ORDINANCE NO. 523
The City of Newport Beach,
by and through its City Council,
does ordain as follows:
SECTION 1: Section 5 of Ordi-
nance No. 440 of the City of New-
port Beach is hereby amended to
read as follows:
"Section 5. R -2 (Two Family)
Residence District Regulations
(a) Uses permitted
1. All uses permitted in the R-1
district (See Section 4)
2. Two- family dwellings.
3. Subterranean drilling, slant
drilling or whipstocking for oil,
gas, tar, petroleum or other hydro
Carbon substances in and under
that certain area in the City of
Newport Beach described as fol-
lows:
That certain area lying
Northwesterly of the South-
easterly line of 53rd Street
in said city, and the North-
easterly and the Southwest-
erly prolongation of said
Southeasterly line of 53rd
Street, as said 53rd 'Street
is laid out and shown upon
a map of Ocean Front Tract,
recorded in Book 4, page 12
of Miscellaneous Maps, Rec-
ords of Orange County, Cali-
fornia, and a map of River
Section. recorded in Book 4,
page 25 of Miscellaneous
Maps, reecords of said Coun-
ty,
shall be permitted, provided ths4
the actual drilling surface sites
. ^ad the derricks and oil drilling
equipment shall be located out-
side of the corpor,te limits of
the City of Newport Beach, and
that all such whipstocking, slant
drilling or subterranean drilling
shall be at a vertic -•] d -pth of at
least 400 feet below the ground
surface within the area mention-
ed and described herein.
(b) BUILDING - HEIGHT LIM-
IT
Two (2) stories and not to ex-
ceed thirty -five (35) feet. except
as provided in Section 10.
(c) Building -site Area Requir-
ed
Except in the case of existing
recorded lots having a smaller
area as provided in Sectio ^s 10
P,nd 11, the minimum b-iildin ^-
site area shall be fml+ thousand
(4000) square feet, b ,,t in no case
shall a one or two - family dwell-
ing be permitted which pr-v�des
less than one thousand (1000)
square feet of land area Per fam-
ily or house - keeping unit.
(d) Front Yard Required
Except as provided in Section
10, no building shall be erected
closer than ten (10) feet to the
front property line of the build-
ing site.
(e) Side Yard Required
Except as provided in Sections
10 and 11, each side yard shall
have a minimum width of three
(3) feet.
(f) Rear Yard Required
Except as provided in Section
10. no building shall be erected
closer than ten (10) feet to the
rear property line of the build-
ing site.
(g) Distance Between Dwell-
ings on same lot
No dwelling or other main
building shall be closer than fif-
teen (15) feet to any other dwell-
ing or main building on the same
building site, and no detached ac-
erssory building shall be closer
Vian five (5) feet to any main
building except as provided in
Section 10.
SECTION 2: Any person vio-
lating any of the provisions of
this ordinance shall be deemed
guilty of a misdemeanor, and
upon conviction thereof shall be
punished by a fine not to exceed
$250.00, or by imprisonment in
the City Jail of the City of New -
port Beach or the County Jail of
the County of Orange, for a per -
iod not exceeding thirty days, or
by both such fine and imprison-
ment. In addition to the forego-
ing penalties. every nuisance ex-
:stin, in violation of this ordi-
nance shall be at once abated.
SECTION 3: The above and
foregoing ordinance shall be pub -
lish ^d once in NEWPORT -BAL-
BOA PRESS, a• newspaper print -
ed published and c'rculated in
the City of Newport Beach, and
q111 take effect and be in force
thirty days from and after its
passage.
The above and foregoing ordi-
nrnce was introduced at an ad-
4ourned regular meeting of the
Citv Council of the City of New-
port Beach held on the 11th day
of May, 1943, and was finally
passed and adopted on the 7th
day of June, 1943, by said City
Council at a regular meeting
thereof, by the following vote, to-
wit:
