Supervisors of the Coun- ty of Orange for holding state and county elections. Polling Place: City Hall, New- port Beach. Officers: Inspector, Harry G. Wheaton. Judge, Mrs. Maude J. Dixon. Clerk, Mrs, Arline Jasper. .Clerk, Mrs. Frankie B. Lindsay. Election Precinct No. 3 shall consist of the regular election Pre - eint No. 3 as now established in said City of Newport Beach by the Board of Supervisors of the County of Orange for holding state and county elections. Polling Place: Legion Rut, 10th Street and Bay Front. Officers: Inspector, Milton L. Oastleman. Judge, Israel Weiner. Clerk, Mrs. Mollie Fenelon. Clerk, Alias Lillian Lindenberger. That in all par- ticulars not recited in this ordin- ance said special election shall be held as provided by law for the holding of municipal elections in the City of Newport Beach. SECTION 7. That the City Council of said city shall meet and canvass the returns of said elec- tion at the regular meeting place of said Council to be held in the Council Chamber of the City Hall of said city on Monday, the 24th day of August, 1936, at the hour of 7:30 o'clock P. M. SECTION 3. That the City Clerk shall certify to the passage- and adoption of this ordinance by a vote of more than two- thirds of all the members of the City Conn. C11 of the City of Newport Beach, and to its approval by the Mayor, and shall cause t',Is ordinance to. be published once a week for two (2) successive weeks in the New- port News, a newspaper of gen- eral circulation printed and pub- . lished less than six (6) days a week in said city, and such publi- cation of this ordinance shall con- stitute the notice of said election and no other notice of said election than the publication aforesaid shall be necessary. SECTION 9. This ordinance shall take effect upon its passage and adoption. PASSED, ADOPTED AND AP- PROVED this 3rd day of August, 1936. HARRY H.
