HomeMy WebLinkAbout961 - Business Licenses & Fees0 • t ORDINANCE NO. 961 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 6110.3, 6200, A N D 6202.7 A N D ADDING SECTIONS 6200.1, 6200.2 AND 6200.3 TO THE NEWPORT BEACH MUNICI- PAL CODE RELATING TO BUSINESS LICENSES AND FEES THEREFOR SECTION 1. Section 6110.3 of the Newport Beach Municipal Code is amended to read: "SECTION 6110.3. Certain Bus - nesses Requiring Council Ap- proval. No license shall be issued for any of the following businesses: Airplane, passenger or freight Ambulance service Auction Automobile for hire Billiard room Boats: fishing barge, sightsee- ing, U- Drive, live bait and watercraft for hire Carnival or circus Dance hall Fortune telling and related practices Game of skill or amusement House to house soliciting Junk dealer or yard Launching ramp Merry -go -round or similar de- vice Outdoor musical or special events Pawnbroker Skating rink Yacht or boat landing, slip rental (Slip rental is hereby defined to be the rental of space in the water to berth three or more boats at the same or different locations) or for any other business which is similar thereto, or which in the opinion of the City Council has an equal or greater effect upon the public health, safety or welfare, except by prior approval of„ the City Council. Whenever any person desires to operate any such business he shall ap- ply -to� the City Council for ap. proval. In any case when the issuance of a license is subject to City Council approval, the City Council may grant approval in whole or in part and may impose reasonable conditions deemed necessary by the City Council to assure that the busi- ness will be conducted in ac- cordance with all state and local laws and not to the detriment of the public. Where any busi. ness specified in this section, in the opinion of the City Council, may become dangerous to, or ad- versely affect the public health, morals, safety or welfare, or become dangerous to surround- ing property, the City Council shall deny approval. The City Manager shall rec- ommend to the City Council that an individual business estab. lishment shall be subject to Council approval when, in his judgment, any such business establishment not specifically included in this section has an effect upon the public health, safety, or welfare equal to or greater than those businesses listed herein. Any applicant for a license to carry on any business specified hereinabove, or any other busi- ness which is similar thereto, or which, in the opinion of the City Manager or the City Coun- cil has an equal or greater effect upon the public health, safety, or welfare, may be re- quired to be fingerprinted by the Police Department of the City of Newport Beach and may also be asked to answer such reasonable questions as may be put to him concerning his past history and mode of carrying on business, whether it be the same or a dif- ferent business than the one applied for. Such application may also be referred to any other department of the City or any public agency for investiga- tion and report. The employee or employees of the applicant, where in the opinion of the City ORDINANCE 961 —PAGE 1 L • Manager or City Council the business is such to affect the safety, health or welfare of the public, may also be required to be fingerprinted by the Police Department of the City of New- port Beach and may also be re- quired to answer such reasonable questions as may be asked con- cerning his past history of em- ployment." SECTION 2. Section 6200 of the Newport Beach Municipal Code is amended to read: "SECTION 6200. Basic License Fee. Every person carrying on any business named in the sec- tions following this section and preceding Section 6201 shall pay an annual license fee of $25.00." SECTION 3. Section 6200.1 is added to the Newport Beach Mu. nicipal Code to read: "SECTION 6200.1. Businesses with Annual License Fee of $25.00. Accountant Advertising, outdoor, excepting advertising of licensee's own goods on his own premises Airplane, passenger or freight (Council approval) Alcoholic beverage, on sale Ambulance service (Council approval) Architect Artist Art studio Attorney at law Auditor Automobile: for hire (Council approval); accessories; dealers, new and used cars; automotive service station; wrecking Awning and tent supply Bail bond Bait and tackle shop Bakery Barber shop Bath house Beauty parlor Beverage, off -sale liquor, wherever located Bicycle, including rental Billiard or pool hall (Council approval) Blueprint service Boats: fishing barge, sightsee- ing, U- Drive, live