The City Council of the City of
- Newport, Beach, pursuant to the
provisions of the "Street Vaca-
tion Act of 1941," approved May
13, 1941, Statutes 1941, Chapter
250 and amendments thereto, be-
ing Division 9, Part 3, Streets and
Highways Code, does hereby or-
�dain, resolve, and declare as fol-
lows:
Section 1.. That, the public in-
terest and convenience require the
closing up and abandonment of a
portion of Ocean Front, and of
certain alleys, all in the City of
Newport Beach, and it is the in-
tention of the City Council of the
City of Newport Beach to order
the following- described portion of
a certain street in said city, and
,of certain alleys in said city, to be
vacated, closed up, and abandoned,
`to -wit:
'STREET TO BE VACATED
A parcel of land 15'feet in
'Width, being a portion of
Ocean Front, as shown upon
a map of Seashore Colonv
Tract, recorded in Miscel-
laneous Maps, Book 7, page
_25, Records, of Orange Coun-
ty, California, and more par-
ticularly described as 'follows,
to -wit:
Beginning at the most
southerly corner of Lot 1,
-Block L of said Seashore Col-
ony Tract; thence, north-
westerly along the northeast-
erly line of said Ocean Front
to the most westerly corner
of Lot 2 of said Seashore Col-
ony Tract; thence, southwest-
erly along the southwesterly
prolongation of the northwest-
erly line of said Lot 2, said
point lying in a line parallel
with and distant 15.00 feet
mcasuied at right angles from
said northeasterly line of
Ocean Front; thence, south-
easterly along said parallel
line to its intersection with
the southwesterly prolonga-
tion of the southwesterly line

easterly along said line of pro-

All of that alley 14 feet in
width in Block H, as shown
upon a map of Tract No. 323,
recorded, in Miscellaneous
Maps, Book 14, pages 40 and
41, and Block 436, as shown
upon a map of Corona del
Mar, Records of Orange Coun-
ty, California, and more par -
ticularly described as follows,
to -wit:
:Beginning at the most west-
. erly corner of Lot 1, Block

thence, southwesterly in a di-
rect line to the most north-
erly corner of Lot 10 of said
Block 436;. thence, southeast-
erly along., the northeasterly
line of said Lot 10 to the

of prolongation to the point of
beginning.

All of that alley in Block A,
10 feet in width, as shown
upon a map of Tract No. 673,
recorded in Miscellaneous
Maps, Book 20, pages 17 and
18, Records of Orange County,
California, and more particu-
tarly.described as follows, to-
wit:
Beginning at the most
westerly corner of Lot 1 of
said Block A; thence, south-
westerly along the southwest-
erly: prolongation of 'the morth-
westerly line of said Lot 1 to
the most northerly corner of
Lot 3 of said Block A; thence,
soutlheA'sterly along the north-
easterly =line of said Lot 31
Ito the most easterly corner of
said3,ot 3; thence, northeast-
erly 'along the northeasterly
prolongation of the southeast-
erly line of said Lot 3, to the
most southerly corner of Lot
2 of said Block A; thence,

westerly line of Lot 1 and Lot

point of beginning.
Subject to exceptions and
reservations hereinafter speci-
fied.
All portions of said street and
alleys to be vacated, closed up
:and abandoned, are more clearly
shown on certain maps approved
and adopted by the City Council
of the City of Newport Beach for
said vacation, closing up and aban-
donment, by Resolution dated
April 22, 1946, and designated
"Resolution No. 3321," and by res-
olution dated April 22, 1946, and
designated "Resolution No. 3322,"
and by resolution dated April 22,
1946, and designated "Resolution
No. 3323." Reference is hereby
made for further particulars as
to the proposed vacation, closing
up, and abandonment of said
street and said alleys, to said
maps, and said maps and each of
them are made a part of this
Ordinance to the same extent and
purpose as if the same were here.

Section 2. That the proceed.

shall be had and taken, and the
City Council of the City of New
port Beach, elects to proceed un-
der the provisions of the "Street
Vacation Act of 1941," approved
May 13, 1941, Statutes 1941, Chap-
ter 250 and amendments thereto,
being Division 9, Part 3, Streets
and Highways Code.
Section 3. The Street Superin-
tendent of the City of Newport
Beach shall cause to be conspicu-
ously posted along the line of the
street and the alleys proposed'to..
be vacated, not less than 500 feet

all, notices of the!vac4ttion of said
street and said alleys. Said notices
shall state the passhge of this
Ordinance of Intension and the
time and place of the hearing of 1
all persons interested in or object
ing to the proposed vacation of,
said street and said alleys, all as,
,required by law.
Section 4. Notice is hereby giv-
en that the City Council -of the,
City of Newport Beach does here-

Beach, as the time and place for

time and place, will hear the evi-
dence offered by any person in-
terested in the vacation of said
street heretofore ` deseribed and
said alleys heretofore described. 7
Section 5. The City Council of
the City of Newport Beach fur-
ther finds and determines that the
Public convenience and necessity
require the reservation of ease-
ments and rights -of -way for the
following purposes, to -wit: To con-
struct, maintain, operate, replace,
remove, and renew sanitary sew-
ers, water mains, and storm
drains, and appurtenant structures
in,'upen, over and across the al-
ley proposed to be vacated herein,
and heretofore described as ally,
No. 2, and to maintain, operate,
replace, remove, renew, and en-
large lines of . pipe, conduits, f
cables, wires, poles, and other
convenient structures for the op-
eration of gas pipe lines, tele- •
graphic and telephone lines, and
for the transportation or distri-
bution of electrical energy, water,
and incidental purposes, including
access and the right to keep the 1
property free from inflammable
materials and wood growth, and
otherwise protect the same from
all hazards in, upon and over the
alley proposed to be vacated, and
heretofore described as alley No. 2. ,
Section 6. The City Council of
