ORDINANCE NO. 1 2 7 2
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTIONS 20.46.030, 20.46.070,
• 20.48.020, 20.48.060, 20.50.030, 20.51.050,
20.54.020 and 20.54.050 OF THE NEWPORT BEACH
MUNICIPAL CODE RELATING TO ADMINISTRATIVE
FEES AND ZONING APPLICATIONS
The City Council of the City of Newport Beach does ordain
as follows.
SECTION 1. Section 20.46.030 of the Newport Beach
Municipal Code is amended to read:
1120.46.030 Application for Use Permit -e Fee.
Application for Use Permits shall be filed in the office
of the Planning Department in writing on forms prescribed
by the Commission and shall be accompanied by a fee of
One Hundred Fifty Dollars ($150) and by plans and
elevations necessary to show the detail of the proposed
building or use.
• Application for a Use Permit may be made by the
owner, lessee, or agent of the owner of the property
affected. The application shall be signed by the
recorded owner o$ the lessee or may be signed by an
agent of the owner if written authorization from the
record owner is filed with the application."
SECTION 2. Section 20.46.070A of the Newport Beach
Municipal Code is amended to read-
"20.46.070 Use Permit Appeal. A. INITIATION
OF APPEAL. In case the applicant or any other person,
firm or corporation is not satisfied with the action
of the Planning Commission or the Planning Director,
he may appeal in writing to the City Council by filing
a notice of appeal with the City Clerk within 15 days
• following said action. Said notice of appeal shall be
accompanied by a fee of Seventy -Five Dollars ($75)."
SECTION 3. Section 20.48.020A of the Newport Beach
Municipal Code is amended to read.

1120.48.020 Application. A. FILING -- FEE.
Applications for variances shall be made in writing and
• filed in the office of the Planning Department on forms
prescribed by the Commission and shall be accompanied by
a filing fee of One Hundred Fifty Dollars ($150)."
SECTION 4. Section 20.48.060A of the Newport Beach
Municipal Code is amended to read:
1120.48.060 A eal. A. INITIATION OF APPEAL.
In case the applicant or any person, firm or corpora-
tion is not satisfied with the action of the Planning
Commission or the Planning Director, he may appeal to
the City Council by filing a written notice of appeal
with the City Clerk within 15 days after the decision is
made. Said notice of appeal shall be accompanied by a
fee of Seventy -Five Dollars ($75)."
SECTION 5. Section 20.50.030A of the Newport Beach
• Municipal Code is amended to read:
"20.50.030 Application for Permit. A. FEE. Any
application for a Use Permit under the provisions of
this chapter shall be accompanied by a fee of Seven
Hundred Fifty Dollars ($750)."
SECTION 6. Section 20.51.050 of the Newport Beach
Municipal Code is amended to read:
"20.51.050 Application Procedure. At least
sixty (60) days prior to filing an application for
classification of land to a P -C District, all information
shall be submitted to the Planning Director for review
and recommendation. The Planning Director shall ascertain
if the proposal complies with the requirements of this
• Chapter and if the form and content is sufficient to
establish or amend a P -C District. The Planning
Director shall advise the applicant of the sufficiency
or insufficiency of the proposal in order that the

"application, when filed, may be complete and may correspond
to the General Plan of the City.
• Upon determination by the Planning Director that the
application is sufficient as to form and content and
meets the requirements set forth in this Chapter, it
may be filed, after which it shall be set for public
hearing before the Planning Commission. Said application
shall be accompanied by a filing fee of Seven Hundred
Fifty Dollars ($750).
Such application shall be processed by the Planning
Commission and transmitted to the City Council with any
conditions the Planning Commission determines should
be imposed."
SECTION 7. Section 20.54.020 of the Newport Beach
Municipal Code is amended to reads
"20.54.020 Initiation. An amendment may be
• initiated by:
(a) The verified petition of one or more owners
of property affected by the proposed amendment, which
petition shall be filed with the Planning Commission and
shall be accompanied by a fee of Two Hundred Dollars
($200), no part of which shall be returnable to the
petitioner.
(b) Resolution of intention of the City Council.
(c) Resolution of intention of the Planning Commission."
SECTION 8. Section 20.54.050 of the Newport Beach
Municipal Code is amended to reads
"20.54.050 Action by City Council. Upon receipt
of such report from the Planning Commission, or upon
• the expiration of the time limit prescribed in
Section 20.54.040, or upon the filing of any appeal,
the City Council shall set the matter for one public
hearing giving notice thereof as provided by law.

"Notice shall also be given to the Planning Commission
of such appeal, and the Planning Commission shall submit
a report of its findings and recommendations to the City
Council setting forth the reasons for the decision of the
Commission, or the Commission shall be represented at the
hearing. After the conclusion of such hearing, the City
Council may adopt or reject the proposed amendment, or
any part thereof, in such form as the Council may deem
to be advisable, or the Council may refer the matter
back to the Planning Commission for further study and
recommendation. Said notice of appeal shall be
accompanied by a fee of Seventy -Five Dollars ($75).
The decision of the City Council shall be rendered
within sixty days after the receipt of a report and
recommendation of approval from the Planning Commission
or after the expiration of the time limit prescribed
• in Sections 20.54.040, or within sixty days after the
filing of any appeal."
SECTION 9. This ordinance shall be published once in
the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a special meeting of
the City Council of the City of Newport Beach held on the 28th day
of August, 1968, and was adopted on the of +4 day of
1968, by the following vote, to wit:
