ORDINANCE NO. 923
AN ORDINANCE OF THE CITY
OF NEWPORT BEACH ADD-
ING SECTIONS 8150 AND 8151
TO THE NEWPORT BEACH
MUNICIPAL CODE RELATING
TO SWIMMING POOLS
The City Council of the City of
Newport Beach does ordain as
follows:
SECTION 1. Section 8150 is
added to the Newport Beach Mu.
nicipal Code to read:
"SECTION 8150. S W I M -
MING POOLS. FENCES. No
person shall construct, use,
permit, maintain, operate or
control any swimming pool,
fish pond, or other body of
water eighteen (18) or more
inches in depth on any land
owned by him or under his
possession or control without
erecting and maintaining a
fence to make such body of
water inaccessible to small
children. Such fence, includ.
ing all gates, must be not
less than five (5) feet above
the underlying ground. All
gates must be self - closing
and self - latching, with the
latches not less than five (5)
feet above the underlying
ground or constructed in a
way so they cannot be open-
ed from the outside by chil-
dren. No such fencing shall
be required on land used for
any hotel, motel, apartment
house, club or trailer park
consisting of ten (10) or
more units Where the owner
of such use or an employee
thereof is on duty on such
land twenty -four (24) hours
each day. This does not re-
quire fencing any body of
water which forms a part of
Newport Bay.
The Director of Building
and Safety may permit other
protective devices or struc-
tures to be used so long as
the degree of protection af.

�, SECTION 2. Section 8151 is
added to the Newport Beach Mu-
nicipal Code to read:
.'SECTION 8151. S W I M -
-=NG POOLS. PUMP, FIL-
TER, HEATER. (a) No person
shall construct, use, permit,

maintain, operate, or control
any pump, filter, or heater
to serve any swimming pool,
fish pond, or other body of
water eighteen (18) or
more inches in depth on any
land owned by him or under
his possession or control un-
less any such pump or filter
be installed in tight housing
of one - hour fire - resistant
construction with solid core
wood lid or door not less
than one and three - quarters
(13/4) inches thick, and un-
less such pump, filter, the
housing therefor, and any
heater serving such body of
water, be set upon and an-
chored to monolithic concrete
foundation not less than six
(6) inches thick.
(b) Such pump, filter, the
housing therefor, and any
such heater may be installed
in a garage or any accessory
building and may be so in-
stalled without providing
said housing when the walls
and ceiling of such garage
or accessory building are of
one-hour fire - resistant con-
struction; provided, however,
that any such installation
shall be adequately guarded
against mechanical injury
and shall be so located as
not to impair any required
parking area in a garage,
and any such heater shall be
adequately guarded against
contact with combustible
materials."
SECTION & This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach held on the 13th day of
June, 1960, and was adopted on
the 11th day of July, 1960, by the
following vote, to wit:
AYES, COUNCILMEN: Hart,
Lorenz, Somers, Kingsley,
Atkinson, Cook.
NOES, COUNCILMEN: None.
ABSENT COUNCILMEN:
Stoddard.
