WHEREAS, the waters Newport Harbor adjacent to shoreline are used by many swi mers, and; WHEREAS, the said waters Newport Harbor are also used I many vessels, both power a sail, and; WHEREAS. experience h shown that swirnmers,have ben endangered by the •close"proxin ity of such vessels in the pas NOW THEREFORE, the Cit Council of the City of Newpor Beach does ordain as follows: SECTION 1: Sections 10157 an 10158 are hereby added to th Municipal CCde of the City o Newport Beach as follows, to wit "Section 10157. Protect. c Swimming Areas. As used in thi, section the term 'Protected swim ming area' shall refer to the fo] ]ow-rng designated areas in Newport Harbor, and to any other such area hereinafter estab lished by the City Council. Such areas are legally described as follows: A. Swimming Area. No. 1. Be- ginning at tha point of inter- section of the Southerly prolongation of the easterly line of Marine Avenue, as said Marine Avenile is shown on a man of Section 4, Bal- boa Island, recorded in Mis- cellaneous Maps, Book 7, Page 37, Records of Orange County, with the U. S. Bulk - head Line b ^tween U. S. Stations 255 and 256: thence .southerly along said south- erly prolongation of the east- erly line of Marine Avenue, a distance of 96 feet, to the U. S. Pierhead Line: thence westerly along said U. S. Pierhead Line to an inter- section with the southerly prolongation of the westerly line of Lot 4, Block 1, of said Section 4 of Balboa Island: thence northerly along said southerly prolongation, 96 feet to an intersection with said U. No vessel shall be navigated within the bounds of any protected swimming area in Newport Harbor, as each such area is established by the City Council of the City of Newport Beeo:n." SECTION 2: This ordinance shall be published at least once n the Wewpert Balboa Press, a r.owspaper of general circulation, printed and published in the City Of Newport Saach and shall take effect immediately upon the final psssage thereof. The above and foregoing ordi- nance was introduced at a reg- ular mooting of the City Council held on tire 13th day of March, 5950 and was finally passed and adopted on the 27th day of March. 1950, by the following vote, to wit: AYES, COUNCILMEN Greeley, Robertson, Isbell, Blue Drake NOES, COUNCILMEN None ABSENT, COUNCILMEN?
