ORDINANCE ADDING SEC-
TIONS 7114x, 7114b AND 7114c
AMENDING SECTIONS 7220
AND 7219 OF THE MUNICI-
PAL CODE AND CREATING
A CHARGE FOR USE OF
SEWERS AND PROVIDING
FOR THE TURNING OFF OF
WATER SERVICE IN DE-
FAULT OF PAYMENT
THEREOF.
SECTION 1: Section 7114a, Sec-
tion 7114b and Section 7114c are
hereby added to the Municipal
Code of the City of Newport
Beach as follows, to -wit:
"Section 7114a: A monthly
charge of $0.40 shall be made
for the use of each sewer
connection, said charge to be
made against the occupant of
each dwelling house and of
each business structure."
"Section 7114b: Said charge
for said use of said sewer
connection shall be payable
and be billed, as provided for
in Sections 7218 and 7219 of
the Code, to water consumers
in like manner as charges for
the use of water. Said charge
for said sewer connection use
by occupants of dwelling
houses or business structures
who are not consumers of
water, subject to charge by
the City of Newport Beach,
shall be billed bi- monthly."
"Section 7114c: Nothing
herein contained shall be con-
strued to impose a sewer use
charge where, in fact, sewer
connection facilities are not
actually in use; and satisfac-
tory proof of such non -use
shall exonerate the charge
imposed by the preceding
Sections 7114a and 7114b."
SECTION 2: Sections 7219 and
7220 of the Municipal Code are
hereby amended to read as fol-
lows, to -wit:
"Section 7219: Unpaid
Charges. The superintendent
of the municipal water system
shall, on or before the first
day of the month next suc-
ceeding the bi- monthly billing
period, mail to each con-
sumer whose premises are
connected with the municipal
water system, a true and ac-
curate statement of the un-
paid charges due the City of
Newport Beach for water fur-
nished to such premises and
for the charges for the use
of the sewer connection as
provided for in Section 7114a.
of this Code, setting forth that
unless said charges are paid
on or before the 10th day of
said month, the same shall
thereupon become delinquent
and that unless such delinqu-
ency charges are paid prior to
the 25th day of said month,
the water will be turned off
from said premises without
further notice and will not be
turned on again until said
charge, together with a turn -
on charges, as specified in
Section 7217, have been paid."
"Section 7220: Turn - off
Date. At the close of busi-
ness on the 25th day of each
month, the person in charge
of the books of the municipal
water system, shall furnish to
the superintendent of the
water system a list setting
forth the premises, the name
of the owner and tenant upon
which the charges, referred to
in Section 7219, remain un-
paid, together with t he
amount thereof and it is here-
by made the imperative duty
of said superintendent on the
next business day to turn the
water off from said premises
and not to turn the same on
again until all of said charges
and the turn -on charge, as
specified in Section 7217, shall
have been paid."
SECTION 3. This ordinance
shall be published at least once
in the Newport - Balboa Press, a
newspaper of general circulation
printed and published in the City
of Newport Beach and shall be in
force and effect thirty (30) days
after the final passage thereof.
The above and foregoing ordi-
nance was introduced at a regu-
lar meeting of the City Council of
the City of Newport Beach held
on the 13th day of June, 1949,
and was finally passed and adopt-
ed on the 27th day of June, 1949,
by the following vote, to -wit:
AYES, Councilmen: Greeley,
Robertson, Isbell, Drake.
NOES, Councilmen: None.
ABSENT, Councilmen: Blue.
