ORDINANCE NO. 955
AN ORDINANCE OF THE CITY
OF NEWPORT BEACH
ADDING CHAPTER 8 TO AR-
TICLE IX OF THE NEWPORT
BEACH MUNICIPAL CODE RE-
LATING TO PLANNED RESI-
DENTIAL DEVELOPMENTS
The City Council of the City of
Newport Beach does ordain as
follows:
SECTION 1. Chapter 8 is add-
ed to Article IX of the Newport
Beach Municipal Code to read:
"CHAPTER 8. PLANNED RESI-
DENTIAL DEVELOPMENTS
SECTION 9108.1. Planned Res-
idential Development.
A planned residential devel-
opment is a development
planned and designed as a unit
to produce an environment of
stable, desirable character not
out of harmony with its
surrounding neighborhood and
which meets standards of densi-
ty, open space, light and air, pe-
destrian and vehicular access,
and traffic circulation similar to
the regulations of this Article for
the 'R' District or Districts in
which such development is to be
located.
SECTION 9108.2. Use Permit
Required.
(a) Planned residential devel-
opments may be permitted in
any 'R' District when a Use Per•
mit is first secured for each such
development. Such Use Permit
shall be subject to the regula.
tions and requirements of this
chapter and notwithstanding the
provisions of Chapter 6 shall be
processed in accordance with the
terms of this section.
(b) Any application for a Use
Permit under the provisions of
this chapter shall be accompa-
nied by a fee of Five Hundred
Dollars ($500) if the land area
of the proposed development is
five (5) acres or less plus One
Hundred Dollars ($100) for each
acre or portion of an acre in
e9cess of five (5) acres.
(c) Such application shall be
processed by the Planning Com-
mission and transmitted to the
City Council with a recommenda•
tion for its approval or disap-
proval and any conditions the
Planning Commission feels
should be imposed. The City
Council may approve, disapprove
or refer the same back to the
Planning Commission for further
processing. Any such permit is
subject to the final approval of
the City Council.
SECTION 9108.3. Land Area
Required.

SECTION 91095. Perimeter of
Public Streets; Partial Waiver.
(a) A planned residential de•
velopment shall be bounded on
all sides by public streets.
(b) A partial waiver of this

when it is found and determined
that such partial waiver will not
be inconsistent with adequate
standards of pedestrian and ve-
hicular access and traffic circu-
lation for the development and
for the area in which the de-
velopment is located.
SECTION 9108.6. Conformance
to Master Plan.
All planned residential devel-
opments shall conform to the
Master Plan of the City of
Newport Beach, and no such de-
velopment shall be approved
unless such development does

SECTION 9108.7. M a x i m u m

SECTION 9108.13. Use Permit

(4) A general development
plan with at least the following
details shown to scale and di•
mensioned:
a. Location of each existing
and each proposed structure
in the development area, the
use or uses to be contained
therein, the number of stories,
gross building and floor areas,
approximate location of
entrances and loading points
thereof.
b. All streets, curb cuts,
driving lanes, parking areas,
loading areas, public transpor-
tation points, and illumination
facilities for the same.
C. All pedestrian walks,
malls and open areas for the
use of occupants and mem.
bers of the public.
d. Location and height of
all walls, fences, and screen
planting, including a detailed
plan for the landscaping of the
development and the method
by which such landscaping is
to be accomplished.
e. Types of surfacing, such
as paving, turfing or gravel to
be used at the various loca-
tions.
f. A grading plan of the
area.
(5) Plans and elevations of
one or more structures to indi-
cate architectural type and con-
struction standards.
(6) A verified petition for a
change in zoning classification
in accordance with Section 9106.5,
if such a change in zoning clas-
sification is required to make
such development conform to the
Master Plan.
• (7) Such other information as
may be required by the City to
assist in the consideration of the
proposed development.
SECTION 9108.14. Reports
from Fire and Public Works De-
partments.
The application and accompa•
nying information, maps, and
plans shall be submitted to the
Fire Department and Public
Works Department and written
recommendations in connection
therewith shall be supplied by
those departments before final
action is taken on such develop-
ment.
SECTION 9108.15. Building
Permits.
The Department of Building
and Safety shall insure that a
planned residential development
is undertaken and completed in
conformance with the approved

SECTION 2. This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was introduced
at an adjourned regular meeting
of the City Council of the City of
Newport Beach held on the 20th
day of March, 1961, and was
adopted on the 10th day of April,
1961, by the following vote, to
wit:
