ORDINANCE NO. 1118
AN ORDINANCE OF THE CITY OF
NEWPORT BEACH ESTABLISHING
INTERIM ZONING REGULATIONS
FOR THE CONTROL OF HELICOP-
TERS AND HELIPORTS
WHEREAS, at the Present time the
City does not have any regulatory ordi-
nances Pertaining to helicopters and heli-
Parts; and
WHEREAS, the unregulated landing
and taking off of helicopters within the
City would endanger life and Property;
and
WHEREAS, the City Council at a meet-
ing held on January 11, 1965, directed
the Planning Commission and the City
Attorney to make an investigation of the
need for regulation of helicopters and
he!iPOrls and to recommend appropriate
IegisiatiOn for the establishment of such
re9'ulelions to the City Council; and
WHEREAS, Section M806 of the Cali-
fornia Government Code authorizes- the
adoption of an interim zoning ordinance
as an urgency measure if the Planning
commission is conducting or intends to
conduct studies within a reasonable time
for the Purpose of recommending to the
City Council the adoption of any zoning
ordinance or amendment or addition
thereto
NOW, THEREFORE, the City Council
of the City of Newport Beach does ordain
as follows:
SECTION 1. Definitions.
As used in this ordinance the following

(a) The term "helicopter" shall
mean any rotorcraft Which depends

stantially vertical axes.
(b) The term "heliport" shall mean
any area of land or water or a struc-
tural surface which is used or intend.

SECTION 2. Landing or Take -Off of
Helicopters and Construction or Use of
Heliports Prohibited.
No Person shall land or take off a
helicopter or construct or use a heliport
within the corporate limits Of the City
of Newport Beach until such time as
the City Council has enacted amendments
to Article IX of the Newport Beach Mu-
nicipal Cade, entitled Planning and Zon-
ing, Permitting such activities and uses,
and such other regulatory ordinances as
the City Council may deem necessary,
or until the expiration of one (D year
from the effective date of this ordinance,
Whichever event first occurs.
SECTION 9. Building Permits.
The Director Of Building and Safety
is instructed to refuse to accept any
building permit application far filing Or
to issue any building Permit for the con-
struction of any heliport until after the
City Council has enacted regulatory leg-
islation as described in Section 2 hereof
or until the expiration Of one (1) year
from the effective date Of this ordinance,
whichever event first occurs.
SLCTION 4. Exceptions.
This ordinance shall not be construed to
Prohibit the construction or use of any
heliport or the landing Or taking off Of
helicopters from any heliport located in
any Unclassified Zoning District of the
City if said heliport has been approved
by Use Permit Prior to the effective date
of this ordinance.
SECTION 5. Emergency Ordinance Ef-
fective Immediately.
This ordinance is declared by the City
Council to be necessary as an emergency
measure for Preserving the Public Peace,
health, safety and welfare and shall take
effect immediately upon its adoption.
The fallowing is a statement of the
facts constituting its 'Urgency:
In Vlew of the growing Use of helicop-
ters for transportation Purposes, there
is a definite need that the City estab-
lish comprehensive zoning, safety and
building regulations to control the land-
ing and taking off of helicopters and the
construction of heliports.
The unregulated landing and taking off
of helicopters and construction of bell-
Parts within the City would create an
unreasonable risk of inlury to life and
Property.
So that there may be opportunity to
study the Problem and to devise and
enact appropriate zoning, safety and
building regulations, it is imperative that
this ordinance become effective imme-
diately.
SECTION 6. Publication. This ordi-
nance shall be Published once in the of-
ficial newspaper of the City.
This ordinance was introduced and
adopted as an emergency ordinance at a
regular meeting of the City Council of
the City of Newport Beach held on the
25th day of January, 1965, by the follow-
ing vote, to wit:
