AN ORDINANCE OF THE CI-
TY OF NEWPORT BEACH AD-
DING SECTIONS '9105.51,
9107.311, AND 9107.312 TO,
AND AMENDING SECTION
9107.32 OF, THE NEWPORT
BEACH MUNICIPAL CODE
RELATING TO STANDARDS
FOR OFF - STREET PARKING
LOTS AND DEFINITIONS
The City Council of the City
of Newport Beach does ordain
as follows:
SECTION 1, Section 9105.51
is added to the Newport Beach
Municipal Code to read:
"SECTION 9105.51. Re-
quirements for Off - Street
Parkin R•
(a) The requirements of this
section and any off -street
parking standards adopted by
the City Council shall apply
to the following:
(1) All off -street parking lots
and areas hereafter developed
which are requred by this Ar-
ticle.
(2) All parking lots which
are hereafter permitted sub-
ject to first securing a use
permit.
(3) All parking lots and par-
king areas which are hereaf-
ter required by the Planning
Commission as a condition of
granting a use permit.
Such off -street parking stan-
dards shall be adopted by re-
solution and shall show mini-
mum dimensions of parking
spaces and aisles, require-
ments for entrances and exits,
and requirements for markings
and other devices deemed ne-
cessary to protect patrons, the
traffic on adjoining streets
and alleys, and property ow-
ners in the vicinity.
(b) Where the boundaries of
parking lots or parking areas
adjoin property in an R-1 or
R-2 district, a wall shall be
constructed along such boun-
daries in such a manner as
will provide protection to the .
public and owners and occu-
pants of adjoining property
from noise, exhaust fumes,
automobile lights, and other
similar sources of disturbance.
Said wall shall be constructed
of solid masonry to a height
of three (3) feet from the front
of the property to a depth e-
qual to the required front yard
setback established for ad-
joining property in a residen-
tial district. The remaining
portion of the wall shall be
six (6) feet in height, the
lower four (4) feet of which
must be of solid masonry con-
struction.
(c) A plot plan of any pro-
posed parking lot or parking
area shall besubmitted to the
Building and Safety Director
for approval. The plot plan
shallshow the layout of park-
ing spaces, aisles, walls, and•
other requirements set forth
in this section and in the off -
street parking standards. If
the proposed parking lot or
parking area as shown on the
plot plan meet said require-
ments, the Director shall en-
dorse his written approval on
the plain and retain a copy
thereof. If the proposed plot
plan does not meet the re-
quirements of this section, the
Director shall return the plan
to the applicant, together
with a written statement set-
ting forth the deficiencies in
the plan, within ten (10) ca-
lendar days after the submis-
sion of the plan to the Direc-
tor. The puking lot or park-
ing area shall be developed
and maintained in accordance,
with the plot plan as approved.
(d) Where the size, shape,
location. or topography of the
proposed parking lot or park-
ing area make compliance
with the requirements of this
section impractical and will
result in hardship, the Plan-
ning Commission, upon ap-
plication; may waive such

requirements of this section
and the off - street parking
standards as are necessary to
permit development of the
parking lot or parking area so
long as the waiver does not
create an unsafe condition or
a condition which- is. detri-
mental to surrounding pro -

SECTION 2. Section 9107.311
is added to the Newport Beach
Municipal Code to read:
"SECTION 9107.311. 'PAR-
KING AREA'. An off - street
perking area containing fewer
than five (5) parking spaces. "
SECTION 3. Section 9107.312
is added to the Newport Beach
Municipal Code to read:
"SECTION 9107.312. 'PAR-
KING LOT'. An off - street
parking facility containing
five (5) or more parking spa-
ces. "
SECTION 4. Section 9107.32
of the Newport Beach Munici-
pal Code is amended to read:
"SECTION 9107.32. 'PAR-
KING SPACE'. An accessible
and usable off - street parking
space."
SECTION 5. This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its ad-
option.
This ordinance was introduced
at a regular meeting of the Ci-
ty Council of the City of New-
port Beach held on the 11th day
of March, 1963, and was ad-
opted on the 25th day of March,
1963, by the following vote,
to wit:
