ORDINANCE NO. 1146
AN ORDINANCE OF THE
CITY OF NEWPORT BEACH
ADDING SECTION 4119 TO
THE NEWPORT BEACH
MUNICIPAL CODE RELAT-
ING TO NUISANCES COM-
MITTED BY ANIMALS
The City Council of the City
of Newport Beach does ordain
as follows:
SECTION 1. Section 4119 is
added to the Newport Beach
Municipal Code to read:
"SECTION 4119. Nuisances
Committed by Animals. It
shall be unlawful for the own-
er or person having charge,
custody or control of any dog
or other animal to permit,
either willfully or through
failure to exercise due care or
control, any such dog or
other animal to commit any
nuisance and to allow such
nuisance to thereafter remain
on any public sidewalk, pub-
lic beach or park or any other
public property or on any im-
proved private property other
than that of the owner or per-
son who has custody or con-
trol of such dog or other ani-
mal; provided, however, that
the foregoing shall not apply
to street gutters. Every person
convicted of a violation of this
section shall be punishable
by a fine of not less than
$10.00normore than $100.00.11
SECTION 2. This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was intro-
duced at a regular meeting of
the City Council of the City of
Newport Beach held on the 22nd
day of November, 1965, and
was adopted on the 13th day
of December, 1965, by the fol-
lowing vote, to wit:
AYES, COUNCILMEN: Parsons,
Marshall, Elder, Gruber, Cook,
Forgit.
NOES, COUNCILMEN: None.
ABSENT COUNCILMEN: None.
ABSTAINING, COUNCILMEN:
Shelton.
