ORDINANCE NO. 871
AN ORDINANCE OF THE
CITY OF NEWPORT BEACH
AMENDING SECTIONS
6104.2 AND 6112 OF THE
NEWPORT BEACH MUNICI-
PAL CODE RELATING TO
LICENSES.
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1: Section 6104.2 of
the Newport Beach Municipal
Code is amended to read:
"SECTION 6104.2. Issuance
of License.
(a) Upon application be-
ing made as above provided
and when the applicant has
tendered the license fee re-
quired, the Director of Fi-
nance shall process the ap-
plication. If it is an applica-
tion for a license for a new
business or if he deems it
necessary, he shall submit
It to other departments as
necessary, including the
health officer if health and
sanitation may be affected,
to determine whether the
business and premises to be
occupied meet the require.
ments of state law and City
ordinances. If it is a license
requiring City Council ap-
proval, it shall be trans-
mitted to the City Council
only after it has been ap-
proved by such other depart-
ments.
(b) Upon receiving the
approval of departments to
which the application has
been referred and, where
necessary, the approval of
the City Council, the Director
of Finance shall prepare and
issue the license showing
upon the face of each license
the following: (1) the person
to whom the license is is-
sued; (2) owner of the busi-
f7ess; (3) the kind of busi-
ness thereby licensed; (4)
name and location of such
business; (5) the amount of
the license fee; and (6) the
date of expiration of such
\�4icense.
(c) When proper appli-
cation has been made for a
license requiring the ap.
proval of the City Council,
the fee tendered and the ap-
plication approved by all de-
partments to which it was
referred or approved by such
departments subject to con-
ditions, the City Manager
may approve the issuance
of a temporary license pend-
ing the submission of the
application to the City Coun-
cil, if he determines that the
operation of the business un-
der a temporary license will
not adversely affect the pub-
lic health, safety or welfare.
Such temporary license shall
expire immediately upon the
City Council's action upon
the application or automat.

has not acted.
(d) When proper appli-
cation has been made for a
license not requiring City
Council approval, the fee
tendered and the application
approved by all departments
to which it was referred sub-
ject to conditions, the City
Manager may approve the
issuance of a temporary li-
cense pending the appli-
cant's compliance with the
conditions imposed if he de-
termines that the operation
of the business under a tem-
porary license will not ad-
versely affect the public
health, safety or welfare.
Such temporary license shall
automatically expire at the
end of thirty (30) days if all
conditions subject to which
it was issued have not been
met.
(e) In addition to the
regular license fee, a fee of
Five Dollars ($5.00) shall be
charged for each temporary
license. In no event shall
this fee be refunded."
SECTION 2: Section 6112 of
the Newport Beach Municipal
Code is amended to read:
"SECTION 6112. Licenses
for Revenue Purposes. The

licenses required by this
chapter for persons to en-
gage in professions, voca.
tions or businesses which are
also licensed by the ,state of
California are for revenue
purposes only and the regu-
latory provisions of this
chapter, including the power
to deny, suspend or revoke
the licenses of such persons,
shall not apply."
SECTION 3: This Ordinance
shall be published once in the
Newport Harbor Ensign, a news.
paper of general circulation,
printed and published in the City
of Newport Beach, and the same
shall be effective 30 days after
the date of its adoption.
This Ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach, held on the 12th day of
January, 1959, and was adopted
on the 26th day of January, 1959,
by the following vote, to wit:
AYES, COUNCILMEN: HART,
LORENZ, SOMERS, KINGSLEY,
ATKINSON, HIGBIE, STODDARD.
NOES, COUNCILMEN: NONE.
ABSENT, COUNCILMEN: NONE.
