ORDINANCE NO. r9 D
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ESTABLISHING INTERIM ZONING REGULATIONS
•\ WHEREAS, the City Council of the City of Newport Beach
has heretofore directed the City Planning Department to prepare a
comprehensive planning study of Corona Del Mar with the following
objectives:
(a) To evaluate existing zoning regulations of
the City as such regulations relate to Corona Del Mar;
(b) To analyze the physical characteristics and
composition of Corona Del Mar as related to the zoning
districts presently established;
(c) To analyze the present and prospective popu-
lation density in various sections of Corona Del Mar as
determined by the zoning regulations; and
WHEREAS, on September 17, 1964, the City Planning Commis-
sion adopted Resolution No, 668 wherein the Commission expressed
its deep concern about the future development of the hillside area
of Corona Del Mar in the general vicinity of the intersection of
Ocean Boulevard and Carnation Avenue, as shown on a drawing marked
Exhibit "A" and attached hereto; and
WHEREAS, the area in question is presently zoned R -3
(Restricted Multiple Family Residential); and
WHEREAS, the City Council has determined that the exist-
ing zoning regulations applicable to the area in question which
pertain to height of buildings, required side yards and density
of population permit the construction of high -rise apartment build-
ings of a type and size which would create the following undesirable
conditions:
(a) Excessive population density;
(b) Overburdening of the existing street pattern
and excessive traffic congestion; and
(c) Further pressures on already inadequate on-
street parking space; and
WHEREAS, the Planning Commission intends to conduct
studies and recommend appropriate changes in the zoning regula-
tions applicable to the area shown on Exhibit "A "; and
WHEREAS, the Planning Commission has recommended in
Resolution No, 668 that the City Council enact an interim zoning
ordinance that would prohibit any further construction within the
area shown on Exhibit "A" other than single family residences,
duplexes and triplexes pending completion of the planning studies
previously referred to and until the City Council has considered
the recommendations of the Planning Commission for changes in the
zoning regulations applicable to the area in question and has
taken such action thereon as it deems appropriate; and
WHEREAS, Section 65806 of the California Government
Code authorizes the adoption of an interim zoning ordinance as an
urgency measure if the planning commission or the department of
planning, in good faith, is conducting or intends to conduct
amendment or addition thereto;
NOW, THEREFORE, the City Council of the City of Newport
Beach does ordain as follows:
SECTION 1. Notwithstanding any ordinance of the City
or provision of the Newport Beach Municipal Code to the contrary,
until such time as the City Council has enacted amendments to the
zoning regulations for R -3 Districts or has rezoned the property
within the area shown on Exhibit "A" to a district other than R -3,
or until the expiration of one (1) year from the effective date
of this ordinance, whichever first occurs, no building permit
application shall be accepted for filing and no building permit
shall be issued, including any building permit applications now
pending, other than for single family dwellings, duplexes, and
triplexes within said area shown on Exhibit "A ",

any zoning
ordinance or
amendment or addition thereto;
NOW, THEREFORE, the City Council of the City of Newport
Beach does ordain as follows:
SECTION 1. Notwithstanding any ordinance of the City
or provision of the Newport Beach Municipal Code to the contrary,
until such time as the City Council has enacted amendments to the
zoning regulations for R -3 Districts or has rezoned the property
within the area shown on Exhibit "A" to a district other than R -3,
or until the expiration of one (1) year from the effective date
of this ordinance, whichever first occurs, no building permit
application shall be accepted for filing and no building permit
shall be issued, including any building permit applications now
pending, other than for single family dwellings, duplexes, and
triplexes within said area shown on Exhibit "A ",

SECTION 2. Emergency Ordinance Effective Immediately.
This ordinance is declared by the City Council to be necessary as
an emergency measure for preserving the public peace, health,
safety and welfare and shall take effect immediately upon its
adoption. The following is a statement of the facts showing its
urgency-
The property described in Section 1 hereof is located
in a steep hillside area which has been partially developed with
single family residential and low density apartment uses.
Under existing R -3 zoning regulations it is probable
that this property would be intensively developed with high -rise
apartment buildings. Serious doubts exist as to whether such
developments would be desirable or appropriate.
So that there may be opportunity to evaluate the exist-
ing zoning regulations applicable to the area and to determine
appropriate changes in said regulations, particularly with refer -
ence to population density, side yards, and height limits, and to
place such regulations in effect prior to any further development
of the area, it is imperative that this interim zoning control
ordinance become effective immediately.
SECTION 3. This ordinance shall be published once in
the official newspaper of the City.
This ordinance was introduced and adopted as an emer-
gency ordinance at a regular meeting of the City Council of the
City of Newport Beach held on the 28th day of September, 1964, by
the following vote, to wit.