bait and water- craft for hire (Council approval) 'Live bait boat' is a boat which sells live bait. Boats: charter Books and stationery Bowling alley Broker, insurance Broker, real estate Broker, stocks and bonds Broker, yacht Broker, any other separate broker business Building and loan associations Cabinet shop Camera and photographic sup. plies Canning or preserving plant Catering Chemist Chiropodist Chiropractor Clothing Cold storage locker Collection agency or credit bu- reau Contractor: general engineer- ing; general building; insula. tion, boiler; hot water heating; steam fitting; cabinet and mill work; cement and concrete; electrical (general); elevator in- stallation; excavating; grading; trenching; paving, surfacing; flooring (wood); fire protection engineering; glazing; warm air heating; ventilating; air condi- tioning; house and building mov- ing; wrecking; structural pest control; ornamental metals; lath- ing; landscaping; masonry or chimney contracting; painting; decorating; paperhanging; plas- tering; plumbing; refrigeration; roofing; sewers, drains, pipe laying, sewage disposal; sheet metal; electric signs; steel, re- inforcing; steel, structural; tile (ceramic and mosaic); water well drilling; welding; swim- ming pool; classified specialist. A general contractor or sub- contractor engaging in or con- ducting other businesses other. wise subject to the payment of a separate business license fee as ORDINANCE 961 — PAGE 2 ,J provided in this Article, shall pay the same fee for each such business as otherwise provided in this Article." SECTION 4. Section 6200.2 is added to the Newport Beach Mu- nicipal Code to read: "SECTION 6200.2. Businesses with Annual License Fee of $25.00. Dairy Dance hall (Council approval) Dancing academy Dentist Delicatessen Designer or illustrator Drafting services Drugs, pharmacy Dry cleaning Engineering: civil, chemical, electrical, mechanical, mining, refrigeration, structural or sur- veyor Floor covering Florist Furniture, new or used Gardening and landscaping (except when person so engaged is paid an hourly wage and proper federal income tax, social security and unemployment in- surance deductions are being withheld.) Gift shop Grocery store or market Hardware and appliances Hotel, motel, rooming house, boarding house, auto court, trailer park, bungalow court, or inn Interior decorator Janitor or cleaning service Jobber Junk dealer or maintaining a junk yard (Council approval) 'Junk dealer' is any person, firm or corporation who collects, buys or sells, either at wholesale or retail for purposes of salvage, any rags. sacks, bottles, cans, papers, rubber, metal or other articles commonly known as junk. Laboratory, dental and medi. call Launching ramp (Council ap- proval) Laundry Machine or blacksmith shop Maintenance and repair, gen- eral (except when person so en- gaged is paid an hourly wage and proper federal income tax, social security, and unemploy- ment insurance deductions are being withheld.) Section 6200.3 is added to the Newport Beach Mu- nicipal Code to read: "SECTION 6200.3. Businesses with Annual License Fee of $25.00. Paint, oil, varnish Parking lot Pathologist Pawnbroker (Council approv- al) Petroleum products, whole- sale Photographer Physician, surgeon, doctor Physiotherapist Planing mill or lumber yard and building supplies Pottery and ceramics Printing: publishing, circulat- ing, distributing by carrier or otherwise a newspaper in the city; conducting a printing shop. Public stenographer Radio and television sale or repair Radiologist Rentals, residential (Three or more rental units at the same or different locations. A rental unit is defined to include all ORDINANCE 961 —PAGE 3 0 residential units except one which is the part or full time residence of the owner and no part thereof is offered or avail- able for rent at any time during the license year.) Section 6202.7 of the Newport Beach Municipal Code is amended to read: "6202.7 For each individual who solicits by telephone, solicits house to house or on the public streets, or sells, peddles or distributes goods, wares, merchandise or ser- vices of any kind, house to house or on the public streets . . 100.00 a c" SECTION 7. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption. This ordinance was introduced at a regular meeting of the City Council of the City of New- port Beach held on the 24th day of April, 1961, and was adopted on the 8th day of May, 1961, by the following vote, to wit: AYES, COUNCILMEN: Kingsley, Atkinson, Cook, Stoddard, Hart, Lorenz, Som- ers.
