ORDINANCE NO. 1 2 8 0
AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADDING
• CHAPTER 15,05 TO TITLE 15 OF THE NEWPORT BEACH
MUNICIPAL CODE TO PROVIDE FOR A UNIFORM MECHANICAL
CODE
The City Council of the City of Newport Beach does ordain
as follows:
SECTION 1. Chapter 15.05 is added to the Newport Beach
Municipal Code to read:
"Chapter 15.05

15.05.010 Adoption of Uniform Building Code Vol. II

Uniform e anica Code. Subject to the particu ar a t ions,
deletions an amendments hereinafter set forth in this Chapter,
the rules, regulations, provisions and conditions set forth in
that certain Code entitled °Uniform Building Code, Volume II -
Uniform Mechanical Code, 1967 Edition ®, which Code is promulgated
and published by the International Conference of Building Offi-
cials and the International Association of Plumbing and Mechanical
Officials (private associations which have been in existence for
a period of more than three years last past), three full printed
copies of which, printed as a Code in book form, were by the
City Council ordered filed and which have been actually filed in
the office of the City Clerk and which, as so on file are hereby
referred to, adopted and made a part hereof as fully and for all
intents and purposes as though set forth herein at length, shall
be and the same are hereby established and adopted as the rules,
regulations, provisions and conditions to be observed and fol-
lowed in the installation and maintenance of heating, ventilating,
comfort cooling and refrigeration systems, of all buildings or
• portions thereof used, designed or intended to be used for human
habitation within the City; and subject to said additions,
deletions and amendments hereinafter set forth, said Code is
hereby established and adopted and the same shall be designated,
known and referred to as the °Mechanical Code' of and for the
City of Newport Beach.

The provisions of the Mechanical Code of the City of
Newport Beach shall apply to and affect all of the incor-
porated territory of Newport Beach, except work located
primarily in a public way, public utility towers and poles,
mechanical equipment not specifically regulated in this
Code, hydraulic floor control structures, facilities for
the production, generation, storage or transmission of
water or electrical energy by a local agency, and'the
buildings and structures of administration and instruction
of public schools,®
15.05.030 Addition of Subsections d e and f of

e(d) Surrender of Permit. If no portion of the work
or construction cover. d Ty a permit issued by the Building
Official under the provisions of this Code has been commenced,
the person to whom such permit has been issued may deliver
• such permit to the Building Official with a request that
such permit be canceled. The Building Official shall there-
upon stamp or write on the face of such permit the words,
"Canceled at the request of the Permittee<" Thereupon such
permit shall be null and void and of no effect.
(e) Refunds, In the event that any person shall have
obtained a ung or grading permit and no portion of the
work or construction covered by such permit shall have been
commenced and such permit shall have been canceled either as
provided for in Subsection (d) of Section 302 or Subsection
(d) of this sections the permittee upon presentation to said
Building Official of a request therefor, in writing on a
special form, shall be entitled to a refund in an amount
equal to 80 per cent of the permit fee actually paid for
such permit,
The Building Official shall satisfy himself as to the
right of such applicant to such refund and each such refund
shall be paid as provided by law for the payment of claims
against the City of Newport Beach.
No portion of the plan- checking fee shall be refunded,
unless no checking has been performed on a set of plans, in
which case 80 per cent of the plan - checking fee shall be
refunded,
• (f) Penalties, The permit fees specified in Sub-
sections (a an c ) of this Section shall be doubled when
work requiring a permit has been started or carried on
prior to obtaining said permit and the applicant had know-
ledge that a permit was necessary, as evidenced by the fact

