AN ORDINANCE OF THE CITY OF NEWPORT BEACH
REZONING PROPERTY AND AMENDING A PORTION OF
DISTRICT MAP NO. 52 AND PREZONING UNINCORPORATED
TERRITORY ADJACENT TO THE CITY OF NEWPORT BEACH
IN THE EVENT OF SUBSEQUENT ANNEXATION
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1: The following described real property in
the City of Newport Beach, County of Orange, State of California,
to wit:
That portion of Block 96 of Irvine's subdivision in the
County of Orange, State of California, as shown on a map
recorded in Book 1, page 88 of Miscellaneous Record Maps,
records of said Orange County, California, described as
follows:
BEGINNING at a point on the northeasterly line of said
Block 96, distant South 49° 23' 25" East 240.00 feet
from the northerly corner of the southeasterly half of
said Block 96, said point being an angle point in the
northerly line of Section 8 Rezoning as described in
the City of Newport Beach Ordinance No. 1142; thence
along said northerly line the following courses:
South 64° 51' 35" West 1810.00 feet; thence North
16° 08' 25" West 325.00 feet; thence North 580 23' 25"
West 140.00 feet; thence North 77° 23' 25" West 560.00
feet; thence South 89° 06' 35" West 550.00 •feet; thence
South 13° 46' 35" West 102.22 feet to a point in the
northerly line of Section 5 Rezoning as described in
the City of Newport Beach Ordinance No. 1142, said
point being in a non- tangent curve, concave northerly
having a radius of 600.00 feet, a radial line from said
point bears North 60 18' 51" East; thence westerly 43.97
feet along said curve through a central angle of 4° 11' 57"
to a point in the centerline of Marguerite Avenue as
described in a deed recorded in Book 8187, page 556 of
Official Records of said Orange County, California, thence
along said centerline of Marguerite Avenue North 110 57' 37"
East 701.77 feet to the centerline of San Joaquin Hills
Road as described in said deed, said point being in a curve,
concave northerly having a radius of 2200.00 feet, a radial
line from said point bears North 120 30' 33" East; thence
southeasterly 65.21 feet along said centerline curve through
a central angle of 11 41' 54" to a point in said centerline
of San Joaquin Hills Road as described in a deed recorded
in Book 9060, page 934 of Official Records of said Orange
County, California; thence continuing southeasterly
340.34 feet along said centerline curve through a central
angle of 80 51' 49 "; thence South 880 03' 10" East 778.00
feet; thence along the proposed centerline of San Joaquin
Hills Road the following courses: South 88° 03' 10" East

155.05 feet to the beginning of a tangent curve, concave
northerly having a radius of 4000.00 feet; thence easterly
118.16 feet along said curve through a central angle of
1° 41' 33 "; thence South 89° 44' 43" East 607.38 feet;
thence leaving said proposed centerline North 0° 15' 17"
East 60.00 feet to an angle point in that certain land
described in a deed to Pacific View Memorial Park recorded
in Book 4518, page 207 of Official Records of said Orange
County, California; thence along the southeasterly line
of said land North 40° 36' 28" East 300.21 feet to said
northeasterly line of Block 96; thence along said north-
easterly line South 49° 23' 25" West 565.50 feet to said
northerly corner of the southeasterly half of Block 96;
thence continuing along said northerly line South
490 23' 25" East 240.00 feet to the POINT OF BEGINNING.
CONTAINING: 42.446 acres, more or less, gross
SUBJECT TO: All Covenants, Rights, Rights -of -Way and
Easements of Record,
as shown on District Map No. 52, referred to in Section 20.06.030
of the Newport Beach Municipal Code, and by such reference made a
part of Title 20 of Said Code, is hereby rezoned from an R -3 -B
District to an R -1-B District, and said District Map No. 52 is
hereby amended to show this zoning change.
SECTION 2: The Planning Director of the City of Newport
Beach is hereby instructed and directed to change District Map No.
52 so as to show the zoning change described in Section 1 hereof,
and as said District Map shall have been so amended, the same
shall be in full force and effect and be a part of Title 20 of
the Newport Beach Municipal Code.
SECTION 3: California Government Code, Section 65859,
provides that a city may prezone unincorporated territory for
the purpose of determining the zoning that will apply to such
property in the event of subsequent annexation to the City.
SECTION 4: The following described real property
which is unincorporated territory adjoining the City of Newport
Beach, County of Orange, State of California, to wit:
That .portion of Block 97,,.,Ir.vine's Subdivision,_in the County
of Orange, State o.f California as per,;,map Map Book 1,
page 88,'Miscelianeous Record Maps in the office of'the
County Recorder of said County, described as follows:

Beginning at the Southwest one - quarter corner of
said Block 97, said corner being.-in the boundary
of Newport Beach as established by Annexation No. 57,
per.Resolution No. 6203 of said. -City; thence North
49° 23' 25" West 212.08 feet along the southwest line
of said Block and boundary to a point on..a.non- tangent
curve concave Northerly having::a.radius of 1940.00 feet,
a radial to said point bears South 81 43' 23." East;
thence leaving said boundary Easterly 100.68 feet along
said curve through an angle of -.2° 58'. 25 "; thence North
780 18' 12" East 91.45 feet to the beginning of a curve
concave Southerly having a radius of 2060.00 feet;
thence Easterly 91.76 feet along said-curve through
an angle of 2° 33' 08 "; thence non - tangent South 9 °08'40"
East 120.00 feet along a radial to.said curve to a point
on a non - tangent curve concave Southeasterly having a
radius of 25.00 feet, a radial to said point bears
North 90 08' 40" West; thence Southwesterly 35.74 feet
along said curve through an angle of 81° 54' 20 "; thence
South 1° 03' 00" East 149.16 feet to the Southwest line
of said Block and said boundary; thence North 49° 23' 25"
West 156.29 feet along said Southwest line and boundary
to the POINT OF BEGINNING.
CONTAINING: 0.959 acres, more or less, gross,
is hereby prezoned to an R -1 -B District.
SECTION 5. The Planning Director of the City of Newport
Beach is hereby instructed and directed to change District Map
No. 52 so as to show the prezoning, described in Section 4 hereof,
and as said District Map shall have been so amended, the same
shall be in full force and effect and be a part of Title 20 of
the Newport Beach Municipal Code.
SECTION 6. The zoning of the territory described in
Section 4 as an R -1 -B District shall become effective only if
the annexation of said unincorporated territory is completed
and shall have the same effective date as said annexation.
SECTION 7. This ordinance shall be published once in
the official newspaper of the City, and the same shall be
effective 30 days after the date of its adoption.

This ordinance was introduced at a regular meeting
of the City Council of the City of Newport Beach held on the
23rd day of November 1970, and was adopted on the
14th day of December 1970, by the following vote,
to wit:
