AMENDING SECTIONS 6103,
6104.4, 6110.3, 6200, 6202.4 and U
6202.7 OF ARTICLE VI OF Is
THE NEWPORT BEACH
MUNICIPAL CODE RELAT-
ING TO BUSINESS LI-
CENSES.
The City Council of the City
of Newport Beach does ordain
as follows:
SECTION 1: Section 6103 of
the Newport Beach Municipal
Code is amended to read:
I "Section 6103. Branch Es-
tabilsbment and Separate
Businesses. Except as other-
' wise s i'cally provided in
-� this Article, a separate li-
cense must be obtained for I
each business and for each
branch establishment or lo-
cation of a business. A I
separate license must be ob-
tained for each separate j
business not ordinarily an 1
accepted part of a licensed i
business although. carried I
on at the same location as
such licensed business. Each
license shall authorize the It-
ce'hsee to transact only the
business licensed thereby at
the location and in the man-
ner designated in such li-
cense."
SECTION 2: Section 6104.4 of
the Newport Beach Municipal i
Code is amended to read:
"Section 6104.4 Void Li-
cense. The City shall not be
bound by the mistake of any
officer or employee of the
City in issuing a license con-
trary to the terms of this
Article, or to the terms of
any zoning or other ordin-
ances of the City. Such li-
cense shall be null and void."
SECTION 3: Section 6110.3 of
the Newport Beach Municipal _
Code is amended to read:
"Section 6110.3. Certain
Businesses Requiring Coun-
cil Approval. No license shall
be issued for any of the fol-
lowing businesses:
Airplane, passenger or
freight
Alcoholic beverage, on sale
Ambulance service
Auction
Automobile for hire
Billiard room
Boats: fishing barge, igh
st-
seeing, U- Drive, live bait
and watercraft for hire
Carnival or circus
Dance hall
Fortune telling and: related
incxtices
Gar" of 'skill or amusement
House to house soliciting
Junk dealer or yard
Launching. ramp
Merry -go -round or similar
device -
Outdoor. muateal or special
events , ."
Pawnbroker
Skatng Rink
Yacht or boat landing. slip
rental
or for any other business
which is similar thereto, or
which in the opinion of the
City Council has an equal
or greater effect upon the
public health, safety or wel-
fare. except by prior approv-
al of the City Coupcil.
Whenever any person desires
to operate any such busi-
ness he shall apply to the
City Council for approval.
In any case when the is-
suance of a license is sub-
ject to City Council approv-
al, the City Council may
grant approval in whole or
in part and may impose
reasonable conditions deem-
ed necessary by the City
Council to assure that the
business will be conducted
in accordance with all state
and local laws and not to
the detriment of the public.
Where any business speci-
fied in this Section, in the
opinion of the City Council,
may become dangerous to,
or adversely affect the pub-
lic health, morals, safety,
or welfare, or became dan-
gerous to surrounding prop-
erty, the City Council shall
deny approval.
The City Manager shall
recommend to the City
Council that an individual
business establishment shall
be subject to Council ap-
proval when, in his judg-
ment, any such business es-
tablishment not specifically
included in Section 6110.3
+has an -effect. upon. the puh-
lic health, safety, or welfare
equal to or greater than
those businesses listed in
said section.
Any applicant for a license
to carry on spy business
specified hereinabove, or any
other business which is
j similar thereto, or which, in
the opinion of the City
Manager or the City Coun-
cil has an equal or greater
effect upon the public
health, safety, or welfare,
may be required to be fin -
erprinted by the Police
apartment of the City of
Newport Beach and may
also be asked to answer such
reasonable questions as may
be put to him concerning
his past history and mode of
carrying on business,
whether it be the Same or
a different business than the
one applied for. Such appli-
cation may also be referred
to any other department of
the City or any public
agency for investigation and
report. The employee or am-
ployees of the applicant,
where in the opinion of the
City Manager or City Coun-
cil the business is such to
affect the safety, health or
welfare of the public, may
also be required to be fin-
ger printed by the Police'
Department of the City of
Newport Beach and may
also be required to answer
such reasonable questions
as may be asked concerning
his past history of employ-
ment."
SECTION 4: Section 6200 of
the Newport Beach Municipal
Code is amended to read:
"Section 6200. Basic Li-

SECTION 5 Section 6202.4 of
the Newport Beach Municipal
Code is amended to real:
"6202.4 Machine, game or
device of skill or amuse-
ment not prohibited by this
Article and not otherwise
licensed as a machine, game
or device owned by the li-
censee of a penny arcade or
an amusement business or
concession in the 'Fun
Zone'; for each such game

ty for use by a patron in
excess of eight on such ma-
chine, game or device of

SECTION 6: Section 6202.7 of
the Newport Beach Municipal
Code is amended to read:
116202.7 Soliciting by tele-
phone, soliciting, selling,
peddling or distributing
goods, wares or merchan-
dise of any class or charac-
ter, house to house or on
the public streets. 100.00

SECTION 7: The license fees
required by the Newport Beach
Municipal Code as hereby
amended shall not be reduced or
prorated for fiscal year 1958 -59
as a result of this Ordinance be-
ing made effective after July
1, 1958. Each licensee not li-
censed before the effective date
shall pay the full annual li-
cense fee for the portion of said
fiscal year following the effec-
tive date of this Ordinance.
SECTION 8: This Ordinance
shall be published once in the
Newport Harbor News - Press, a
newspaper of general circula-
tion, printed and published in the
City of Newport Beach, and the
same shall be effective 30 days
after the date of its adoption.
This Ordinance was introduc-
ed at a regular meeting of the
City Council of the City of New-
of May, 1958. and was adopted
on the 9th day of June, 1958, by
the following vote, to wit:
