ORDINANCE NO. 798
The City Council of the City
of Newport Beach does ordain
as follows:
SECTION 1: Section 4209 en-
titled `Public Address Systems"
be, and the same is, hereby
amended to read as follows:
"Section 4209. Public Address
Systems. No person shall use or
permit to be used, any public
address systems or similar me-
chanical contrivances or appar-
atus, for the purpose of broad-
casting noises or music, or other
sounds, in or on the public
streets, or in or on public or
semi-public places in the City,
unless such public address sys-
tems or similar mechanical con-
trivances or apparatus as hereto-
fore mentioned, and the sounds
emitted therefrom, shall be con-
fined within enclosed rooms or
buildings, provided that this sec-
tion shall not prevent the Parks,
Beaches and Recreation Depart-
ment from using a public ad-
dress system in conjunction with
planned programs and activities
for the benefit of the citizens of
Newport Beach.
"EXCEPTION: Upon applica.
tion to the City Council, the City
Council may within Its discretion
grant an exception to the afore-
said prohibition, provided that
the public address system or
similar mechanical contrivances
or apparatus as heretofore men-
tioned is confined to a fixed
established place of business
within the City of Newport
Beach, or the application is made
by a non - profit charitable organ -
Ization, in which event the deter-
mination of whether the appli-
cant Is a non - profit charitable
organization shall be left solely
in the judgment of the City
Council. Such exception, If
granted by the City Council,
shall be for a fixed period of
time."
SECTION 2: This ordinance
shall be published at least once
In the Newport Harbor Ensign, a
newspaper of general circulation,
printed and published In the
City of Newport Beach and shall
take effect 30 days after Its final
passage.
The foregoing ordinance was
Introduced at a regular meeting
of the City Council of the City of
Newport Beach held on the 27th
day of August, 1956, and was
finally passed and adopted on
the 11th day of September, 1956,
by the following vote, to -wit:
AYES, COUNCILMEN: Hart,
MacKay, Wilder, Stoddard, Hig-
ble, Hill.
NOES COUNCILMEN: None.
ABSENT COUNCILMEN: Rid -
derhof.