that at the time of doing such work he held a contractor °s
license with the State of California or had previously
applied for a permit from the Building Department of the
City of Newport Beach, but the payment of such double fee
shall not relieve any persons from fully complying with the
• requirements of this Code in the execution of the work nor
from any other penalties prescribed herein.°
15.05.040 Addition of Section 304.5 to the Mechanical
Code. Sects n 304.5 is added to t e mechanical o e, ereinbe-
ore adopted in Section 15.05.010, to read:
'Sec. 304.5. Processing and Plan - checking fee for
mechan ca nsta lation. when a plan is required to be
submitted y Subsection 303(b) and the system is required
in lieu of the window requirements of the Building Code, a
Processing and Plan- checking fee shall be paid to the
Building Official at the time of submitting plans and speci-
fications for checking. In addition to the above a Process-
ing and Plan- checking fee shall be paid for any mechanical
permit with a fee of $25.00 or larger. For extremely
simple installations this Processing and Plan - checking fee
may be waived by the Building Official, Said Processing
and Plan- checking fee shall be equal to one - fourth of the
fee required for the Mechanical Permit.'
15.05.050 Addition of Section 500.5 to the Mechanical

15.05.060 Addition of Section 1905 to the Mechanical
Code. ect on 1905 is added to the Mechanical Co e, erein e-
fore adopted in Section 15.05.0109 to read:
`Section 1905. There shall be installed in the wall
or ceiling, approximately over the cooking facilities, a
ventilating oP,enin� with a minimum area of eight inches by
six inches (8` x 6 ), connected by an incombustible venti-
lating duct free to the outside of the building. The
ventilating duct for each kitchen shall have a minimum
cross - sectional area of twenty -eight (28) square inches.
An approved forced -draft system of ventilation may be
substituted for the natural -draft ventilating system.'
15.05.070 Amendment to Section 201(c) of the Mechanical

Sec. 201
°(c) Right of Entry
(1) The Building Official, or his duly authorized
representative, shall have the authority to enter any
building or premises for the purpose of investigating the
• existence of suspected or reported damage or defects which
constitute an immediate danger to human life or an immediate
hazard to public safety or health.
(2) Except in emergency situations as defined in
Section 202(d)(1) of this Code, the Building Official, or

his authorized representative, shall not enter any building
or premises without the consent of the owner or occupant
thereof, unless he possess a reasonable search warrant
authorizing entry and search of the premises.
• (3) No person shall hinder or prevent the Building
Official or his authorized representative, in the performance
of the duties hereinbefore described as emergency situations
or while in possession of a valid search warrant, from
entering upon and into any and all premises under his juris-
diction, at all reasonable hours, for the purpose of
inspecting the same to determine whether or not the pro-
visions of this Code and all other applicable laws or
ordinances pertaining.to the protection of persons or pro-
perty, are observed therein.®

Sec. 302
'(b) Plans and S ecifications, Plans and specifica-
tions for t e insta ation ot equipment general, comfort
cooling systems, absorption systems, ventilation systems
and hoods shall be filed with the Building Official and
approved before the issuance of any permit for the following-
1. Any Group A. B, C, D, or E Occupancy.
2, New buildings having an aggregate floor area
including basements of 15,000 square feet and over,
•3. Installations other than those listed in
items 1 and 2 above, where the aggregate Bot,u, input
capacity is 350,000 B >t,u >'s and over for equipment general,
or an aggregate of 25 horsepower and over for comfort
cooling, or an aggregate of 350,000 Bot,u, input capacity
and over for absorption units.
The Building Official may waive the requirement for
plans and specifications for minor installations.
Plans and specifications shall be designed and prepared
by a registered engineer or architect where required by
State law, Plans may be reviewed by other departments of
the City of Newport Beach to verify compliance with the
laws and ordinances under their jurisdiction.
One set of plans and specifications may be filed for
checking provided that not less than two sets of corrected
plans and specifications are filed before approval is given
by the Building Official. After approval one set of plans
shall be returned to the applicant and the other set shall
be retained by the Building Official for field checking.
When the plans and specifications do not comply with
provisions of this Code, the necessary changes or revisions
shall be made thereto.
• Every plan shall be a print or other type of plan
approved by the Building Official. The information con-
tained on the plans shall be clearly legible and specifi-
cally indicated. No plan shall be of a scale smaller than
one - eighth inch (1/8'' per foot,

