ORDINANCE NO. 522
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1: Section 1 of Or-
dinance No. 372 of the ,City of
Newport Beach, being an ordi-
nance entitled: "An ordinance of
the City of Newport Beach, pro-
hibiting the business of drilling
for, developing, producing, stor-
ing and refining petroleum, oil,
gas and other hydro- carbon sub-
stances within the corporate lim-
its of the City of Newport Beach,
and prescribing regulations and
restrictions to be enforced with-
in said city relative to the busi-
nesses now established in said
City for the drilling for, develop-
ing, producing, storing and refin-
ing of petroleum, oil, gas and oth-
er hydro- carbon substances; pro-
viding for the abatement of nui-
sances and prescribing penalties
for all violations of this ordi-
nance;' is hereby amended to read
as follows:
"It is hereby declared unlawful
for any person, .firm, corpora-
tion, co- partnership or associa-
tion of persons, to erect or con-
struct oil drilling derricks or oil
drilling equipment within the
boundaries of the City of New-
port Beach, or to drill from the
surface or by subterranean drill-
ing, for oil, petroleum, tar, gas
or other hydro- carbon substances,
within the boundaries of the City
of Newport Beach, or to build or
establish refineries for the pur-
pose of refining petroleum, oil,
gas, tar or other hydro - carbon
substances within said city, ex-
cept that it shall be lawful under
the provisions hereof to drill for
oil, petroleum, tar, gas or other
hydro- carbon substances by slant
drilling or subterranean drilling
in and under the area hereinaft-
er described, provided that the
drilling sites shall be located out-
side of the city limits of the City
of Newport Beach, California,
and that such drilling shall be at a
vertical depth of at least 400 feet
below the ground surface within
the area mentioned and herein-
after described.
That the area in the City of
Newport Beach in which slant
drilling or subterranean drilling
shall be permitted, under the
terms hereof, is described as be-
ing all that area lying northwest-
erly of the southeasterly line of
53rd Street, and the northeaster-
ly and southwesterly prolongation
of said southeasterly line of 53rd
Street, as said 53rd Street is laid
out and shown upon a map of
Ocean Front Tract, recorded in
Book 4, page 12 of Miscellaneous
Maps, Records of Orange County,
California, and a map of River
Section, recorded In Book 4, page
25 of Miscellaneous Maps, Rec-
ords of said County."
SECTION 2. Any person vio-
lating any of the provisions of
this ordinance shall be deemed
guilty of a misdemeanor, and
upon conviction thereof shall be
punished by a fine not to exceed
$250.00, or by imprisonment in
the City Jail of the City of New-
port Beach or the County Jail of
Orange County, for a period not
exceeding thirty days, or by both
such fine and imprisonment. In
addition to the foregoing penal-
ties every nuisance existing in
violation of this ordinance shall
be at once abated.
SECTION 3. The above and
foregoing ordinance shall be pub-
lished once in NEWPORT -BAL-
BOA PRESS, a newspaper print-
ed, published and circulated in
the City of Newport Beach, and
shall take effect and be in force
thirty days from and after its
passage.
The above and foregoing ordi-
nance was introduced at an ad-
iourned regular meeting of the
Citv Council of the City of New-
port Beach held on the 11th day
of May, 1943, and was finally
passed and adopted on the 7th
day of June, 1943, by said City
Council at a regular meeting
thereof, by the following vote, to-
wit:
