AN ORDINANCE OF THE
CITY OF NEWPORT BEACH
AMENDING SECTION 3124
OF THE NEWPORT BEACH
MUNICIPAL CODE RELAT-
ING TO THE FIRE PREVEN-
TION CODE.
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1: Section 3124 of the
Newport Beach Municipal Code
is amended to read:
"SECTION 3124. Amend.
ments Made in the Fire Pre-
vention Code. The Fire Pre-
vention Code is amended and
and changed in the follow-
ing respects:
(a) Section 15.201 is hereby
amended to read:
'Section 15.201. Restricted
Locations. The storage of
Class I, II and III flammable
l i q u i d s in above - ground
tanks outside of buildings
is prohibited within the lim;
its established by law* as
the limits of the district or
districts in which such stor-
age is to be prohibited.'
(b) Section 15.503, Paragraph
b, is amended to read:
'b. Automatic Dispensing
Devices. The installation
and use of coin - operated
dispensing devices for Class
I flammable liquids is pro.
hibited. The dispensing of
Class I flammable liquids
into the fuel tank of a ve-
hicle or into a container
shall at all times be under
the control of a competent
person. The use of any de-
vice which permits the dis-
pensing of Class I flamma-
ble liquids when the hand
of the operator of the dis-
charging nozzle is removed
from the nozzle control lev-
er is hereby forbidden ex-
cept when using an auto-
matic nozzle as provided in
Section 15.503 b (1).
(1) Automatic Hose Noz-
zle Valves with Latch -Open
Devices., In lieu of being
held open by hand, an ap-
proved automatic n o z z l e
may be used for dispensing
Class I flammable liquid
into the fuel tank of a ve-
hicle. Such a nozzle shall
have the latch -open device
as an integral part of the
assembly and shall shut off
the liquid reliably and pos-
itively when the gasoline
tank is filled, when it falls
from the filling neck of an
automobile tank, when it is
subject to rough usage such
as dropping or lack of prop-
er lubrication, or when an
automobile is driven away
while the nozzle is still in
the tank. A competent at-
tendant shall be not more
than ten (10) feet from the
vehicle being filled by such
an approved nozzle.'
(c) Section 26.01, Paragraph
b, is hereby amended to
read:
'b. Location Restricted. No
person s h a 11 kindle or
maintain any bonfire or
rubbish fire or authorize
any such fire to be kindled
or maintained on any pri-
vate land unless (1) the
location is not less than 25
feet from any structure and
adequate provision is made
to prevent fire from
spreading to within 25 feet
of any structure, or (2) the
fire is contained in an ap-
proved waste burner with
closed top, located safely
not less than five feet from
any structure."'
SECTION 2. This Ordinance
shall be published once in the
Newport Harbor Ensign, a news-
paper of general circulation,
printed and published in the City
of Newport Beach, and the same
shall be effective 30 days after
the date of its adoption.
This Ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach held on the 8th day of
December, 1958, and was adopted
on the 22nd day of December,
19582 by the following vote, to
wit:
AYES, COUNCILMEN: HART,
LORENZ, SOMERS, ATKINSON,
KINGSLEY, HIGBIE, STODDARD.
NOES, COUNCILMEN: NONE.
ABSENT COUNCILMEN: NONE.