Specifications, legibly and definitely stated, shall
be included either on the plan or on separate sheets.
The approval of any plans or specifications shall not
be construed to sanction any violation of this Code,
• No person shall deviate materially from any approved
plans or specifications or fail, neglect or refuse to comply
therewith unless permission to do so has been obtained from
the Building Official.
The plans or specifications shall show the following-.
1. Layout for each floor with dimensions of all
working spaces and a legend of all symbols used.
2. Location, size, and material of all piping.
3. Location, size and materials of all air ducts,
air inlets and air outlets.
4. Location of all fans, warm -air furnaces,
boilers, absorption units, refrigerant compressors and con-
densers and the weight of all pieces of such equipment
weighing 200 pounds or more.
5. Rated capacity or horsepower of all boilers,
warm -air furnaces, heat exchangers, blower fans, refrigerant
compressors and absorption units.
6. Location, size and material of all combustion
products vents and chimneys.
• 7. Location and area of all ventilation and
combustion air openings and ducts.
8. Location of all air dampers and fire shutters.
9. First sheet of each set of plans and specifica-
tions shall show the address of the proposed work and the
name and address of the owner or lessee of the premises.
10. Plans and specifications shall be of sufficient
clarity to show that the proposed installation will conform
to the provisions of this Code and of all applicable laws,
ordinances, rules, regulations and orders.
15.05.090 Amendment to Section 420 of the Mechanical
Code. Sect n 420 of the Mechanical Code, hereinbefore adopted
in Section 15.05.010, is amended to change the definition of
the following term only. All words, phrases or terms not here-
inafter defined by Amendment shall have the same meaning as set
forth in Section 420.
'READILY ACCESSIBLE means capable of being reached
safely and quickly for operation, repair, or inspection
without requiring those to whom ready accessis requisite
to climb over or remove obstacles without the use of
portable ladders.'

'Sec. 1202. Location of comfort cooling equipment

shall comply with the zoning ordinance.
Cooling coils installed as a portion of, or in
connection with, any warm -air furnace shall be arranged to
comply with the requirements of Section 705.
• No direct refrigerating system containing any Group 2
refrigerant shall serve any air cooling or air conditioning
system used for human comfort.
An approved means shall be provided for the collection
and disposal of condensate from every air cooling coil for
any comfort cooling system to outside the building or to
an approved drain.
When any comfort cooling equipment, other than ducts
and piping is suspended from the underfloor construction,
a minimum clearance of not less than six inches (6 ") shall
be provided between the base of the equipment and the
ground.
The minimum condensate drain size shall be not less
than three - fourths of an inch (3/4 ") and shall drain over
the top of an approved plumbing fixture or to a suitable
sandpit to the outside of the building or to other approved
means .'

'Sec. 202. Penalty for Violations. Any person,
firm, corporat ration, partners p or co- partnership who
wilfully violates any of the provisions or fails to comply
with any of the mandatory requirements of this Title is
guilty of a misdemeanor, and upon conviction thereof, shall
be punishable by a fine of not to exceed Five Hundred
Dollars ($500) or by imprisonment in the City Jail, not to
exceed six (6) months or by both fine and imprisonment,
except that nothing contained herein shall be deemed to bar
any legal, equitable, or summary remedy to which the City
of Newport Beach or other political subdivision, or any
person, firm, corporation, partnership or co- partnership
may otherwise be entitled, and the City of Newport Beach
or any other political subdivision or person, firm, corpora-
tion, partnership or co- partnership, may file a suit in the
superior court of the County of Orange, and restrain or
enjoin any attempted or proposed subdivision or sale in
violation of this Title.'
SECTION 2, This ordinance shall be published once in the
official newspaper of the City, and the same shall be effective thirty
• (30) days after the date of its adoption.
