ORDINANCE N0, 1191
AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADDING
SECTIONS 10.28.040 AND 10.28.050 TO CHAPTER 10.28
OF THE NEWPORT BEACH MUNICIPAL CODE RELATING TO
NOISE ARISING FROM CONSTRUCTION ACTIVITIES
The City Council of the City of Newport Beach does ordain
as follows:
SECTION 1. Section 10.28..040 is added to Chapter 10.28
of'the Newport Beach Municipal Code to read:
"10.28.040 Noisy Construction and Excavation Work --
Hours ermtted. No person shall construct, demolish, alter
or repa r any wilding, grade or excavate on any private or
public property, or cause or permit such work to be done,
the performance of which work is attended by any loud or
unusual noise or sound which interferes with or may reason-
ably be presumed to interfere with the peace, comfort and
repose of persons residing in the neighborhood or general
vicinity in which such work is being performed, other than
between.the hours of 7 A.M. and 6:30 P.M. on any weekday,
between the hours of 8 A.M. and 6 P.M. on Saturdays, and
between the hours of 10 A.M. and 6 P.M. on Sundays and
holidays, except that in cases of urgent necessity or emer-
gency the Building and Safety Director may grant a revocable
permit.authorizing such work to be done at different hours."
SECTION 2. Section 10.28.050 is added to Chapter 10.28
of the Newport Beach Municipal Code to read:
"10.28.050 Exceptions. The provisions of Section
10.28.s aIT not�rued to prohibit such work at
different hours by or under the direction of any govern-
mental agency in cases of necessity or emergency.
SECTION 3. This ordinance shall be published once in
the official newspaper of the City, and the same shall be effec-
tive 30 days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 10th
day of October, 1966, and was adopted on the Z7th day of
December , 1966, by the following vote, to wit:
AYES, COUNCILMEN: Parsons, Rogers, Marshall,
Forgit, Shelton
NOES, COUNCILMEN:
None
