AN ORDINANCE AMENDING
SECTION 4107 OF THE MUNI-
CIPAL CODE, AND ADDING
SECTION 4107.1 THERETO,v
RESTRICTING CERTAIN
AREAS FROM DOGS.
The City Council of the City of
Newport Beach does ordaid as fol-
lows:
SECTION 1: "Section 4107 of
the Municipal Code of the City of
Newport Beach is hereby amended
to read as follows:"
"Section 4107 — DOGS. RE=
STRICTED AREAS. No person
having the care, charge or control
of any dog shall permit or allow.
said'dog to be at large upon any
peach (except the beach surround-
ing Balboa Island), street, alley,
park or public place in said City,
unless dog is securely held by a
leash or chain not exceeding six
feet in length, and any such dog
so at large may be ordered muz-
zled by the Chief of Police, or
any public officer, or ordered rem
moved from such beach, street,.
alley, park or other public place."
SECTION 2: There is hereby
added to the Municipal Code of the
City of Newport Beach, Section
4107.1 to read as follows:
"Section 4107.1. DOGS, FUR -
TIAER RESTRICTED AREA. No
person having the care, charge or
control of any dog shall permit or
allow said dog to be, under any
circumstances or conditions, on or
upon the beach surrounding Bal-
boa Island."
SECTION 3: This Ordinance
Is hereby declared to be an emer-
gency Ordinance necessary for the
immediate preservation of the
public peace, health and safety,
and shall take effect immediately,
The following is a statement of the
facts showing its urgency.
With the advent of the summer'
season, and the greater use of the
beaches surrounding Balboa Is+
land by swimmers and sun bath-
ers, and the consequent annoy-
ance, inconvenience :and threat.:to
the peace, health and safety of
said swimmers and sun Bathers,
it is deemed necessary and expe?
®Sent that this 'Ordinance pass
and take effect immediately in or=
der to protect the peace, health
and safety of said persons.
SECTION 4: This,-Ordinance
shall be published at least once in
the Newport Harbor Ensign, 'a
newspaper of general circulation,
printed and published in the City
of Newport Beach, and shall be in
force and effect immediately upon
the final passage thereof.
The above and foregoing Ordi-
nance was introduced at a regular
meeting of the City Council of the
City of Newport Beach held on the
14th day of July, 1952, and was
finally passed and adopted on the
28th day of July, 1952, by the fal,
lowing vote, to -wit:
AYES, Councilmen: Miller, Hde,
NOES, Councilmen: Finch
ABSENT Councilmen: None
