ORDINANCE NO. 1261
AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING
SECTION 12.44,110 OF THE NEWPORT BEACH MUNICIPAL
CODE RELATING TO OVERTIME PARKING IN PARKING METER
ZONES
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1. Section 12.44.110 of the Newport Beach
Municipal Code is amended to read:
"12.44.110 Overtime Parking. A. COMMERCIAL AREAS.
No person, except as otherwise provided in this chapter,
shall cause, permit, allow or suffer any vehicle registered
to or parked or operated by him to be or remain parked in
any parking space in a parking meter zone, designated by
resolution of the City Council as a commercial area, during
any time when the parking meter adjacent to such parking
space indicates that no portion remains of the period of
time for which a coin or coins have been deposited or
beyond the time parking in such place is otherwise permitted
or limited.
B. COMBINATION RECREATIONAL- - COMMERCIAL AREAS. No
person, except as otherwise provided in this chapter, shall
cause, permit, allow or suffer any vehicle registered to or
parked or operated by him to be or remain parked in any
parking space in a parking meter zone, designated by reso-
• lution of the City Council as a combination recreational-
commercial area, during any time when the parking meter
adjacent to such parking space indicates that no portion
remains of the period of time for which a coin or coins
have been deposited or beyond the time parking in such place
is otherwise permitted or limited.
C. RECREATIONAL AREAS. No person, except as otherwise
provided in this chapter, shall cause, permit, allow or
suffer any vehicle registered to or parked or operated by
him to be or remain parked in any parking space in a parking
meter zone, designated by resolution of the City Council as
a recreational area, during any time when the parking meter
adjacent to such parking space indicates that no portion
remains of the period of time for which a coin or coins have
been deposited or beyond the time parking in such place is
otherwise permitted or limited."
SECTION 2. Emergency Ordinance Effective Immediately.
This ordinance is declared by the City Council to be necessary
as an urgency measure for preserving the public peace, health
and safety and shall take effect and be in force upon its
adoption. The reasons for the urgency of this ordinance are
• as follows: Large numbers of temporary visitors will be enter-
ing the City of Newport Beach during the summer months. Most

of these visitors arrive by means of private vehicles and utilize
public parking meters.
The existing ordinance to be amended prohibits overtime
parking by a general provision applicable to all meters within the
City, without regard to the type of area being served. In order to
prevent flagrant violations of the existing overtime parking re-
strictions and to guarantee adequate traffic control and circula-
tion, the City Council by resolution effective immediately is
designating parking meters into three enforcement areas according
to their common use. Due to the fact that present fines are less
than the legal charges for parking in such zones;, a recommendation
has been made to adjust the bail schedule to correspond with each
enforcement area, Separate prohibitions for each enforcement area
are essential for proper law enforcement.
SECTION 3. This ordinance shall be published once in
the official newspaper of the City.
This ordinance was introduced and adopted as an emergency
ordinance at a regular meeting of the City Council of the City of
Newport Beach held on the 24th day of .Tune, 19689 by the following
vote, to wit:
