The City of Newport Beach, by
and through its City Council, does
ordain as follows:
SECTION 1: Every person who
attempts, by means of any threat
or violence, to deter or prevent
any police officer in the City of
Newport Beach from performing
any duty imposed upon such of-
ficer by law, or who knowingly re-
sists by the use of force or vio-
lence, such officer, in the perform-
ance of his duty, is punishable by
a fine not exceeding Three Hun-
dred Dollars ($300.00) and impris-
onment in the City Jail not ex-
ceeding three (3) months, or by
both such fine and imprisonment.
SECTION 2: This ordinance is
hereby declared to be an urgency
measure necessary for the imme-
diate preservation of the public
peace, health and safety, and the
following is a declaration of, and
the facts constituting its urgency:
That the City of Newport Beach is
a city where many young men and
women go for fun, amusement and
pleasure; that particularly during
Easter week many boys and girls
of school age spend their vacation
or a portion of their vacation at
said beach; that often crowds of
Young men and women congregate
together and cause disturbances of
various descriptions, which condi-
tion constitutes a police problem
in the City of Newport Beach;
that officers of the law are often
deterred or prevented from per-
forming their official duties by
reason of the fact that the pen-
alty provided by the state law for
resisting an official is very severe
and many cases do not merit such
severe punishment; that the lo-
cal police court has no jurisdic-
tion at this time over offenses
such as are described herein; that
by reason of the facts herein re-
cited, public peace, health and
safety are involved, and in order
to properly safeguard persons and
property it is necessary that this
ordinance be passed immediately
so as to go into effect before Eas-
ter week of 1944.
SECTION 3: The City Clerk of
the City of Newport Beach shall
certify to the separate vote on the
urgency of this ordinance and its
passage by the vote of five (5)
members of the City Council of
the City of Newport Beach and
cause the same to be published
once in the Newport - Balboa News -
Times, a newspaper printed and
published in the City of Newport
Beach, and upon the passage of
this ordinance the same shall be-
come immediately operative and
take full effect.
I HEREBY CERTIFY that the
above and foregoing ordinance
was introduced at a regular meet-
ing of the City Council of the City
of Newport Beach, held on the 6th
day of March, 1944, and was fi-
nally passed and adopted on the
3rd day of April, 1944, by said City
Council at a regular meeting
thereof, and that the question of
the urgency of the foregoing ordi-
nance was passed and the forego-
ing ordinance was adopted by a
vote of five (5) members of the
City Council of the City of New-
port Beach at'said regular meet-
ing by the following vote, to -wit:

Allen, Kirk, Isbell,
Reed, Hall.
NOES, COUNCILMEN: None,
ABSENT, COUNCILMEN: None.
